los angeles sheriffs department mistakenly kills tosh0 production assistant thought was knife wielding assailant tragic west hollywood

This is horrible!

Police just released details of a shooting that occurred in West Hollywood on Monday and everything we're learning about the tragic event is just AWFUL!

It all started when Los Angeles County Sheriff's Department responded to an “assault with a deadly weapon, man with a knife” call at a WeHo apartment building. In the fray, it looks like the sherifs accidentally mistook one of the victims for a suspect and one of them wound up shooting and killing an innocent man named John Winkler.

John, a WeHo resident 30-year-old production assistant on Tosh.0, was being held captive that night with two others at knife-point.

As law enforcement arrived on the scene and entered the building, they saw two victims rush out of the apartment unit where they believed the incident was taking place. The first, an unidentified victim, had a knife wound in his neck and bled from it profusely.

The second man, Mr. Winkler, whose appearance apparently matched the description they were given of the knife-wielding suspect, ran out the door right behind him. According to the report, he followed victim number one out the door in such away where it appeared he was lunging after him.

Believing they were witnessing a deadly assault in progress, three sheriff's deputies shot at John.

One bullet struck John and another struck the first victim. Both victims went down to the ground.

The police then moved inside the unit and encountered two other men involved in an altercation. One of them, 27-year-old Alexander McDonald, had reportedly overpowered a third victim and was choking him. There was also a large knife nearby on the floor.

Deputies used physical force to subdue Mr. McDonald and took him into custody.

John Winkler was rushed to the hospital, but he died from injuries sustained by the single gunshot wound. The other two victims were also treated at the hospital and they are doing much better. One was released already and the other is in stable condition.

Investigators have examined the evidence and determined that Alexander McDonald is the main suspect in the case. They allege he held all three men captive at knife-point.

Alexander was arrested and charged with one count of murder, two counts of attempted murder, and one count of torture. He is currently in custody and his bail is now set at four million dollars.

It's unclear exactly what, if anything, could happen to the deputies who responded to the call.

Either way this is one of the saddest cases of mistaken identity we have ever heard.

Our hearts go out to John's friends and family, the other victims, and everyone else affected by this completely awful tragedy.

But he didn't have a knife right??? So how could he have been the armed assailant if he wasn't armed!!!! Cops are SOOO trigger happy and lack logic. It is more dangerous to call the cops than not.

Stop calling the cops! They kill the wrong people every single day.

I refuse to believe with all the so-called "training" that the officers wouldn't have had enough mental clarity or forethought to at least shoot the victim(s) in non life-threatening parts of their bodies. It hurts to get shot anywhere, a police officer should be capable of aiming for an arm, leg, shoulder, hip and not causing a fatal wound. There's also shouting "stop, police!" or declaring your intention to shoot if the assailant doesn't stop moving…just some thoughts.

Typical LA police for you, shoot first, ask questions later! People seriously need to question what the police are doing- they do this all the time and it is NOT their job! Why do police even need negotiators anymore if they're just going to go in with guns blazing and not caring about who's the victim and who's the perpetrator! F*in sick!

    Really sad, may he RIP.

Can someone explain to me why the suspect is being charged with murder. He didn't actually kill anyone. The cops are the ones that shot and killed the victim.

They say the man they accidentally killed was mistook as the attacker and thats why they shot him? But then why did they shoot the 1st person out of the door, who by this reasoning must of been one of the victims? Why? Because police are a bunch of trigger happy thugs with a licence to kill.

the same thing happened to a girl in new york last year. these officers are not being trained properly to handle these situations. i really dont understand how this could happen. it's awful.

If they could stop the real assailant by using force w/o a gun
what was stopping them from doing that to the "alleged" assailant aka the victim John Winkler

This shouldn't have happened. No one should have died.

Re: AG55 – Agree!! How can they charge him with murder??

  12. 12

uh, the police officer technically shot and killed the victim… not the suspect. what the actual eff.

Re: AG55 – You can be charged with murder if someone dies while you are in the commission of a crime. For example if you car jack someone, and as that person is crossing the road to the pay phone to call the police they get hit by a car the car jacker is responsible as they wouldn't have been on the road had you not car jacked them.

so….they murdered this guy, then charged the actual kidnapper with murder? Because I don't see anywhere in here that Andrew Macdonald had killed anyone or that they found any bodies, OTHER THAN the fucking corpse the LAPD created. what the fuck

  15. jimmyjenkins says – reply to this

Re: Jaded – so, is that true even if it's the police who killed the victim? If that's the case, any officer could go into any kidnapping situation & turn it into a murder situation on his own accord really quickly, & get away with it. Like, "I'm sick of dealing with you. BAM BAM BAM. now you're a murderer (even though I killed them)."

Re: Strangeasitmay – Exactly. If they thought he was trying to assault the first victim, why was the first victim also shot? Can they not aim? Regardless, this is a true tragedy. RIP

As heinous as this Mr. Macdonald is. Why is he charged with murder and not the officers?

Re: AG55 – McDonald's action caused the death and in CA if you put into action an event and someone dies you are charged with murder.
