    Perez, I am addicted to your website, but you seriously need a lesson in basic economics. This is not a moral issue, but one of legality. If Walmart caves to the bleeding heart bullshit then they will have to bend over for everyone. They can't afford to NOT stick to the fine print because if they don't they will be setting a precedent for every case that follows. The only thing that will happen if this family is let off the hook is Walmart will be forced to "repackage" their benefit plan in a way that won't benefit as many people as the current plan. Don't get me wrong, the situation is horrible and not one I would wish on an enemy, but life isn't always easy. In fact, it sometimes kinda sucks.

    This severely sucks, If people started to boycott the store we could at least cost them a few dollars, I was nearly killed in an explosion where I worked and today I am on the verge of losing everything, I got no compensation from the company and they were so 100% at fault. I get a little workmans comp medical care, but no benefits other than than, not one cent. big business is big for a reason

    I've always been disgusted by Walmart. After hearing this story yesterday I emailed them to tell them I will no longer be shopping with them. Sure, legally Walmart is in the right. Morally, they are cold hearted. I seriously will never shop there. My response from them was that they are indeed forwarding my mail ahead. I'm excited to hear back from them. If we all boycott Walmart maybe they will start treating their people better!!!!

    There must be a lot more to this story than meets the eye in terms of legal obligations. Clearly, Wal-Mart has its hands tied if they are willing to issue a statement admitting the circumstances surrounding the Shank case and still maintain their position. This sounds like a case of Debbie Shank and her family not being aware and/or bothering to read the fine print (which most of us would not) and then having the misfortune of such incidents occurring to them. Then, their lawyers were incompetent and clearly did not sue the trucking company for the amount required to care for Ms. Shank for the rest of her life, which would normally be considered in the settlement.

    That brings me to wonder, was the trucking company actually at fault in the traffic incident, or was Debbie Shank? A one million dollar settlement is extremely low if the trucking company was actually responsible, and it sounds like they just came to a settlement in order to avoid an extensive trial that would require ample expert witnesses (oftentimes each witness brought in, such as a doctor, costs above $50,000 apiece), that they may have lost anyways because of jury sympathy, despite potentially being completely innocent.

    This is an example of where a charity should be started to help the Shanks rather than suing large companies; they must abide by their regulations or our government would eventually capsize in a sea of superfluous lawsuits.

She barely had any left after legal fees and as the Wal-Mart rep said "her circumstances are clearly extraordinary, and unbelievably sad."     This story drives home the point that we, the people, have to become more fully involved in our lives - stop just signing on the lines without reading things - stop expecting corporations to do the right thing without us demanding it of them (by way of electing officials who will work for US, not them!!!). We want everything to be perfect and cosy but we are too lazy to be involved right from the start. We will all feel bad for a week or so for this woman; we will boycott WalMart (some will return); we will yell that it's unjust; but what will we DO???     Any insurance company tries to collect back out of settlements after an accident. This isn't a Walmart specific issue. Check out the fine print in any health insurance policy. It hits the elderly worst when medicare and medicaid do it. It's the right of subrogation and it's the legal right of a first party carrier.

    The fact is that Wal-Mart should bend over for all of their employees. They purposely keep people at part-time hours so they do not qualify for health insurance. And for the employees who are covered, they are not covered well. Employees have to pay the bulk of their coverage from their meager earnings. In fact, after taxes and benefit deductions many Wal-mart employees still live below the poverty line.

    You say read the fine print, but when the only health care options you have is either nothing or your employer's manipulative plan — you take the plan.

    This is just disgusting. I didn't really get it as i'm from the UK and don't really understand the American legal or medical systems.

    But what I do know is that Wal-Mart are shit!!!! They took over one of our biggest supermarket chains ASDA a few years ago, so now not only are the supermarkets shit but they are now called ASDA - Wal-Mart. I don't shop in them and will not do from now on either.

    I work for a rival supermarket and will be taking a serious look at my shares and healthplan contracts that I have with them.

    Perez, you are angry at the wrong thing. Sure, Wal-Mart has some detestible practices that we have all heard about in the news. However, this case simply isn't one of them. How can we be angry in a situation where Wal-Mart simply held up its end of the deal? Wal-Mart's policy aims to help those who do not win money through a trial. Some people have nobody to sue when their health fails. This woman isn't one of them; she won $1,000,000, and that amount represents the number that the judicial system has deemed appropriate. Wal-Mart rightfully takes its money back, The End.

    However, there ARE villians in this story: the lawyers who took over 50% of what she earned, the fact that life just isn't fair, and of course, the journalists who erroneously use heart-wrenching stories such as these in an attempt to paint Corporate America as a cold, heartless force eating up America. Wal-Mart, like any other company, is certainly not perfect, but please don't forget to keep business law in mind when analyzing this case.

    The best thing that can be done in this situation is for readers to donate money to the family. And Perez, I'm sure that you would be able to coordinate this very easily, maybe taking $1 or $2 from each T-Shirt sale and putting it towards this family?

    wait a minute, people are mad that wal-mart is following the law? the contract clearly states that if you win a suit for damages, you can't use company money to pay for medical bills because the person you won the suit against is paying for your bills ALREADY. without giving the money back, she is collecting TWO TIMES for the SAME THING… money from the trucking company and money from walmart. wake up people, most employers utilize this exact same policy, as do most personal insurance plans. yea, this is a horrible situation but this a legal question.
