Howard Stern's SiriusXm Radio Lawsuit THROWN OUT By Judge!

Uh-oh! Guess this was a bust!
Howard Stern's lawsuit against SiriusXm Radio, which he filed last year as he claimed that he "was bilked out of stock awards SiriusXM promised him," when they acquired XM and totaled more than $300 million, has been thrown out of the New York State Supreme Court!
According to Judge Barbara Kapnick in a letter dated yesterday, the contract between the parties “is inconsistent with any reading that the parties intended subscribers acquired by merger with XM to be considered.”
Ouch! We certainly didn't see this one coming!
Especially given the last details we heard about this case!
SiriusXm dodged one helluva bullet there!

Hopefully he will be able to deal with this decision, although I doubt it. Not sure how his contract was worded, although according to him, they promised him residuals & money according to the number of subscribers.
