    I hate Wal-Mart. A Wal-Mart truck driver killed my uncle, and he never even got out of the truck to help. My aunt had to sit there and watched him die. I hope there is a special place in hell waiting for the people that run this company.

    I think they should abolish this 'rule'. I've never heard of being punished by your insurance company for winning damages in a law suit. Why should Walmart 'recoup' their costs? They haven't lost anything. They agreed to provide insurance and that's what they did. To say they want it back is appauling!! On a side note, I don't see why they keep telling her that her son was killed in Iraq. She's severly brain damaged. If she keeps on believeing he's still alive for the rest of her life what harm will that do. Let the poor thing believe her son is still alive. She's in a bad enough situation already, it won't do her any harm.

    I think we need to look at this from an objective point of view. If wal-mart pays her then they will need to pay everyone else in this situation. more and more people will bring up this case in court as a defense and then what is wal-mart going to do? their 90 billion dollar profit is going to be paying disabled people. also, this whole son dying in Iraq… yes its very sad however it is just the media trying to get people to side with her. they're tugging at your heart strings. in reality it is completely irrelevant to the case at hand. what does the passing of her son have to do with an accident that occurred a few years prior? just a thought. im going to side with wal-mart on this one.

    I'm so glad you posted this for the Shanks family, Perez! I just read this on CNN! It's so pathetic. The Shanks deserve the $. I know Walmart is worried about future lawsuits if they allow the Shanks to retain their almost $500,000 but for heaven's sake, can't a 900 billion corporation like Walmart make an exception?? Good grief. Walmart certainly has the monopoly on - THE WORLD. PS ~ Not only is Debbie permanently brain damaged, her son lost his life serving in Iraq, as well, a week after they lost their plea.     while this is sad, insurance companies are not here so you can "make money" on your terrible accident. if your ins company pays for your medical bills and part of your settlement is for medical expenses then, yes, you do need to refund the money to the ins. co. any money for pain and suffering and what not is yours. typically a settlement is negotiated between the ins co and the other responsible party. can you imagine the mess if people expected the company health plan to pay for all the "BACK AND KNEE PAIN AND PSYCHOLOGICAL TRAUMA" caused by a minor fender bender and then they also sue the auto carrier and whammo, instant payday! insurance companies have the right to subrogate, otherwise theyd be in a bigger mess than they are. READ YOU PLAN BOOK PEOPLE!!!

    Just today a friend of mine dragged me to Wal-Mart and as we walked across the parking lot . I said to her "I hate f/ucking Wal-Mart" she asked me why..well.. here, this is another example.
    I NEVER shop there (and I hated to even have to walk around in there with a friend) and have boycotted them for many years.
    Wal-Mart is totally unscrupulous in every way. They are abusing the health care system by not taking care of their workers and the taxpayers have to foot the bill, so that they can make an annual profit of 90 Billion. And that's just the tip of the Iceberg! They also knowingly import a major amount of goods from child labour manufacturers. There a thousand more examples..

    They were within thier rights as pertaining to the contract. It sucks, yes. But if they were able to win a lawsuit, why didnt thier lawyers see the clause? Obviously they didnt care because that would have to be a pretty big oversight. The world sucks, and things happen like this all the time in the corporate world. They dont care about this women and are playing to thier own expenses but its within thier right. Its the law. If every judicial decision was based on pure emotion than there would be just too many shades of gray.

    That being, the family is an awful situation and something should be done. But the question is, who is responsible? Instead of posting a link and bashing the company, how about starting up something to help them?

    It is simple, wal-mart holds up their end of the policy. I mean that is what policies are for.     Someone posted "it's not up to corporate American to fix it." I propose that it's really up to the people who fuck things up the most, to fix them. In the case of our current, global policies and societies, corporate America is indeed fucking up, big time (specific examples include, but are not limited to: the loss of actual legislative power by American citizens, the destruction of the environment, a hierarchical economical system that is leaving the vast majority of the world in poverty and mayhem…).     Cripes, my mom fell in broken glass on the floor at walmart and cut her leg open (huge!) and they refused to pay her medical bill for the stitches! They wouldn't do a thing. They "reviewed the tape and determined they weren't at fault". She came around a corner where someone had broken a jar and it hadn't been cleaned up yet, she didn't see it as she rounded the corner and slipped right in it with a manager standing there..not blocking it or hollering out to people to watch out for it!

    I feel awful for this lady. Walmart SUCKS. :(

    I'm wondering if people actually think that WalMart and WalMart's insurance company are on the brink of bankruptcy. That is so wrong and hardly the case. The point is WalMart could afford to pay this off without increasing the premiums of ANYBODY. They should accept the suits of people who lawfully have the right to be asking for money.

I guess i'm not in the latter category, because I would love if WalMart raised their prices and became a place of affordable, responsible, organic, sustainable products that didn't invest in sweatshops and corporate greed.
    We shouldn't just demand "business" for "business' " sake in lieu of demanding ethical business practices. It's possible to make enough to comfortably live without having to demand more and more. People in charge of these corporations and lawyers hired by them don't give a rat's ass about people like this woman (and CNN's, albeit biased story, makes that clear), when they've spent their lives preparing for nothing but pampering themselves at whatever cost.

    Insurance is a privilege by a company it is NOT required. Wal-Mart paid and they deserve to the recoup that money if there is a lawsuit. If Wal-Mart would have not payed out the money this poor family would be in major DEBIT with medical expenses.. thats why they lost the case.. Wal-Mart did their part.

    It seems like Wal-Mart has exploited the US consumer and it's employees for far too long. Unfortunately there are still quite a bit of people who shop there.
