    Uh, this can happen to anyone with insurance. If I am in an accident, my insurance company will try to recoup the loss through any suit/settlement. A good lawyer will know that and recover damages and future care costs. Really not Walmart's faut. Although they could help a bit.

    I am disgusted by Wal-Mart is doing to that poor family. It is clear that Wal-Mart does not take care of their employees. Its’ bad enough they pay workers minimum wages and make a fortune off of slave labour from third world countries. Wal-Mart makes billions off the suffering of others; operating as a leach sucking out the life of people for profit.

    The Evil Empire has struck again! Wal-Mart has a long history of mistreating their employees. They will hire part time employees and work them 39.5 hours a week. If they don't work 40hrs a week, NO MEDICAL BENEFITS!! BOYCOTT Wal-Mart!!! They are a huge part of everything that is WRONG with our country!

    Some people don't have any heart. It's 100% absurd that Wal-Mart should "need" under $300,000 from some poor family who will be left with nothing. The founder of Wal-mart, Sam Walton, was one of the richest men in the US during his lifetime. His many (five?) children who benefited from his will are now STILL among the richest people in the US. WAL-MART does NOT need $300,000. Give it back to this family, and continue to make billions of dollars a year, fuckers.

    This lady got screwed by her lawyers NOT Walmart. If anything Walmart has been incredibly generous.

    Her lawyers did not sue for enough money, they shouldn't even call themselves lawyers if they did not realize that Walmart health plan had every right to re-claim the money for medical expenses that they paid. The lawyers should have known they needed to sue for medical expenses PLUS extended care. That's ridiculous. This woman got completely disserviced by her lawyers, I'd say ROBBED, and then the lawyer has the gall to charge $583,000 for screwing her over???

    However her lawyer is should be disbarred. Walmart has absolutely no guilt in this situation.

    "Walmart - The High Cost of Low Prices" - I encourage anyone who has time to check that out on youtube. The horrible way that Walmart and the Walton family treat employees all over the globe would have Sam Walton rolling in his grave. Not only do we have to worry about getting robbed/raped/kidnapped in their parking lots - they get away with fleecing small town america and putting BILLIONS in their own pockets while their employees are forced to go on public assistance and work hours they are not being paid for. Please take the time to watch the video and ask your friends to watch as well. TOGETHER we can make a difference. Walmart will NEVER see another penny from me and I hope they will never see another penny from you.

    Well people shouldnt sign something and then expect out of it. If you sign any other contract youre bound to its rules. It sucks what happened to her but if walmart makes an exception to her than they'll get bombarded by other employees wanting compensation. I think publicitizing a women's horrible time on the news and the public is horrible. let her be and go about another way to have fundraizers and things to raise money for her.     Fine print or not, those people had the information. Rules are rules and one exception opens the doors for tons of lawsuits from other Wal*Mart employees that followed the rules and paid their money. If they're really interested in doing the 'right' thing, they'll stop whining and pay as I'm sure many others have before them. Special treatment is never the right thing.

Its incredibly sad what this lady has gone through and her family should sue (the people they originally sued) for more money.     It's a sad story but Walmart is within their rights. Especially if the accident didn't happen at work. I deal with this everyday. It is not walmart's responsibility to take care of her…as for not being able to work, thats what disability is for. It is a terrible thing that happened to her but NOT walmarts fault.

    Walmart sucks and should be shut down, but they are within their legal rights. Shank accepted the terms of the plan by going on the insurance plan. At least she had coverage up front. Wal-Mart (even though all of them should burn to the ground) is still entitled to recover.

The people that would suffer…the low income people that shop at walmart.     Of course they want the money back. Not to put in the pockets of greedy execs at WalMart, but to go back into the plan. Like it or not, that's where the money belongs. What a sad story, but it's not WalMart's fault. Nor is it Blue Cross's fault. If she was at home with a "back injury", collecting benefits and not working, I doubt anyone would question the logic here. Yes, it's terrible that she was so badly injured, but you're pointing the finger at the wrong people. Feel free to dislike WalMart for any number of other reasons, but this story is completely emotional. It would be illegal for them not to demand their money back, and furthermore, it would be unfair to the other policyholders, whose premiums are based upon payments collected vs expenses paid. Sad, sad story for the family involved. FYI…WalMart didn't send her son to Iraq. Again, pointing the finger at the wrong people. Her attorney made a nice chunk of change and possibly even earned it. Any personal injury attorney should know the effect of the subrogation clause. Sorry Perez, WalMart has done the right thing. If you generous people want to contribute to the family, knock yourself out. Sadly, there are many families with incapacitated loved ones who need money for care. The most annoying part of the story is that CNN played the pity card to evoke an emotional response. Just report the news, damnit!

    Just another reason that I refuse to shop at HELLmart. They have run off all of our local department stores like Ames, G.C. Murphy's, Hills, Woolworth's, etc. Nobody is getting rich except the HELLmart family and as far as I know they don't donate to any charities or organizations. They treat their employees like crap and this incident just confirms my case. So very sad!

    Perez, i just wanted to thank you for featuring this article. I grew up in Jackson MO and know these folks–Jackson is a very small town. Their son that died was in my youngest brother's class, and this entire ordeal has been heartbreaking for everyone who knows the Shank family. They are good, hard-working people and do not deserve to be treated like this by Wal Mart. I just appreciate you calling attention to their story. peace&bless-e.

A while back they purposedly hired illegal Hispanic immigrants (because we all know perfectly well that all illegals are Hispaincs right??!! There are absolutely no European, African or Asian illegals in this country…only Hispanics, especially Mexicans and Salvadorans….stupidity thou has a name and it is Minutemen) and then contacted ICE that arrested and deported these immigrants. Needless to say, they could give away stuff for free, I still would not go there.

    Why are you hating onwalmart so much when the insurance plan was up front. They signed on to these benefits. If the company makes an exception for her than 100,00 other poor stories will come out of the wood work and can win in court due to this case. Premiums for health insurance go up because of cases like these where the insurance company has to shell out a lot of money. It WOULD be benficial to the rest of the working force to take the money back. SHould walmart have a abenfit or offer free product- YES. Are they obligated to- NO. Say what you want about Walmart but if it were not for them in some small towns there would be NO jobs and people could not afford simple things. This woman has a sad sad story and if it were my family, I too would try everything I could to get the money… Walmart is not in the wrong here though.

    Walmart will never do the right thing. My aunt worked for them years back and she paid into her long/short term benefits and walmart denied paying her the money she paid into it after she had her brain tumor operation. Not to mention that currently they charge their employees around $500-600 a month for health benefits that are POOR and in the next year are looking to raise it another $100. I know a family that has to drop their health coverage because they can't afford to pay what Walmart wants to keep their coverage. A store like that, that makes the money they do and that's what they do to their employees? It's really sad. They don't pay them enough to pay for healthcare like that. It's rediculous. And when they give money to "charitable causes" they end up cutting the employees hours to make up for the money they gave. So they get it back in a tax right off AND from cutting hours from families that need the money. It's a disgrace.

    The sad thing is, they're not entirely clear with people about their health benefits. They always find a way around being honest and doing the right thing. It's sad.
    It's also sad that they run smaller businesses out. They're monopolizing and it's getting out of control. They know people will shop there because the economy is hurting and their prices are lower than everywhere else.

    Thank you, Perez. I am rethinking my patronization of Walmart. While subrogation is common, it can be waived. Or, Walmart could donate to the trust fund of its employee to offset the amount it takes back in subrogation. Marcy Graham is an excellent attorney, though. That is one positive light from the story. The woman is well represented.

    I am a personnel manager for Wal-mart and I know for a fact that they have insurance plans as low as $3 per paycheck and none of the plans come anywhere close to $500 per month. As far as them denying the short term/long term claim–they don't make the decisions on that–the insurance company The Hartford does. You are severly misinformed about many things.
