    Does anyone care that state governments do this as well when their medi-care programs? If someone paid out $X and you got a judgment for medical bills, pain and suffering, etc . . ., the person who paid the medical bills is entitled to the portion of the judgment they paid out/were responsible for.

    This is a sad case. I am not sure if all health care policies say this maybe it was just a shitty one bc that is what Wal-Mart provides. That is the issue, the shitty coverage Wal-Mart gives not Wal-Mart exercising its rights under the law.

    If she didn't like that provision under the plan, she could have got another one (I know no one really reads them.) However, I would assume there are better ones out there.

It's sad that they had to go as far as divorce to get her the help she needs, and that STILL didn't cut it. This is someone who is being screwed by a huge company, is in a sad situation, and can't pay the bills, to no fault of her own. Use your status for some more good!

    I had a similar thing happen after an accident and needed surgery twice on my neck. I felt grateful that my insurance company covered my medical bills until I could get a settlement. The family's lawyer knew from day one that the insurance would recover what they had paid out on medical bills as soon as the family settled. It is explained to you the minute you fill out forms in the doctors office and the emergency room. Why did the lawyer take over half of the settlement? Why didn't he try for a larger settlement? Probably a quick settlement so he could get his money sooner. I feel terrible for the woman but the family is looking for the deep pockets.

    Guys listen up! This applies to everyone. If you're in an accident and your health insurance pays out money and you sue and win money, your insurance company has the right to recoup any monies paid they paid out of that law suit.

    Thank god there are some realistic people posting! Yes it sucks, I can't imagine the pain the family is in, but they signed a contract which they have to follow in order to continue to recieve medical assistance. Imagine how much worse it would be if she got to keep the money but lost insurance? And for those that bash WalMart, think of how many people could be unemployed without it. Sure its not the best thing out there, but thats life and thats America. Corporate greed is very American.

    Whatever… that family should read the fine print. They got paid in the settlement, their bills are all paid, why sue for more money that they shouldn't have in the first place. Walmart is not in the wrong. Peoples kids/sibligs/parents die every day, but that doesn't give you the right to use thier death as the sympathy card to get half a million.

    It is a sad story for that family but it has nothing to do with Wal Mart. They chose to sign the contract that clearly stated Wal Mart could do that. If Wal Mart lets them keep the money then that establishes precident thus leaving Wal Mart open for countless law suits and damages. It is unfortunate but Wal Mart is not responsible for anything outside of their contract. I am sure if the family did not receive a million dollars from their insurance Wal Mart would have paid the costs. It is not about who needs to money more. It is about contract law.

    I'm sorry, I don't see how Wal-Mart or ANY company is responsible for her medical bills that were not the result of Wal-Marts fault? Their size has nothing to do with it. If Wal-Mart wasn't living up to their end of the agreement with the health care participant, they would be expected to change. This is no different. It isn't and shouldn't always be in the "little persons" favor. A side note…I don't shop at Wal-Mart…YIKES!

    It was in the fine print…I hate to say it but in the legal sense, Walmart is entitled the money. BUT, they should make an exception. If they had just allowed the Shanks to keep the money, nobody would've known that they made one exception. Now this blew up, taking away any chance of giving them the money….but then again, insurance is insurance, not charity.

They discriminate against anyone who is not a white male without disabilities, they continue to pump our money into China, they hire illegal undocumented workers, they refuse to give their employees a fair wage, they fight tooth and nail about giving their employees a decent health plan (case in point), all in the name of MONEY… to save a buck.     What's so strange about this. Sounds pretty logical and is common place. The "at fault" driver's insurance company, (or trucking company's insurance), should pay the medical bills and reimbursement the victim's insurance company upfront medical costs. When my MIL was in an accident the same thing happen. I don't get what the big deal is.

    for those of you who keep saying that its a rule and they're just following it, you should read the article a little closer. it actually says that wal-mart has the RIGHT to ask for the money back (eg sue), this does NOT mean that because you recieve a settlement, you automatically have to give back what they gave you. it means if, after reviewing the case, they deem the money they gave unneccisary, they can ask for it back. THEREFORE, my conclusion is that Wal-Marx is a prime example of corporate greed. they are not REQUIRED to get this money back. they just can't bear to be seperated from their precious greenbacks.

    I'll be the first to admit that I'm no fan of Wal Mart. However, they are not totally wrong in wanting reimbursement since their insured received a settlement from another party. The party at fault here in my opinion is the attorney. He should have included all medical costs incurred when trying to reach a settlement. And keep in mind that the attornies took MORE THAN HALF of her settlement. No one is ragging on them. Wal Mart isn't the only company that has done this, just the only one that gets the publicity because of what they are. And honestly, we're all at fault for not reading the fine print–which is what this lady's husband admitted not doing.

    I understand walmart's policy, and yes they should have technically won this lawsuit. BUT i think there needs to be an exception made in this case. this woman will never be able to work and support her family again. she has to be supported now. i think her husband and her younger son have been through enough, losing their other son/brother plus their wife/mom that will never be the same again and do not need to worry about a $200,000 debt to this huge corporation.
    I can honestly stay i will not step foot into a walmart store anytime soon.

I went there once with my son at the time he just turned 2 & was just potty trained & said he had to go the bathroom as I hurried to get him there I rounded a corner & cut my arm open on a large metal shelf brace sticking out after getting my son to the bathroom I went to the manager & told her what happened showed her my arm that was dripping blood & her response was " what do you want me to do?" not I'm sorry or can I get you a band-aid.     I don't think that's right, but my sister in law was hit by a train and is severly brain damaged. She won many law suits and had to pay insurance, lawyers, and everyone else involved. Everyone wants a piece of the pie and they don't give a damn that she needs every dime so that she can afford help in her life.
