I know the family (they go to my church, I went to high school with the oldest son…Jeremy, who was killed in Iraq was in my younger sister's class). This story is SO sad and the effects on the family go way beyond the financial effects talked about in this story. I HATE WAL-MART! It's so hard not to go sometimes because it's so convenient but this is just that extra reminder of how awful a corporation they are! We should NOT support them!

I hate Wal Mart thats why I don't shop there. Luckily where I live there are more Targets than Wal Marts so I shop there. Target is a lot cleaner, friendlier, and their quality is a lot better. Thanks Perez for posting this wal mart is scum and will always be.
Walmart should not be demonized here. The woman had her medical bills paid by both Walmart and the insurance company of the trucking company that hit her. The law says you cannot "double-dip" when it comes to payment of medical expenses. I feel bad for the lady but she was paid for her medical expenses by the trucking company insurance company so therefore Walmart i sentitled to the money they paid for her medical expenses back.

I agree that this is a sad story. People should remember this and remember to read the fine print of ANYTHING you sign. However I do not think Walmart is being fairly represented here. First off, net sales of $90 billion DOES NOT mean they earned $90 billion, in actual fact their net income was only $13 billion, a fair cry from $90 billion. Also remember that Walmart creates millions of jobs, provides discounted health care to it's employees, and donates millions to charity. If you think about it, without Walmarts "lending" them the money, they would not have been able to afford the initial health care that was required. The actual expenses should have been paid for by the TRUCKING COMPANY, they should have sued for expenses incurred and paid for by Walmart, and lost wages and damages. I do not believe that Walmart is an angel, however I do believe they are being wrongly blamed for this womans hardship. Prayers with her and her family.

Wal-Mart took advantage of a policy called subrogation. It basically means that they gave themselves the right to first dibs on any payout that an injured employee received from the other party. That doesn't sound horrible, BUT traditionally the insurer will not try to exercise subrogation rights if the injured worker didn't get fully compensated by the third-party. In this case, Debbie wasn't fully compensated by the truck driver's insurance because the truck driver was grossly underinsured. That's why she only collected a million dollars — that's far less than she needed to cover her medical expenses. Unlike Wal-Mart, most companies would NOT have exercised anhy subrogation rights in a situation like this — it is considered an unusual move because it is so unfair to the injured worker. Debbie paid her insurance dues, and now she's not getting compensated properly by the insurance plan that she paid into. Sure, you can argue that Wal-Mart was just trying keep premiums low for all it's employees who pay into insurance. But that is a bullshit argument because all of its employees need to know that they will be compensated fully in case of catastrophic injury. Wal-Mart is pretending that it is acting in it's employees' interests, but they are actually acting against their employees' interests by making their insurance plan totally inadequate in case of catastrophic injury.

While I am sure that Wal-Mart offers some good deals, much of their merchandise is of poor quality and you can find better quality items at better stores for the same or slightly higher prices. Wal-Mart has sucked the poor in this country into believing they are their best option and the get ripped off. Wal-Mart employs people that are uneducated and often can't get better jobs and pays them horrible wages because they can get away with it because people have to work. The LEAST they could do is help this woman out. People like her are the reason Wal-Mart can exsist. Wal-Mart is not as generous with charity as you seem to think and stores like Target donate more to the community on a monthly basis than Wal-Mart does in a year.

We have a situation with our wal mart like this…a guy took his cart back and then realized he forgot his wallet and run under the little door they shove them in and it cut his whole nose off!!! Walmart called to tell him that he shouldnt have done that the next day, they didn't even ask how he was!!! He is trying to sue them. Now, the door is always shut and there is a caution sign over it…it should have been like that years ago!! that could have been a child… we need to boycott walmart, it is getting too big for it's own good!
I didn't read anything past the part about the people who keep telling this poor mother that her son is dead and she must live the experience again and again and again as though she is hearing it for the first time.
These people need to stop telling her this "truth" and tell her that her son is "on his way to see her soon and that he misses and loves her very much." She can't remember the "truth" for very long anyway. What is the sense in causing her so much needless pain.

I went to Harvard. I studied economics. I say that Wal-Mart is fine, and what I say goes because I went to Harvard. Indubitably, Perez could not have been accepted to Harvard (my alma mater), nor could Debbie Shanks have been admitted to the world's greatest, most prestigious, and most important educational institution (i.e., Harvard). Furthermore, my alma mater Harvard's endowment is so prodigious that it makes Sam Walton look like Debbie Shanks (in the sense that Sam Walton's fortune is only in the single-digit billions, whereas Harvard's endowment is in the middle-to-high double-digit billions. So Sam Walton seems absolutely impoverished (like Debbie Shanks and her family) in comparison to Harvard, which is where I earned my baccalaureate degree).

Wow. A few years ago I was shopping at Wal-Mart with my then 2 year-old daughter. We were walking down the aisle while someone was stacking 12 packs of soda in the next aisle on the top shelf. In order to make more room they pushed the cases so far that they fell in our aisle on my baby sitting in the cart. Luckily, she was ok. She cried and I cried -then they gave me a $25 gift certificate. Thanks, jerks.

Insurance companies suck ass…don't trust anyone. When I got hit by a car while jogging, my insurance company paid for a years worth of medical bills and physical therapy. Now they're suing me. They all suck, not just Wal-Mart.

Walmart should not be demonized here. The woman had her medical bills paid by both Walmart and the insurance company of the trucking company that hit her. The law says you cannot "double-dip" when it comes to payment of medical expenses. I feel bad for the lady but she was paid for her medical expenses by the trucking company insurance company so therefore Walmart i sentitled to the money they paid for her medical expenses back.
I am so disgusted. this absolutely breaks my heart. I think there has to be a solution….and I think it should involve everyone. What can we do to help? Start a donation can at walmart? I agree that this is a sad story. People should remember this and remember to read the fine print of ANYTHING you sign. However I do not think Walmart is being fairly represented here. First off, net sales of $90 billion DOES NOT mean they earned $90 billion, in actual fact their net income was only $13 billion, a fair cry from $90 billion. Also remember that Walmart creates millions of jobs, provides discounted health care to it's employees, and donates millions to charity. If you think about it, without Walmarts "lending" them the money, they would not have been able to afford the initial health care that was required. The actual expenses should have been paid for by the TRUCKING COMPANY, they should have sued for expenses incurred and paid for by Walmart, and lost wages and damages. I do not believe that Walmart is an angel, however I do believe they are being wrongly blamed for this womans hardship. Prayers with her and her family.

Wal-Mart took advantage of a policy called subrogation. It basically means that they gave themselves the right to first dibs on any payout that an injured employee received from the other party. That doesn't sound horrible, BUT traditionally the insurer will not try to exercise subrogation rights if the injured worker didn't get fully compensated by the third-party. In this case, Debbie wasn't fully compensated by the truck driver's insurance because the truck driver was grossly underinsured. That's why she only collected a million dollars — that's far less than she needed to cover her medical expenses. Unlike Wal-Mart, most companies would NOT have exercised anhy subrogation rights in a situation like this — it is considered an unusual move because it is so unfair to the injured worker. Debbie paid her insurance dues, and now she's not getting compensated properly by the insurance plan that she paid into. Sure, you can argue that Wal-Mart was just trying keep premiums low for all it's employees who pay into insurance. But that is a bullshit argument because all of its employees need to know that they will be compensated fully in case of catastrophic injury. Wal-Mart is pretending that it is acting in it's employees' interests, but they are actually acting against their employees' interests by making their insurance plan totally inadequate in case of catastrophic injury.

Re: gerly – Wal=Mart provides jobs, yet underpays their employees, their insurance coverage is poor and most employees are not even eligible for coverage. While I am sure that Wal-Mart offers some good deals, much of their merchandise is of poor quality and you can find better quality items at better stores for the same or slightly higher prices. Wal-Mart has sucked the poor in this country into believing they are their best option and the get ripped off. Wal-Mart employs people that are uneducated and often can't get better jobs and pays them horrible wages because they can get away with it because people have to work. The LEAST they could do is help this woman out. People like her are the reason Wal-Mart can exsist. Wal-Mart is not as generous with charity as you seem to think and stores like Target donate more to the community on a monthly basis than Wal-Mart does in a year.
So many small companies rally for employees that end up in a situation like this woman, Wal-Mart should do the right thing and get their insurance money back and then make a huge donation to a trust for her.

We have a situation with our wal mart like this…a guy took his cart back and then realized he forgot his wallet and run under the little door they shove them in and it cut his whole nose off!!! Walmart called to tell him that he shouldnt have done that the next day, they didn't even ask how he was!!! He is trying to sue them. Now, the door is always shut and there is a caution sign over it…it should have been like that years ago!! that could have been a child… we need to boycott walmart, it is getting too big for it's own good!
I didn't read anything past the part about the people who keep telling this poor mother that her son is dead and she must live the experience again and again and again as though she is hearing it for the first time.
These people need to stop telling her this "truth" and tell her that her son is "on his way to see her soon and that he misses and loves her very much." She can't remember the "truth" for very long anyway. What is the sense in causing her so much needless pain.

Furthermore, my alma mater Harvard's endowment is so prodigious that it makes Sam Walton look like Debbie Shanks (in the sense that Sam Walton's fortune is only in the single-digit billions, whereas Harvard's endowment is in the middle-to-high double-digit billions. So Sam Walton seems absolutely impoverished (like Debbie Shanks and her family) in comparison to Harvard, which is where I earned my baccalaureate degree).

Wow. A few years ago I was shopping at Wal-Mart with my then 2 year-old daughter. We were walking down the aisle while someone was stacking 12 packs of soda in the next aisle on the top shelf. In order to make more room they pushed the cases so far that they fell in our aisle on my baby sitting in the cart. Luckily, she was ok. Insurance companies suck ass…don't trust anyone. When I got hit by a car while jogging, my insurance company paid for a years worth of medical bills and physical therapy. Now they're suing me. They all suck, not just Wal-Mart.

Anyway lets face it, 5 people (out of the hundreds who claim they're going to) making their life hard as they go out of their way to NOT shop at the cheapest most convenient place is not going to affect Wal-Marts sales anyway.
All companies do stuff we don't agree with. If we boycott them all there would be nowhere left to shop. Wal-Mart is a necesary evil.
Just because you don't like them and want to take a pop at them whenever you can doesn't mean you should.
You can hate Wal-Mart and still shop there.
You can hate Wal-Mart, think they are shitty, boycott them, pray that they go bust but still look at this story and say hey, those are the rules. Wal-Mart is actually right here. …But it fucking sucks!
