I think this means she will take a plea deal at the last minute (of course, nothing but last minute drama for Lucky Lohan). If she doesn stick with Heller-on-wheels, and does go to trial, and is thinking she'll skate - it wouldn't surprise me either. Dee-lusional is Lindsay's middle name. But on the other hand - it's quite possible that Heller could get her off the 3 counts of lying, obstruction and reckless driving - by claiming she had a concussion and couldn't think straight. Even though she did go back to work hours after the accident - he could bring in witnesses who said she couldn't remember her lines (they're probably easy to find since she never arrives on set knowing her lines, geez, the easiest part of being an actress eludes lying Lohan). So she could quite possibly walk out of that courtroom a free woman. Not violating probation, and no jail, no community service, no rehab, no nada. Free to terrorize the streets of LA and NY and the nightclubs again. I don't see anything stopping this idiot until she kills someone with her rented Porsche.

City prosecutors who convicted her of theft from a Venice jeweler are not interested in a jail sentence because it could mean as few as eight to 10 days behind bars due to overcrowding, according to sources.
Prosecutors are concerned that Lohan, 26, is a potential danger to the public and herself and believe they should curtail her behavior with effective treatment, say sources familiar with the prosecution.
Lohan could plead no contest to the judge and throw herself at his mercy at sentencing, stepping around negotiations with prosecutors, according to one scenario. But that could be a risky proposition.
Not only is it risky, but highly unlikely. There's no reason for the judge to be any less merciless than agreeing to 90 days in a rehabilitation facility.
