15-Year-Old Girl EXPELLED For Reporting Rape By 'Star Athlete' — Now She's Fighting Back!

Just awful.

A lawsuit in federal court is fighting back on behalf of a female student at Cousino High School who was EXPELLED after reporting being sexually assaulted by an older student, who just so happened to be the school's "star athlete."

According to the court docs reported by local news WXYZ, Salvatore Prescott & Porter law firm alleges the victim (identified as Jane Doe) was 15 years old when she entered a relationship with the alleged suspect (John Roe), who was 18 at the time, at the beginning of her freshman year.

On May 15, 2015, the docs go on, John allegedly asked Jane to go to his car with him in the school parking lot. Once there, they got into the backseat where he locked the doors and demanded oral sex.

According to the lawsuit:

"Jane Doe started to comply with John Roe's demand, but then told him it was 'gross' and that she wanted to stop. John Roe said, 'oh well,' and then he forcibly pushed Jane Doe's head down toward his lap and forced her mouth onto his penis."

Days later, Jane was questioned by school officials about the incident (without her parents knowledge), only for the assistant principal to "criticize Jane Doe's clothing, intimating that Jane Doe invited unwanted sexual attention because of the way she was dressed."

Jane reportedly left questioning feeling "nervous and sad," especially because she was threatened with expulsion from school.

Even though Jane filled out a witness statement form, she told John otherwise out of fear:

"She reached out to John Roe and told him, falsely, that she hadn't said anything to the school administrators. She did not want him to retaliate against her, or to spread rumors about her."

When officials asked John about the incident, he said the oral sex was consensual and he was allowed to attend a track meet the very same day — not to mention, he was free and clear to continue his education.

The lawsuit states that Jane was expelled by the district on June 29, 2015 — and during the appeal was asked questions like, "Do you feel remorseful for your actions?" while being told not to "let this incident define you."

Jane has supposedly (and understandably) struggled significantly over the past year as she's having to attend virtual and alternative schools while dealing with credit card debt.

We're really hoping justice is served here — as this sends a TERRIBLE message to young women (and men!) who are afraid to come forward after being assaulted.

We'll keep you updated as we learn more.
