While Im totally NOT a fan of Wal-Mart and NEVER shop there…I must agree with the courts on this one. I understand that what happened to the lady is tragic, but there are other tragedies every single day that we just dont hear about that we may feel should be an "exception". The lady's husband said Wal-Mart should make an exception…but WHY? I'm sure every single family feels they should be the exception. If the employees want to remove this stipulation, they should band together and get Wal Mart to change their insurance policy. As it is right now, they are paying insurance rates (and the employees are paying their part too) based on the Wal Mart insurer being able to recoup their losses in this way. Change the policy, pay more money for better coverage, but DO NOT OFFER AN EXCEPTION!!!! EVER!!!!!!! Because if you do it for one, you must do it for all.
i actually have a close family friend that works in networking and legal things, and his company had been hired by walmart before (not sure for what)… long story short, his company withdrew their alliance with walmart because of their rudeness and how unmoral and unethical they found walmart to be. they called walmart the lousiest group of people they have ever worked with.

I am really disturbed at all the negative people attacking this poor woman as if she had done something wrong. How do you people expect Walmart employess to purchase all this insurance on their own when Walmart only pays them $6 an hour? In my state you wouldn't even be able to rent a room in a rooming house on that salary. Walmart, the great EVIL empire. I try to avoid Walmart at all costs. I do occassionally go in but I've tried to give my business to their competitors whenever possible. Walmart showed just how money hungry they are when the took away their layaway plan which helped lower income families at crucial times of the year like Christmas. And they keep trying to take over more and more areas of business, not content to kill off all the mom and pop stores in the cities and towns they open stores but also wanting to venture into things they they should stay out of, such as banking. Walmart wants to rule the world….and that scares the hell outta me.
When will everyone boycott walmart once and for all? Wal-Mart made he go see a doctor that Wal-Mart provided, and the bogus doctor released her to go back to work even though she can only work part time, and has double vision out of one eye, and still has back injuries. Because she has to work only part time now, they have reduced her pay and Wal-MArt has said it is because they have to hire another part time employee to cover her part of the shift/ She is also in court and her family is suffering for it. That is bloody awful, however I am not surprised. Health insurance in the United States is a FOR PROFIT situation. Therefore any company, including WallyWorld will do anything to get money back, even if it puts them in a bad light. The USA needs to have a completely different way of health care, to make it not a "for profit" situation, and make it more along the lines of like in Sweden, England, and Canada. Granted, the taxes in those countries are horrible, and there's waiting lists in Canada and England, but at least no one has to pay when they are in the hospital. However, if you think about the lower taxes versus the amount of money people pay toward health insurance per month I think it comes out pretty even. For example, my cousin is a nurse, she gets health insurance through her workplace, but there's still a lot of stuff she has to pay for that her hospital's health insurance policy does not cover, so she pays like $500 a month for health insurance and that's a total of $6000 for a year. I also read somewhere there's like 36 million people in the USA without health insurance. That's like the whole freaking population of Canada with no health insurance. So yeah, while WallyWorld sure looks like they are doing an awful thing, considering the company makes billions of dollars a year, they still want as much money back as they can get. Greedy bastards!

Hello ……many,many, many companies are just like this..Wal-Mart isn't an exception to the rule. If you get hurt on any job, you collect from L&I (eventually), but if you sue any third party, you have to reimburse L&I as well. even though you paid into it . (I know first hand because my husband ended up with a brain related injury in the work place as well, thankfully not as severe as this woman though.)Target is the same way. a lot of people do not really realize this, that's why you have to read the fine print, very carefully and understand it. Insurance companies are in the business of making money, not giving it out.

She sued because she didn't have car insurance to cover her bills, therefor she should pay back her health insurance which is for covering illness. Do you people realize we are at war in Iraq so that corporations can make money? The Iraq war has NOTHING to do with "freedoms" or 9/11, it has to do with corporations seeking to control the world oil supply and make money off the rebuilding. Private contractors are billing the military $60 for a single CAN of coke and billions are unaccounted for. I mean, why was she only awarded $1M in damages originally? She was relatively young when the accident occurred, so if her injuries really require personal care for the rest of her life, then the damages should have been more than $1M, no? Or does MO state law cap personal injury damages at $1M? Perhaps she was partly at fault in the accident. Or perhaps she does not require as much health care as the family is making out. A reasonable person needs more facts before they can make up their minds whether Wal-Mart is as big a villain as the family, their lawyer, and the reporter are making them out to be.

Walmart said they were going to a 'factory-style' meat company (ie their meat SUCKS big time - my dog wouldn't even eat it the one time I bought it) and they all got 'let go' as a 'cost-saving' issue. Trudy, I appreciate that arguement, but the cost is actually higher. People spend no money - and I am talking about pennies less - for cheaper products. THEN, the average worker loses jobs to outside the country and people who work for Walmart properties are hit with less benifits. So, a few pennies saved now for millions of people adds up to the general person losing a lot more in the future. As an aside, my mother works at Sams Club - owned by Walmart - and she has been passed over for a well deserved promotion countless times when they hire a 20 year old (in other words, cheap labor - that is how they keep costs down) over her.

Did you people know that under Universal default a credit card company can jack your interest rate up to 67% on your balance over something as stupid as being late with your phone bill? So you get sick and miss one payment on anything and they will bury you in debt for the rest of your natural life. Does that sound fair? At that rate you would be better off going to the Mafia for a loan. I don't get how this bullshit is even legal. Our whole system is set up to ruin the lives of low income people just trying to survive while rich scumbags hide their money in other countries and don't even pay their taxes.
I manage health insurance for a large company, and issues like this happen all the time. Health plans are bound by their contract and cannot make exceptions for individuals. It is considered "discriminatory" and it opens up a lot of liability if they don't make the exception for everyone else. Most people don't understand the rules and think Wal-mart is just being greedy, but that's not the case. They have no choice.

I am really disturbed at all the negative people attacking this poor woman as if she had done something wrong. How do you people expect Walmart employess to purchase all this insurance on their own when Walmart only pays them $6 an hour? In my state you wouldn't even be able to rent a room in a rooming house on that salary. Corporations are keeping people down on purpose by not paying a living wage, keeping employees at part time hours on purpose so they can't get health benefits, overtime or time and half making it impossible to get ahead. In rural parts of this country Walmart is the only place to work so if you don't work there you would have to live on welfare so what are they to do? Don't even get me started on how banks and credit card companies screw with people who don't understand legal jargon. It's no accident that mutlimillionares are getting richer and richer while average americans are losing their homes and getting saddled with debt they cannot escape. Walmart, the great EVIL empire. I try to avoid Walmart at all costs. I do occassionally go in but I've tried to give my business to their competitors whenever possible. Walmart showed just how money hungry they are when the took away their layaway plan which helped lower income families at crucial times of the year like Christmas. And they keep trying to take over more and more areas of business, not content to kill off all the mom and pop stores in the cities and towns they open stores but also wanting to venture into things they they should stay out of, such as banking. Walmart wants to rule the world….and that scares the hell outta me.
When will everyone boycott walmart once and for all? Yes they may have low prices and in this economy I can understand why people must shop there..But come on, they treat their employees poorly, they pay employees poorly, stock few American made products, do nothing to give back to the communities they reside.

I used to work for walmart and let me tell you…..they FUCKIN' suck!!!!! The management team at the one I worked at are a bunch of idiots! I knew more about how to run the store than them!!!!! Dear Perez, I have to say Wal-mart is the worst company to work for. My kids step mom works for Wal-Mart, and she also had an accident. Wal-Mart made he go see a doctor that Wal-Mart provided, and the bogus doctor released her to go back to work even though she can only work part time, and has double vision out of one eye, and still has back injuries. Because she has to work only part time now, they have reduced her pay and Wal-MArt has said it is because they have to hire another part time employee to cover her part of the shift/ She is also in court and her family is suffering for it. I have never shopped at Wal-Mart for I dont agree with any of their practices, and she is a great step mom. DONT BUT WAL-MART!!
Her attorney screwed up. If he were competent, and for the over 500K HE collected one would think he should be, he would have known there was a medical lien against any award and tried to negotiate it down…he totally screwed up!
The reality is that Walmart CAN allow this poor womans family to keep this money but they are too f-ing greedy to allow it to happen because their attorneys are worried about setting an example they will have to follow in the future with other employees. That is bloody awful, however I am not surprised. Health insurance in the United States is a FOR PROFIT situation. Therefore any company, including WallyWorld will do anything to get money back, even if it puts them in a bad light. The USA needs to have a completely different way of health care, to make it not a "for profit" situation, and make it more along the lines of like in Sweden, England, and Canada. Granted, the taxes in those countries are horrible, and there's waiting lists in Canada and England, but at least no one has to pay when they are in the hospital. However, if you think about the lower taxes versus the amount of money people pay toward health insurance per month I think it comes out pretty even. For example, my cousin is a nurse, she gets health insurance through her workplace, but there's still a lot of stuff she has to pay for that her hospital's health insurance policy does not cover, so she pays like $500 a month for health insurance and that's a total of $6000 for a year. I also read somewhere there's like 36 million people in the USA without health insurance. That's like the whole freaking population of Canada with no health insurance. So yeah, while WallyWorld sure looks like they are doing an awful thing, considering the company makes billions of dollars a year, they still want as much money back as they can get. Greedy bastards!

Hello ……many,many, many companies are just like this..Wal-Mart isn't an exception to the rule. If you get hurt on any job, you collect from L&I (eventually), but if you sue any third party, you have to reimburse L&I as well. even though you paid into it . (I know first hand because my husband ended up with a brain related injury in the work place as well, thankfully not as severe as this woman though.)Target is the same way. a lot of people do not really realize this, that's why you have to read the fine print, very carefully and understand it. Insurance companies are in the business of making money, not giving it out.

She sued because she didn't have car insurance to cover her bills, therefor she should pay back her health insurance which is for covering illness. The story itself is badly reported and full of bias against Wal-Mart. I'm not saying that Wal-Mart is necessarily in the right here. But there are just too many holes in the reported facts to say for sure that Wal-Mart is acting in bad faith. And the reporter is using the facts in a way that is pretty clearly meant to make Wal-Mart look evil. It is bad reporting at best, and malicious/ misleading at worst. I mean, why was she only awarded $1M in damages originally? She was relatively young when the accident occurred, so if her injuries really require personal care for the rest of her life, then the damages should have been more than $1M, no? Or does MO state law cap personal injury damages at $1M? Perhaps she was partly at fault in the accident. Or perhaps she does not require as much health care as the family is making out. A reasonable person needs more facts before they can make up their minds whether Wal-Mart is as big a villain as the family, their lawyer, and the reporter are making them out to be.

Walmart said they were going to a 'factory-style' meat company (ie their meat SUCKS big time - my dog wouldn't even eat it the one time I bought it) and they all got 'let go' as a 'cost-saving' issue. I wish I had the story about it, but I am sure it's out there.

Trudy, I appreciate that arguement, but the cost is actually higher. People spend no money - and I am talking about pennies less - for cheaper products. THEN, the average worker loses jobs to outside the country and people who work for Walmart properties are hit with less benifits. So, a few pennies saved now for millions of people adds up to the general person losing a lot more in the future. As an aside, my mother works at Sams Club - owned by Walmart - and she has been passed over for a well deserved promotion countless times when they hire a 20 year old (in other words, cheap labor - that is how they keep costs down) over her.

Did you people know that under Universal default a credit card company can jack your interest rate up to 67% on your balance over something as stupid as being late with your phone bill? So you get sick and miss one payment on anything and they will bury you in debt for the rest of your natural life. Does that sound fair? I manage health insurance for a large company, and issues like this happen all the time. Health plans are bound by their contract and cannot make exceptions for individuals. It is considered "discriminatory" and it opens up a lot of liability if they don't make the exception for everyone else. Most people don't understand the rules and think Wal-mart is just being greedy, but that's not the case. They have no choice.
