Tracy Morgan VS Walmart: 30 Rock Star Fires Back After Store Blames Him For Tragic Accident!

We couldn't believe what Walmart's response was to the injured comedian's lawsuit — and we don't think he can either!

Tracy Morgan decided to make a statement following the response that Walmart made this week, indicating they blamed Tracy for the accident that left him in critical condition!

The company's lawyers said on Monday in a filing that the accident was "caused, in whole or in part, by plaintiffs' failure to properly wear an appropriate available seat belt restraint device," and that Morgan and the other people in the car "acted unreasonably and in disregard of (their) own best interests."

Well, Tracy has fired back and it sounds like he's upset! And we don't blame him!

Here's what Tracy Morgan said in a statement on Tuesday:

"After I heard what Walmart said in court I felt I had to speak out. I can't believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."

We're glad to hear that Tracy WON'T be taking this lying down, and it sounds like he's ready for battle with the super-duper chain stores.

And if that's the case then we're assuming he's recovered a ton from his injuries that he sustained in the car wreck that left one of his friends dead and his own life in serious danger!

Sounds like Walmart kind of backed down, as well, since their original filing. They said in a statement on Tuesday:

"Walmart is committed to working to resolve all of the remaining issues as a result of the accident. As part of the ordinary course of legal proceedings, Walmart filed an initial response yesterday to the lawsuit that included facts and defenses that may impact the case moving forward. While we were required to respond to the lawsuit, we have also taken steps to encourage settlement discussions. Our thoughts continue to go out to everyone involved, and we remain committed to doing what's right."

Sounds like some legal mumbo jumbo to us!

This defense of no-seatbelt argument that they're going with isn't even allowed in 30 states, but unfortunately it IS a valid thing in New Jersey!

However, this ain't over yet!

We'll see them and Tracy in court! Because this willful comedian WON'T back down!

And we LOVE that about him! Good luck, Tracy!!!

    He is required by law to wear a seatbelt and that was HIS responsibility. The driver that caused the accident is still responsible but he may have sustained further injury by not following the law by wearing a seatbelt and thusly protecting himself from further injury.

    Walmart is not blaming him for the accident.
    They are saying his injuries would have been less severe if he had been wearing a seat belt. Which is exactly right.

    There is good reason why everyone is told they need to wear a seatbelt. In case of a crash it helps reduce injuries. He is an idiot for not knowing this.

    It's called contributory negligence, in that Tracy's negligence in failing to wear a seat belt as required by law contributed to the extent of the injuries/death suffered. It's a theory in tort that is designed to mitigate/reduce/share in the damages a judge/jury would award an injured plaintiff. For example, if the damages were $100,000, and it was found that Tracy was negligent by 20%, his award would be reduced by 20%. It's not a complete defense, but one that reduces liability.

    I get what Walmart is trying to do. Legally trying to cover your ass is par for the course in cases like this, but c'mon! Buses like the one that Tracy was traveling on RARELY have seatbelts. Seatbelt or not, he was SEVERLY injured and a man DIED in an accident caused by THEIR driver. Srsly, they need to shut the hell up and pay up.

    If Tracey and they guy that died had been wearing a seat belt maybe he would still be alive. They aren't saying their driver wasn't at fault for the accident but that if the guys had been wearing their seat belt like the LAW says then maybe there injuries wouldn't have been as bad.

    It was the truck driver's fault for causing the accident, but it was Morgan's fault for not wearing his seatbelt. Just because you are sitting in a limo doesn't exempt you from the law and personal responsibility for your safety.

    He should have been wearing a seatbelt! Yes, the Walmart driver is guilty too!

    Who wears a seatbelt in a limo? NOBODY. EVER. It is NOT required by law, so get your facts straight or shut it.

    New Jersey’s Seat Belt Law: (NJS 39:3-76.2f) :
    Applies to all passenger vehicles including vans, pickup trucks and SUV's, that are required to be equipped with seat belts

    Notice the omission of limos and busses? The fact that this needs explaining is a sign that America is just plain stupid, and Walmart(s driver) is completely at fault here, period.
