    This is pretty standard, actually. An insurance company gets paid back for the wrongdoing of another insured party. The fact that her attorney didn't tell them this isn't cool, however why didn't they also sue for future needs? Bad attorney!

    I am completely shocked by all the "a contract is a contract" replies to this, those people who are saying that an insurance company has the right to recoup money from a settlement to cover any medical expenses that were paid out. There is something seriously wrong in American society for anyone to agree with this practice. When I hear stories like this it makes me so much more grateful to be a Canadian and for our health care system. This just would not happen in Canada. To all you Americans out there who are outraged about this, don't be outraged about this one case, be outraged that your government allows insurance companies to operate like this! Use your vote in the forthcoming election to put a stop to greedy insurance companies' control over your health care!!

    wal-mart sucks. unfortunately, one of the reasons the corporation makes so much money is because they locate themselves in small ass towns where there's literally no big stores nearby but wal-mart. and especially with those super wal-marts they are making bank because they are open 24 hours. these ppl who shop there don't have much choice b/c it's the closest place for them to get everything they need. IF you live in a bigger city where there's tons of other stores to shop at, DO so. Fuck wal-mart!

    just like any other payment you make, it's all within a contract, wether its your cell phone, car loan, house loan, whatever, you agreed to the terms of service, there for you must abide by them, if you don't you lose out. it's not about greed, it's about rules and regulations, we all have them, so don't be so quick to judge someone or some company over what the rules say they can do. it sickens me that you all are so easy to trash yet you don't read between the lines. you read what you want and you base your judgement on that because you THINK it's not right.

    Wal-Mart exudes mediocrity in every sense imaginable. They are boarish and unsympathetic to the fact that they've altered the built environment in this country forever. They plop their stores in previously undeveloped sites, crappy development and vinylized neighborhoods soon follow and then the company abandons that location for one more favorable, even if only half a mile away. What company can immediately occupy acres of cheap construction fabricated on the premise of bottom dollar? There isn't one, and so the building sits empty as a monument to an enourmous waste of time and resources. This very scenario just happened in the town in which I grew up; the city finally decided to raze the building and use it as fill for a riverbank development project. Oh…and the company also razed a mountain top (literally, it chopped off the top of a mountain) to locate their new store.
    My point is that Wal-Mart treats its employees and contractors similar to the land it sits on; it doesn't give a damn. I hope that some executive down in Arkansas is reading these responses about their company and taking stock; we're tired of you and we won't stand for it anymore. I haven't visited your store in years and I encourage everyone else to do the same. Even the site of your building makes me ill.
    Go to hell, Wal-Mart.

    About the lawyers' fees: I don't think they were excessive. A lot of work goes into a lawsuit. It takes most cases an average of 18 months to reach trial. that's a lot of work and time expended. Besides, if you have to take on a corporate giant like Wal Mart, you're going to need good lawyers and that costs money.

    Lilly, your post makes sense. I am really suspicious of the woman's lawyers. If she had to have constant medical care for the rest of her life, then why did the lawyers let her settle for a measly million dollars? Full-time care is crazy expensive. That money would run out in a hurry. And why did the lawyers get 60% of the payout? My understanding is that a typical personal injury lawyer works on contingency and gets about a third of the recovery. But then again, if the truck company's insurance didn't cover all of the woman's expenses, then I don't understand why Wal-Mart's insurance didn't cover the rest. Unfortunately the story doesn't have any details about Wal-Mart's insurance plan, so I can't tell if Wal-Mart is to blame or not. But if the insurance plan is really that bad, then Wal-Mart probably is at fault because they should have taken better care of their employees. I know some people are saying that the woman should have read the fine print. But please, Wal-Mart has way more bargaining power than her, she probably wasn't in any position to turn down the job even if they didn't offer her insurance. I mean, come one, she was a stock-clerk at Wal-Mart, so she probably wasn't very sophisticated.

    Where is this Walmart's problem and not yours? Walmart provided cut rate insurance that is paying all the medical bills. And if CNN is so shocked, where is their contribution? Better yet, why doesn't Perez donate his extra revenues earned from posting an appallingly judgmental story with inappropriate pictures of a 14 year old girl?

    Just saying…since you’re suddenly so quick to now know what is right, and you seem to love leading the sheep, start us off with your own six figure contribution. When we see you do it, then you will have earned the right to advise any person or company where they should direct their charitable contributions. Until then, you will remain a trivial being who exploits young girls for profit and revenge, while expecting the rest of us to “do the right thing.”

    how is this any fucking different than paying athletes millions of dollars. As if anyone really needs that kind of money. THere should be a law requiring them to donate a percentage of their earnings to charity or to be used as scholarships to educate this country or else we are all doomed!!     This same thing happened to me after a 2003 car wreck. This is in most larger companies insurance policies, in very fine print. All of my insurance settlement went right back to the company I work for.

    hmmm well her situation sucks & I blame her attorney. I could have done a better job than he did & I'm no lawyer. He should have read the insurance contract. That is after all what he was getting paid for. Or advised them not to sue and just keep the regular healthcare. And then he should have figured in the cost of long-term care and asked for an amount that would cover it. Not asked for $1 million and then taken half of it.

    I don't think it's fair to blame Walmart for following their own policy and not being philanthropic. It would be nice if they could save the world, but they are corporate America not the Red Cross.

    Obviously Walmart is living up to their rep. But the family needs to quit reminding her that her son has died. Just tell her he's doing fine and leave at that. I work with Alzheimer's patients who go through the same thing, asking for their parents who have been dead for years. I just tell them "they will be back soon". Within in minutes they forget they asked. Why make them relive the pain over and over. It makes no sense.

    the real effed up part about this is the fact that it said wal-mart 'had the right to' collect. not that they 'had to collect'. saying that wal-mart is bound by certain rules is bullshit. they don't 'have to' they 'took the right to.'

    I may not know much about anything, but I know about this.

    I adjust injury claims for an automobile insurance company. The blaim here lies with… THE ATTORNEY. Every attorney knows that unless they want this exact situation, the subrogation would have to be waived by the health insurer or self insurer. If he went for the cool milliion and was lazy enough to not address the health insurance carrier, then YES, THAT MONEY WOULD BE OWED TO THE HEALTH INSURER BECAUSE THEY HAVE A LIEN ON ANY SETTLEMENT OR JUDGMENT PROCEEDS. This is not just Wal-Mart's health insurance, it is Medicare and Medicaid especially, Blue Cross/Blue Shield, Anthem, Aetna, United HealthCare… all of them.

    Curious how the attorney is pointing the finger here. This poor woman is in this situation because her attorney screwed her. If the attorney ignored his RESPONSIBILITY to address her health insurance lien, which is pretty substantial judging from her injury, and accepted the $1 million for general damages only… pain and suffering, inconvenience, etc… that would increase his payday!! Yep

Wal-Mart should not have paid a dime for her medical bills to begin with since it was an auto accident, but they did. The other guys insurance should have paid for her bills. Now they just want their money back for something they should not have paid for in the first place. Next time you need to research and actually know how the process works before bashing a company.

    The lawyers weren't fighting Wal-Mart to get the $1 million settlement, they were fighting the truck driver's insurance company (based on the facts reported in the story). Most personal injury lawyers work on contingency, and they only get 30% of the payout. These lawyers got almost 60%. That seems excessive. The family is probably not well-educated. It sounds like the lawyers took advantage of them.

    obviously she was an employee of Wal-mart and took part in the benefit package which was given to her as comp for her accident and b/c she sued and won her case from the trucking company that caused the accident Wal-mart is now suing her for the money that was given as part of her benefit package with Wal-mart…my opinion…Wal-mart makes billions of dollars a year so why bother taking this woman to court, let her keep the money its not like Wal-mart is needing for anything…how pathetic is that to be taking advantage of this poor woman in the state that she is in….HAS SHE NOT SUFFERED ENOUGH…WAL-MART SUCKS A$$!     I love how everyone is getting onto her for taking the insurance. A) It is probably not like she had a lot of choice. He options might have been work there and get some form of insurance, work somewhere else and get the same kind, or worse, get none. I am sure that if we all read the fine print on our contracts we could be put in the same situation so we can't point the finger at her. I hope this is rectified soon. The CEO should save face and cut her a big check. I hated shopping there before, hated the attitude and the ignorance surrounding this company. Haven't shopped there in over a year and don't plan on returning. In case you haven't read it there has been news of another Wal-Mart employee who has been denied use of his wheelchair while at work. They are on a PR steamroll right now.

    Fucking walmart! Didn't pay for my own mother's medical bills when she slipped on the floor in there are fractured her skull! All my parents wanted was the medical taken care of…they didn't want anything else, and fucking walmart to them no and threatened them with a backlash lawsuit if they tried to do anything about it! It was their fault…they had no wet floor signs where the spill was and no one around to warn people about it…and my mother had to live with a fractured skull for months…she still had migranes and pain from it. I would burn them to the ground if I would go to jail for it!

    The settlement amount is determined by the trucking company's own insurance policy and if it's low then you either need to sue beyond the company, i.e. the people at fault personally, the owners etc or just deal.

    Similar situation happend to me and I had to pay it back. However, I'm not sending my probable lack of ability to give birth in the future and pissing problems at age 20 to the media to cry about it. oh did i say my mom died 6 months after it happend. she had breast cancer, she didn't chose to go to the military and get sent to Iraq, as her son did.

    but that's the emotional hook to sway opinions of the already indifferent audience.

    Re: jesse – Apparently you have poor reading comprehension. The money the woman was awarded was not from Wal-Mart, it was against the person who injured her in the accident. The woman worked at Wal-Mart and had her health insurance through them. Wal-Mart is suing her for the money her insurance paid for her care. In other words, they want her to pay back the money her health insurance paid. She worked, paid her premiums and deserved the coverage, BUT greddy ass wal-mart wants the money back since she won a lawsuit, which had nothing to do with Wal-Mart. Try understanding what you are commenting on before you say something ignorant. You actually sound like a typical Wal-Mart shopper…Uneducated, poor and likely dirty and fat.
