    WALMART is a HORRIBLE company! so you pay 10 cents less for a bottle of detergent. it IS NOT WORTH IT! they are an evil company. the meat department at a super walmart tried to unionize and it shut the whole department down! they don't care about their employees, and this article just proves what everyone already knows. Walmart would rather pay it's lawyers to recover this disabled woman's money than do the right thing and let the poor girl keep it. imagine what the lawyer's costs were for this? they probably end up getting next to nothing anyways. this is RIDICULOUS!

    walmart is a horrible, HORRIBLE company! They are helping to perpetuate a cycle of ignorance and poverty in this country and (eventually) abroad.

    One of our friends is in a suit against them after a manager supported drugging and gay bashing of him…on store property and while everyone involved was "on the clock". They fired our friend (after he had to go to the hospital on company time) and transferred the "bashers" to other stores. Nice things like that happen in oklahomo!…Ask sally kern.

    Unfortunately, they are so big and use their buying power to keep everything so cheap, no one (who matters anyway) will ever really boycott them.

    They suck. Go to TARGET!

    Such a sad story. Anyone who has a benefits plan through their employer should read that policy. It is standard that if your benefits plan pays you out and you then receive a settlement that you have to reimburse the benefits plan.

    After being obessed with your website for, I don't know, FOREVER! It is sad to say, that my first comment had to be posted, regarding this story. However it is MY FIRST, so Whoohoooo!
    This is such a sad story, and it is not the first time Walmart has been involved in this kind of scenario. They are constanly involved in cases such as this one. So, I was thinking, since you have been on a "Let's do good" spree, why don't you write a letter to Walmart (about how selfish and unethical they are), and have people on your website sign it (sort of like a petition). This might make a difference to that poor family and do wonders! I'm obviously in! :0)

    This is absolutely horrible…there is a time to be professional but then there is a time to be caring. Why can't Wal-Mart just give them a donation of the amount and not even go through the legal stuff. Or why doesn't Wal-Mart set up a donation account and give it to the family? I'm really really starting to dislike Wal-Mart…in fact we could have easily sued them when I was little but this was before everyone sued over everything…so God knows how much we would have been able to get…Lately though the store has just totally went downhill for me…it's dirty, the workers are mean, the lines are long, and when you self-check out and have a problem there is no one to help. Just the other day we went to Wal-Mart on Easter to get some candy (hopefully on sale) and they totally had packed it up completely, the guy said they sold out…bull crap! They rather pack that crap up then to sell it on sale….DO NOT SHOP AT WAL-MART….THEY DO NOT CARE! We had to go to freakin' Rite Aide to get last minute easter bunnies lol.

    They can't make their money, if you don't support them. Who cares if you have to pay a little extra, it means at least you know that you aren't fucking their employees. Their belief is 20%full time and 80% part time and after you worked there 5 yrs, believe that you will be fired so you don't receive benefits.

    People who are saying "fuck Wal-Mart" really need to read this story again and stop saying this blindly. Wal-Mart is doing nothing wrong!!! It was her stupid lawyer who sued for an amount that was well below what she was predicted to get (after his 50+% was taken out). You would think that a descent lawyer would have doubled the claim and there wouldn't be a problem. 99% of insurance policies have this clause and if you are stupid enough to sign a policy and not fully understand what you are signing, then you are the dumbass. It is not Wal-Mart's or the government's responsibility to bail her out of this problem that her lawyer got her into. Private donations, family, friends, her church should raise to the occasion. Or maybe some of you should seek her out and give a donation.

    Wal Mart had every right to recoup the money. People should learn to read the small print, it's small for a reason. Another example of people trying to suck money out of corporations because "we need it more than they do". What a ridiculous mentality. Everyone wants to benefit from circumstances like this, Debbie is lucky to be alive. It's sad her son died in Iraq but our soldiers die in Iraq every day, that's just life, and it doesn't entitle you to money you don't deserve. Bottom line, life sucks. People get in accidents, soldiers are killed in Iraq and life is a bitch, but that shouldn't make you feel entitled to hald a million dollars that's not yours.

    Let me say this after reading the comments made by the lawyer for Wal-Mart. Legally, they did not have to take the money despite their claims. I am a lawyer and I know that exceptions can be made despite what is written. Just becuase there is a law on the books, doesn't mean it has to be inforced. Its these types of lawyers that give the rest of us a bad wrap!

    I'm sorry but the woman knew when she signed up for the insurance that if she was reimbursed for any medical treatment she would have to pay it back. What she did was called double dipping and it's illegal. I feel badly that she has ongoing problems but that doesn't give her the right to take money that isn't hers.

    A contract is a contract, people. This is a prime example of why you should READ what you SIGN. Yeah, it really sucks, but it could have been avoided if she read the contract, and if her lawyer did his job. Don't blame Wal-Mart for following their policies and a legal contract.

    First off READ EVERYTHING before signing anything. 2ndly more people everyday know exactly how Walmart treats its employees, and does its business, yet everyone shops there because the prices are always considerably cheaper than what they would be anywhere else, but, with those cheap prices comes a price, Walmart does not pay its employees their worth by any means, so there is most likely public assistance reciepants, which means tax dollars, Then, you consider the fact that walmart sells things that aren't always the best quality so you may be buying another one of whatever it is soon, which means you might as well buy two.
    The fact of the matter is Wal-mart will never do the right thing, they cover themselves with the story about making exceptions yada yada yada, the truth of the matter is they wanted to make an example out of someone and poor Debbie happened to be it. For making 90 BILLION dollars, they sure don't do much good for their communities, look at all the waste they create..I have seen dumpsters full of clothes and ect. behind Walmart, not to mention any dented can etc, also gets thrown away…not even donated just thrown away….

    Has nothing to do with Wal-Mart….this is standard for most insurance carriers. It does suck, but that's the way it works. It prevents people from "double dipping" having insurance pay for everything and then keeping the cash they get in a settlement.

    How how how can people do this to peoples. Rules are meant to keep order and all that but they're also meant to be broken. This woman needs every dime she can get to just get by for the rest of her life. She's been stripped of her dignity, her child, husband, and now the very money needed to keep her cared for. This mentality is why America is where it is. We are a generous people who want to help eachother. Or that's what we used to be.

    I hope WalMart decides to do the right thing.

    This family is from my hometown. The story has been in the news for a little over a year now and it is very sad. The couple's oldest son has been a friend for awhile and he has been through so much, First his mom's accident, then the money situation, and then his brother died in Iraq. If people really want to help, not shopping at Wal-Mart won't do much to help our the Shanks. You can go on Facebook and search for her name in Groups, and contact the family to send donations if anyone really wants to help out :)

    This weekend I shopped at Walmart, Target and Best Buy. Spent roughly $50 at each for my daughters birthday. Christmas 2007 bought $1500 plasma at Walmart. Weekly trips to such stores as Meijers, Walmart Target over the year total roughly $1300/month. We are a typical American family I believe and if Walmart can be this heartless to this dead soldier's family, I cannot and will not continue to shop there. I don't dare what their Board of Directors has to do but if they don't make this right, I know I and many other mothers and fathers in my middle class area will no longer care about saving a couple dollars here and there. This is just tooooooo much!

    I live in SC and about five or more years ago we had a local girl that worked for Sams Club which is owned by Walmart or vice versa. This girl had worked for them for about 8 or 9 years and she got lukemia and needed a bone marrow transplant to save her life her church had raised the money for what insurance would not cover and she had a doner but she had already reached her insurance pay out for the year and it was about November so Walmarts health insurance denied her to have the surgery said she had to wait till January for her benefits to start again and then they would pay for it. Her doctor said that by January it would be to late she would not be healthy enough for the surgery. Walmart would not make any exceptions and she died around febuary it was very sad for our small town.

But it is unfortunate that the Supreme Court will not hear the case. It looks as if the family will have to pay back to Wal Mart what they paid for her health care all because her family sued the person who caused the accident and they got a huge settlement.     I don't shop at walmart anymore and this is part of the reason. They're cold and heartless, and the sad part is that they're the largest retail department store in North America. They give no money to charity, rarely pay state taxes, and screw their employees out of their overtime pay. Now, even though they had a multi-billion dollar profit last year, they're concern is getting back $400,000 from a poor woman that clearly needs help. I hope every Wal Mart burns to the ground. Shop at Target! Even though they're less profitable than Wal Mart, they still manage to donate 6% of their profits to local charities. The few extra dollars I spend at Target are well worth it. The stores are cleaner and run better anyway!

    You're an idiot. This woman had no bargaining power against Wal-Mart. She is lower-class, rural, and uneducated. She was not in any position to turn down a Wal-Mart job or their insurance even if she understood the subrogation clause. It is unconscionable for Wal-Mart to enforce their subrogation clause when an employee is catastrophically injured. The truck driver's insurance was inadequate. This woman was not going to be fully compensated for her injuries. She paid her insurance dues to Wal-Mart. They should not get away with paying nothing, and they should not try to subrogate the claim until the employee has been fully compensated for her injuries. That is actually how most companies do it. Wal-Mart is being extremely aggressive in this case, and they are ignoring the best interests of Ms. Shanks. Any halfway-moral company would not treat its employees this way.

    I'm Debbie Shank's son, Chris. I've read all the comments and seen that there are some people who are looking for a way to help. Well, if you read this and want to help, we set up a fund for mom at Bank of America. All you need to do is go to any Bank of America location and say "I want to donate some money to the Debbie Shank fund." and they should be able to help you from there. As far as the claims that rich people have already taken note and donated a lot of money, that's simply not true. At this moment, we currently have enough money in that fund to help mom out for about 5 or 6 months. After that, I don't know what we can do. Even Medicare and Medicaid doesn't cover everything and we still have to pay a certain amount every month to the nursing home. But, that's assuming nothing bad happens to mom (knock on wood). That would deplete the funds even more. What's more, after Wal-Mart won their money in this case, there's still a matter of about $150,000 in unpaid hospital bills and the hospitals are going right after my dad in this case. So, he's probably looking at selling his home to pay everyone off, and moving/starting a new loan in his mid-50s. One could say he'll be paying this off for the rest of his life. But, anyway, if any of you want to help, there's how you do it. If you want to fundraise, by all means, do so. Thank you all for caring!
