Amber Marchese and her husband Jim (real name James) haven't forgotten about that domestic violence arrest back in April.
In case you forgot, Jim was arrested at LAX for domestic violence after allegedly assaulting his wife on an airplane. Reportedly, a Virgin America flight attendant called the police after the RHONJ stars boarded a red-eye flight and Jim allegedly grabbed his lady by throat and threatened to harm her.
Shortly after, the Marriage Boot Camp: Reality Stars contestants released a statement saying:
"The District Attorney's office as well as the City Attorney refused to press charges after reviewing the lack of evidence in the case against James Marchese. The false eyewitness reports caused LAPD to wrongfully arrest Mr. Marchese for felony abuse, with both District Attorney and City Attorney finding no merit in the allegations. James and Amber always vehemently contended the false report from the start."
Now, months later, Jim and Amber have filed a lawsuit against the airline for false imprisonment and defamation, according to E! News.
Court docs say Amber and Jim claim they were simply engaging in "flirtatious" behavior and were actually not fighting at the time of the incident.
Jim also promised to file a civil action suit against the airline for the company's "disgusting, hurtful defamatory act which caused the police to take such extreme action resulting in horrible rumors."
Mr. Marchese tells the outlet the entire ordeal is "absurd" and "doesn't make any sense":
"We had spent two and a half weeks shooting [the show] which was so much fun and we had just finished a promotional photo shoot…We got on the plane and the next thing you know, my wife is in handcuffs and I'm being escorted off the flight."
Meanwhile, a spokesperson for Virgin America says:
"There is no merit to this lawsuit and Virgin America will defend the claims made against our Teammate."
