    She will be donating 300% of her tips made that night to the family. She if she makes 150 she will donate 300 of her own money for a total of $450! Its not a ton, but if one person can make that much of a difference, imagine what everyone else can do… WAY TO GO BHAVISHA PATEL!!!

    If they tossed around money just because they 'felt bad' they would not have a company to run. Thats the way life works kids.
    This is a very sad story.
    However, she signed those papers, you're meant to read the fine print when signing things, let that be a lesson. Their lawyers who charged way too much for their time, should have done the same.
    It's not Walmarts duty to just say "oh well in your case it was super sad so here is a shit load of money.." and to someone else running off their policy "well your case did not bring us to tears, so no money."

    THERE ISNT ENOUGH TIME, not for ANYONE. I was in a contractual law class and even my LAWYER teacher cant take the time and even decipher the lingo they use, let alone all of us regular joes…
    GET A GRIP! If it was your mom, you would feel MUCH different.
    Try to remember we arent all perfect when you talk about it being their fault that they signed up for a poor health plan and then got hit by a car.

    Are you honestly telling me when signing something for a well known 'money grabbing' corporation you would not take the time to read those pages?

    This is not a Wal-Mart thing, this is ALWAYS how it works when you get taken care of by your insurance company.

    When you receive a settlement your first required action is to pay back the insurance company. That's just how it works, always, for everyone.

    Then, you pay the lawyer. How much of your settlement you pay to him/her depends on what you negotiate.

    This is NOT a case of someone getting screwed by the big guy. Do your homework. I have no love for Wal-Mart, but I do love the truth.

    I hate to tell you all this, but ALL insurance companies do this! I work in the insurance department of a local hospital. This is why our hospital has started flags the patients injured in MVAs as cash. We also put a lien against any future settlements with the car insurance. Because they have a habit of collecting the insurance settlement & never paying the hospital bills. Some are even ballsy enough to file bankruptcy on the bills AFTER they've received a nice chunk o' change.

If you personally pay for someones prescriptions (say $1000) and then they turn around and are reimbursed for that amount by an insurance company is it right that they keep the money?     Yeah we don't all read the fine print but if we don't we are still held to it.
    Of course we would be on the woman's side if it was our mom, because we would probably be acting with our emotions too. That doesn't mean we are right it means we are simply blinded by our emotions and hoping for special treatment. It's natural to feel that way.

    Wow this is just sad, I can't believe so many bad things can happen to a family and for Walmart to take back such a small amount really shows how heartless they are. They could very easily just let them keep the money and not say anything. Any of the Waltons can easily have that much money in their wallets.     Well if your hospital didn't charge such outrageous sums for care then maybe people would be more inclined to pay the bill. One emergency visit resulted in me being billed $3,000 and I was even admitted. They charged me $75 for one pain pill when an entire bottle doesn't even cost that. Why? To compensate for those scummy illegal aliens who walk away from their bills. They threatened with collection after only 3 weeks. I hate you hospitals as much as I hade that Cancer known as Walmart.

    I am a college student living on a limited income so I used to do all of my food shopping at Wal-mart but I learned of this story back in November from my father and I have since stopped buying ANYTHING AND EVERYTHING from Wal-Mart. I will not support this disgrace. I do shop at a regular grocery store, meaning I do shell out extra cash I could be saving, but I would feel horrible knowing I am supporting this atrocity. Oh and Hillary used to be on their board of directors. She now says that Wal-Mart should pay their workers more, but when asked if she did anything to help that cause while she was on the board, she replied " It was a long time ago…I'll have to remember" Probably absolutely nothing!

    I worked for Walmart for almost 2 years. Their claims too be "fair" too all the other employees is BULLSHIT! Walmart bends the rules on a daily basis, whether it comes from making you work a job you've NEVER done but have to be trained to do, not being paid that rate for THAT new job PLUS the job you're supposed to do, not giving you your lunch ontime or at all…the list goes ON AND ON!

    If they wanted too help her they would. I hope this lights a fire under their asses and they help her. My god how cold could they be! Sam Walton would be ROLLING in his grave right now if he knew wtf kind of company his company has become…it's a MONEY HUNGRY firey pit of hell!

    When you shop at Wal*Mart (which I do from time to time), you are undercutting the US economy while building up China's economy. China is responsible for the genocide in Darfur, which is making them tons of money in cheap oil and weapons sales. China is responsible for keeping the Myanmar/Burmese military dictatorship in power, which sells them oil and recently murdered hundreds of peaceful protesters, mostly monks and nuns. Now China is going after Tibet. Who is China's most important cash cow? Who is paying for all this? Americans who shop at Wal*Mart and buy Chinese goods elsewhere.

    It sucks about this woman and her family, I hope they win. But Wal*Mart has way more blood on their hands than this. As do all of us who shop there. "Never again"?     I think it is a disgusting story and it makes me feel sick to think that not only does Walmart get away with the fine print, but that the lawyers took so much of the money. That money is for her long term care as she was left brain damaged and in a wheelchair. What Walmart paid was for the medical costs up to that point and I think it's unfair to claw it back against money that cost more to win than was actually able to get into her trust. It's like Walmart is saying, oh, we'll just take back all the money it cost to keep you alive up to this point, now that you can never work again and that the judgement was intended to offset future medical costs is really of no concern to us. Read the fine print..oh that's right! You're permanently brain damaged. Shrug.

Sorry for this woman's plight, but the company is completely in its rights. Why can't people own up to responsibility anymore?     This is the way the system works folks. If you collect money in a lawsuit your medical costs are part of the suit. I think the lawyers were at fault for not making more allowances for her future medical expenses to be incurred than what they actually were to date. If Wal-Mart makes this one exception they will be setting a precident for further claims. I think they should, however, make a silent donation to help his poor family out or the major stockholders. This is why I think all these celebs should ban together to help at home before sending it everywhere else. We have some needy people here in the US.

    Walmart by LAW is doing the right thing. If a person sues and gets a settlement of any kind as a result of injury or negligence, the health insurance COMPANY has the right to get the money back that they have paid out in health insurance bills!!! It's called SUBROGRATION!

    IN THE END UNFORTUNATELY THIS IS NOT A WALMART ISSUE, THIS IS A HEALTH INSURANCE ISSUE!!

    Walmarts insurance company isn't the only one that does this. If you look at the fine print in every insurance policy, it states that. It is HEALTH insurance, not ACCIDENT insurance. So…if you are ever in an accident that wasn't your fault…DO NOT LET THE HOSPITAL/DR OFFICE BILL YOUR INSURANCE! Because they will get every penny back they spent on you…and it is completely legal for them to do so.

    Blame the government…they let the insurance companies get away with this.

    I work for several insurance companies and this is clearly stated in certificate booklets that you get once you sign up. its not that walmart needs the money its that they have to file what's set in stone or else everyone would want exceptions to the rule. yes it sucks but the guidelines are made for a reason.
