James Franco Fires Back At Sacked NYU Professor Suing Him Over "Bad Teacher" Comments!

james franco lawsuit

Here it comes! We can already see it now:

James Franco's next academic adventure to secure a law degree!

If you recall, the actor has some serious beef with Jose Angel Santana, the former NYU professor who sued the school for what he claims was unfair termination from his job for giving his famous student a "D" grade…and then turned him litigious claws on James himself after justifying his poor marks on the fact that he was a "bad teacher!"

Yeah, seriously. This is an actual court case.

Regardless, the Oz The Great and Powerful star is NOT taking Santana's request for a default judgment in the favor of his defamation suit lying down, and has officially filed a response!

Apparently, Santana claims he deserves to be awarded judgment because Franco never responded to the 2011 filing, but now, Franco is asserting that he was never properly served with the legal documents, and on that grounds alone, the suit should be thrown out!

Furthermore, he doesn't believe his now-public opinion that Santana is a "bad teacher" is grounds for suing someone, anyway, as it's protected under free speech!

Inneresting predicament, don't U think??

We'll be very curious to see if/how this develops in the courtroom!

But for the time being…

What do U think, legal minds? Is James protected under free speech in this case?

I have lost so much respect for James Franco over all of this. I was once a student of Jose's and let me tell you, he is one of the finest acting teachers I have ever had the privilege to study from. James Franco is such a jerk to not fess up and say, "Yeah, I never went to class and I deserved the grade I received." But, nope, he has chosen otherwise. Hollywood entitlement at its finest.

Free speech is a very misunderstood concept. What it does is protect your speech from government reaction, not from personal reaction. The prof's problem is that he will have to prove that Franco's comment caused him any real or professional damage. I doubt the guy has any case for that.

GOD James Franco is so full of shit. Didn't get what he wanted and of course he didn't blame it on himself. I feel bad for the professor and he should sue him! He prolly lost his reputation as a prof so hell yes I'd be pis-s-ed off too.

Having worked in the world of academics for a long time I can say with relative confidence that James Franco is being a big baby. You got the grade you earned. Get over it and get over yourself.

Students who went to class gave the professor good to excellent reviews. If you cut 90% of the classes how could you know if the teacher was good or not??? Making derogatory false statements to the press is usually considered slander, not freedom of speech.

He received a D because he was absent from class because he was filming 127 Hours, for which he was oscar nominated. In an earlier interview he was not concerned and even laughed about it. The professor lost his job when his contract was up and the school said it had nothing to do with James Franco. The professor blamed Mr. Franco. It was after the professor's public attack on him that James made his comments. Those of you unfairly judging James Franco do not have all he facts.
