Robert Durst, the subject of the HBO crime documentary series The Jinx, is ready to face trial.
But will the best evidence against him even be admissible?

In a Today show interview Tuesday morning, lawyer Dick DeGuerin stated that he believed L.A. prosecutors who charged Durst with murder "jumped the gun because of the television show."
DeGuerin is arguing that Durst's stunning confession — that he made while speaking to himself in the bathroom while still wearing a live mic — should be ignored! He argued:
"That's not a confession."
Of course, DeGuerin says if it was up to him, Durst never would have appeared in The Jinx in the first place! He said:
"Yes, he didn't take the good advice that he got from lawyers other than me. I didn't talk to him about it, he didn't ask me about it, but he didn't take that advice, and he was tricked as he was told probably would happen."
Wait — HE WAS TRICKED?? DeGuerin asserted:
"There's no question. It's all in the editing. The editing was designed for good television, but it wasn't designed to get to the truth."
Right now, DeGuerin is defending Durst on lesser charges in Louisiana before facing the murder charge back in Los Angeles.
