    I have a solution that could solve everything…Perez, be a hero…give the family the money.
    This would win you incredible amount of respect and save a heart-broken family. For the rest of your life, you would know you were an angel to a family that has been devastated. And it's a win, win, win, win, win, win, win, win, win, win, win,WIN situation. These people would have resources to survive, you could always know you saved a family from tragedy, and even if you are jaded–the rest of this country–including the stars you stalk–would see your generosity, and probably give you whatever you needed for a story.     Yes Wal-Mart makes a lot of money. Yes this situation is horrible and sad. However, if you look at it from the other point of view, they are trying to keep the cost of health insurance down for everyone else by recouping what they paid out. The situation sucks and I wish Wal-mart would just donate more than the 500K back to the family…but I can see where they aren't do anything wrong if I had to look at it the other way.

    It is amazing how a retailer who has such a lengthy history of mistreating there employees continues to see such large profits. If we as consumers simply make the right decision; not to shop there; they would eventually be forced to treat there employees with the respect and dignity that all working people deserve. I would not shop there if it was the last retailer on earth, no matter how great their prices are. I simply do not think they deserve a dime of my hard earned money!

    everytime i buy shit at walmart they always try to over charge me on items at the register even though the sign says differently. it just happened to me again yesterday it took me 20 minutes to get $1.07 back because they didn't believe that their sign was wrong in the back until i went back there and showed them. their so cheap

    The lawyer should be sued for malpractice for not reading his client's health contract with Walmart. The policy to recoup in the event of a recovery is customary, and the attorney should have known that. He could have gotten Walmart to waive their right to recoup or also sued for future & PAST (Walmart's) medical expenses.

    That's life. As bad as I feel for her and her family, that is the case with most insurances. I had an auto accident and my lawyer let me know right off the bat that I had to repay my insurances out of my winnings. If the lawyer felt so bad for them then he should have waived his fee. I notice she recieved less then half of that million due to 'legal fees'.

    Sounds like the family's lawyer wanted his share of the take. He informed Walmart only after the settlement, which means he knew the rules of the game. He's at fault, but Wal-mart could have found a way to get the money back to the family anyway and no one, including Perez, would have heard about it The company probably has skyrise full of fancy lawyers who could have found a way without violating the rules.

    I understand it's the Company BENEFIT FUND that's suing, not Walmart, no?

    Additionally, I think the fund covers all medical costs, but can get costs back into the fund (WHICH IS SHARED BY ALL OTHER EMPLOYEES) if a person gets a settlement for medical costs (WHICH WERE PAID BY WALMART ORIGINALLY!!!).

    Your emotional response to this is misleading. You get pissed at companies for doing stuff like this, while you bask in luxury in West Hollywood. If you cared, you and others like you wouldn't live such an extravagant lifestyle.

    I work for Wal-mart. For the two and a half years that I have been with the company our insurance provider has been Blue Cross Blue Shield. Before I worked for Wal-mart my insurance provider was Blue Cross Blue Shield. I was in a car accident that was not my fault. After the accident I received a letter from the insurance company saying that if I received any money from a settlement that I would have to pay it back. From what I understand (I have not ONLY read articles online, I have heard nothing about this at work) Wal-mart does not want the money, Wal-Mart's insurance provider wants it back.

    As for "they should let this one incident pass." There are too many greedy people in this world. Everyone could use more money. If they would let this family keep the money then everyone would want to keep there money no matter how big or small the amount.

    I could go on and on about this, but I won't. This is a very sad story and I hope everything works out for the best.

    I don't shop at Wal-Mart but unfortunately too many people do. C'mon people, it only takes some will power and you're fooled if you think you are saving money by shopping there. I'm surprised by the number of people that still shop at Wal-Mart even though they wish it never existed. It will never go away as long as people continue to shop there.

    It really diminishes an opinion when it is laced with profanity and hate. The inappropriate comments have no credibility and only show what is wrong with the commenter, not the situation. Before you go spouting off, give it 5 seconds more thought. WalMart's policy, like so many others has strict rules, many inforced by federal and employment laws that prohibit one employee being treated differently from any other in the areas of health care, retirement plans, insurance coverage, etc. This is a protection for all employees, not a slight on some. Now, you can be pissed off at WalMart, it won't matter, they will still make billions. Try a write in campaign or a picket outside their headquarters suggesting that they "make a charitable donation" to the woman. Both WalMart and Target give millions to charity and they are able to then write that off (as regular folks are) on their taxes. So, if presented properly, their donation could be written off and the woman could keep her trust money. She's going to need far more than what she has left in trust as it is!
