Shooting Victim's Mother Sues Cinema!

| Filed under: Legal MattersSad Sad

colorado-century-16-shooting.jpg

Oh this is all so horrifically f*cked up!

The mother of 36 year-old Rebecca Wingo - one of the 12 fatalities of the James Holmes Dark Knight Rises shootings - has decided to sue the Centrury 16 movie theater where the mass-killings took place, claiming their exit doors should have been more secure!

It is widely believed James Holmes had bought a ticket to the midnight showing of Dark Knight Rises and waited for 15 mins in screen 9, before exiting through one set of emergency doors leaving them propped open for convenient re-entry.

Shirley Wygal has supposedly secured an LA lawyer who will file a lawsuit alleging the movie theater in question should have had alarm-sensitive emergency exits, or should have had security personal guarding the doors.

As we've previously reported, unharmed eye witness Torrence Brown is also suing the Century 16 theater, as well as Holmes' doctors and Warner Bros.

While we can't begin to imagine the anger, heartbreak, and helplessness those effected by this disturbing crime are currently experiencing, suing an innocent company that had NOTHING to do with the depraved acts of one individual seems a tad excessive.

Plus, even if the doors had been more secure, we're sure James would have found some other way to execute his sick plan.

All we can hope for is that justice will be SWIFTLY and effectively served to Mr. James Holmes.

I do not get her suing the theater. The doors were shut, no matter how secure they were. The gun man was going to prop them open. I do not see how the theater was going to prevent this. Why not sue the guy who shot everyone……well we all know that answer. The theater has money.

  2. 2

Anything to make a buck, right Shirley Wygal? It must be soooooooo easy to say that someone "should have" had different doors; it's sooooooooo easy to have perfect hindsight. I suppose it's how you justify turning your adult daughter's death into an opportunity for gain for yourself, right? Why should you, Shirley, benefit? And how will money make you feel better? What's wrong, Shirley … are you smart enough to realize that suing the shooter won't get you a fucking dime, so you're going after the innocent theater owner(s) instead? No, this is wrong. Shirley Wygal should have the shit kicked out of her greedy, selfish ass. I hope a jury awards her NOTHING. Shirley Wygal is an asshole.

I think the victims and their families (for those who are no longer with us) have every right to sue the cinema. They are absolutely correct–the exits should have been better secured with alarms like most fire exits are. Would the gunman have found another way? Maybe. But, that is completely beside the point.

PS–ANYONE who was in the theater during the shooting is a victim–you don't have to have a bullet wound to be considered a victim in the heinous crime. These people will likely suffer from PTSD and depression for a very long time.

Re: Yes You Bore Me – You don't think the fact that her daughter is DEAD feels enough like getting the shit kicked out of her?

  5. 5

Suing everyone but the man who went on a shooting spree make logical sense. Its not the theaters fault, she was even suggesting that the theater should have had armed guards at the door because they were watching such a dangerous movie lol. No one could for see this event happening, just like know one could for see 9/11.

  6. 6

I feel truly devastated for the victims but if people get blood money from the innocent that's just messed up!

its sad what money will make people do, shouldn't they be grieving, and trying to move on with their lives instead of planning where they're going to get compensated for their loved ones death. only in america can u get away with even thinking about suing a place that had absolutely nothing to do with the shooting besides showing the movie at midnight. i really hope that they throw out this lawsuit and every other lawsuit that isnt against the bastard who actually shot the people.

  8. 8

Re: Robyn – Apparently not if she's suing people who aren't responsible for the shootings. You can't figure that out on your own?

Re: Yes You Bore Me – It is a completely normal part of the grieving cycle to try and blame everyone (including yourself) for a tragedy. Educate yourself.

  10. 10

Really disgusting. Her daughter was in her 30s and had children of her own, and here is her mother less than 2 weeks later trying to make a buck off her death.

There was absolutely no reasonable expectation that a gunman would come in and attack at the theater. I live in Colorado and have personally attended movies at that very theater and never for one moment felt unsafe. The door is an EXIT door, not an EMERGENCY EXIT door. The only person who should be sued is the terrorist that committed the crime.

She should be suing the NRA. The NRA are murderers. They are also responsible for the Gabby Giffords bullet through the head. They have been weakening gun control laws for decades. THEY HAVE BLOOD ON THEIR HANDS!!!

  12. 12

Did anyone sue the theatre where Lincoln was murdered? No.

Money won't help you get over the incident, or the devastating loss of a child.

  13. 13

Poor woman, even if she wins, she will still not get any closure for her daughter's death

Sure, turn every public space in America into militarized zone. What a way to live - what a happy and carefree environment. It's all very logical, arm your hillbilly butts to the hilt and go to the movies.
What happened in Aurora is a tragedy. But it's an increasingly common one. People should take their anger out on corrupt politicians in the pocket of the gun lobby. Unless guns are controlled there's no chance of this ever stopping.

  15. suckitracistscum says – reply to this

    15

I agree, there should have been alarms on the doors (don't know if it would have done much but..). I don't know if this is the norm in most theaters or not. I agree everyone in there is a victim. Having said that, I don't know how far suing is going to take them. The real issue here is gun control. I'd be looking for someone to sue who felt it was okay that this guy could amass a militia's worth of amo and think it was perfectly eh okay.

  16. 16

This whole american trend of suing everybody is such a weird concept to me! leave justice to the police/courts - it is not for one individual to get a different justice to the other victims families. What makes this woman believe she should get a huge payout where the rest of the families will not? The deaths are awful, it was an awful thing which happened but none of the victims families deserve any more than the exact same as the others. The cinema is a victim too not to blame, that's like blaming the world trade centres for falling on 9/11!

What a horrible mother. Trying to cash out on her daughters death

  18. 18

    The suit makes no sense.
Everyone is trying to figure out how they would have stopped this a-hole. He was DETERMINED to do what he was doing and would have figure out another way to commit murder.

The security doors are also exits to the parking. The cinema is not at fault. Sounds like a lawyer grasping for money.

  19. demode says – reply to this

    19

Perez…. this is where you are wrong. The theatre should have had alarms on all doors. They also should have had security guards to monitor the the entire theatre, in the same way that a mall is monitored, from a controlled station. These theatre chains, who make big bucks, often provide no security to theatres that are teaming with hundreds to thousands of people. This makes these theatres unsafe, and these theatre chains need to start hiring proper security.

  20. 20

The mother is raw right now and wants to lash out at someone because she can't at the shooter. Attorneys hit like vultures after an event like this and always get someone. I can't put myself in her place, but every day we walk this earth something can happen. Her child walked in to the theatre they weren't forced in. She will get something from it, but not what she is hoping which I dont think has anything to do with money.

  21. 21

Holding anyone accountable, besides the shooter, makes absolutely no sense.

Your comment " even if the doors had been more secure, we're sure James would have found some other way to execute his sick plan" interests me. I agree, he would have found another way to get in had the security been tighter at the movie theater. This is the same argument most people would argue about the gun control issue. You've clearly stated that you believe this could have been prevented with stricter gun control laws, however you acknowledge that if he was hell bent on committing this heinous incident he would have found any way to do it. So why can't you acknowledge that the same would go for the guns?

  22. 22

Re: Robyn – 1st of all, it's is not beside the point if he would have found another way in. you don't plan this type of attack for months to be dissuaded by a single locked door. if he hadn't come in the side, he would have come in the front. but on the same token, why stop at suing the cinema? She should also sue the people who gave him the scholarship that brought him to the city. And sue the gas station that fueled the car he drove there, and perhaps the doctor who delivered him at birth. Then she should sue the news for showing people that guns can be used to kill, and sue the constitution for him being allowed to have a gun in the first place. Why in the world isn't she suing, i don't know, the gunman? oh right, cause it's not about justice, it's about money. The theatre didn't stockpile ammo with the intent to kill innocent people, I can't believe people like you support this kind of thing. :-(

  23. 23

Re: Yes You Bore Me – Are you Perez Hilton?? Because you're a FUCKING BULLY!

  24. 24

i cant even feel bad for that victims mom.

  25. 25

Re: lilkornfreak00 – aside from the comment about kicking the lady's ass, i think "Yes You Bore Me's" comment was SPOT on. How is anything that poster said being any more of a bully than this woman who is trying to bully a completely innocent business for money over a crime they had absolutely nothing to do with? People in America defend everyone owning guns by saying "guns don't kill people, people kill people". So by the same token, cinema's don't kill people, people kill people. This isn't a case where a fire broke out and the door wasn't maintained and people got stuck. This is a madman coming into a room and shooting to death innocent people.

  26. 26

Listen if they haven't learn their lesson from 20 something years ago & stop selling AUTOMATIC WEAPONS AT THE CORNER STORE TO ANY BODY THAT COMES IN you cant be surprised and call it tragic…….
    THIS IS TRAGIC:
2 year old girl walking down a brooklyn street with her father is shot in a drive by
4 year old boy is shot in a brooklyn playground…..

SUING IS THE AMERICAN WAY….they all suck

  27. 27

    SashaSkye said it best.

This woman is absolutely disgusting and so is her lawyer. That's like a house guest killing someone else in your home & instead of suing the killer they sued you. Where in the WORLD does that make any sense?

  28. Janelle says – reply to this

    28

honestly I get wanting someone to blame and yes the doors should have been secure. However, the shooter probably would have just went in the front door and started firing at people in multiple places. More people could have died. Its just so sad.

  29. 29

Suing the cinema isn't going to help anything, it isn't going to stop what happened or bring any of the back. It is a HORRIBLE situation and NEVER should have happened. But as others have said he would have found a way around a locked or alarmed door, he clearly wasn't dumb. An armed security guard? Really? What cinema has one of those, and I'm sorry but this movie was not NEARLY as violent as so many others out. He picked this movie because he knew it would have a huge turn out, he wasn't going to go shoot up a movie with a couple of viewers.

Re: boston61 – Shut up idiot. 150 MILLION OTHER PEOPLE did not kill anyone with a gun. Theres 311 million people in this nation with 150+ million firearms, one guy shot up a bunch of people..Just shut up. Most NRA members think idiots like you shouldn't have guns.

I never heard anything about NRA members stopping a massacre.
    Cowards?

  33. 33

Re: wet chicken with guns – NRA is just a gun club that makes sure our 2nd amendment rights aren't taken away from us. Some NRAs dont have concealed weapons permits or anything of that sort. You're statement literally made no fucking sense at all.

On their own the NRA is pretty much powerless, however its the MONEY that they use to scare the shit out of politicians. If a politician goes on a crusade to ban guns, the NRA will use LOTS of money to 'destroy' him, as well as heavily fund the people who oppose him. The NRA is no different than the large amount of left wing organizations. Like GLAAD,PETA,Etc.

Theater exit doors are never alarmed. They are used as a form of egress. Why would it be alarmed? People use them to leave all the time and in a full movie many theaters open them so people have both the front and rear doors open to leave. People get up and leave through these exit doors in the middle of movies. You can't alarm them. Who has ever been to a movie theater that had guards at exit doors? I have never seen it in my whole life nor would I expect it. It's these lawyers the egg people on to pursue these cases knowingly full well they have no legal basis for a case, but our hoping that they get some money in a settlement as these businesses don't want the bad press. They are vultures.
