Family Of 10-Year-Old Boy Decapitated On Water Slide Reaches Wrongful Death Settlement With Park

We can't imagine what this family has gone through. But hopefully, this settlement eases their pain.

Last year, Kansas State Representative Scott Schwab tragically lost his 10-year-old son, Caleb, who was killed while riding the world's tallest waterslide at Kansas City's Schlitterbahn water park.

Police later confirmed the boy had been horrifically decapitated while on the Verrückt slide.

At the time, the family had filed a petition for a wrongful death settlement with Johnson County District Court, against the park's owners and the raft manufacturer.

On Wednesday, Judge Thomas Sutherland approved the settlement, saying it was "fair, reasonable, valid, just, and equitable," and was "in the best interests of all plaintiffs."

According to the Kansas City Star, the agreement also allows Caleb's family to file more claims against "potentially culpable and liable parties," like Verrückt's designer and builder.

The family's attorney, Michael Rader, confirmed "additional claims are being pursued against others." However, he said in a statement that he can't release any more details about the settlement, saying:

"The Schwab family remains determined to hold all those responsible for this tragedy accountable, while doing all they can to ensure this never happens again to another family. … In the near future we will be allowed to disclose further specifics regarding the settlement."

The Kansas City police had also been investigating whether or not there was any criminal wrongdoing in connection with this case, and a spokesperson revealed on Wednesday that the investigation was done and submitted to the Wyandotte County District Attorney's Office.

The state is also reviewing the case through the Kansas Attorney General's Office.

Back in November, Schlitterbahn closed the deadly waterslide for good.

Our hearts are with everyone affected by this terrible tragedy, and we hope this settlement brings closure.
