    Yea, blame the lawyers and Wal-mart. They're always the greedy scapegoats! Except, if you read the story, she settled with the truck driver, which doesn't amount to a whole lot of legal fees. It's the appeals process, up to the Supreme Court, that drove up the legal costs. The health insurance policy contained a clause that stated IF SHE SETTLED FOR MORE THAN THEY GAVE HER, they'd want their money back. Which she did. Can we at least have a pity party for people who don't have health insurance that this sort of thing happens to?

    Although Walmart got the bad publicity, it was actually the insurance company that was going after the settlement money. This is a local story for us that we have been hearing about for months. I'm pleased that not only are they dropping the lawsuit, they are returning the trust fund money that was already taken by the insurance company. Walmart is also changing their policy so that they don't go after settlement money after an accident. I'm not saying this should be the case all the time, but in cases like this where the victim is in a permanent care facility, it's certainly a help.
    If anyone is interested in the local story, it's at KFVS12.com It's sad because Debbie's husband had to recently divorce her so that she would qualify for some health care. He obviously cares for her and wants the care for her that she needs.

    Perez, I don't think you had anything to do with this victory but whatever you want to think. That "we" comment is misleading since there was a certain journalist- forgot her name- who spearheaded this into the media. She deserves the most credit, not you.
    But, this case is still tragic. I am glad they are FINALLY doing the right thing but why this family was put through this miserable situation for so many years is ridiculous. I realize it is company policy and it is a lot of companies policy, but this was an egregious circumstance. Hopefully, her family can have some peace now.

    I'm no lawyer, but I'm sure this isn't the first person that has been sued in this exact type of situation. I expect all of those people will be contacting Perez looking for some publicity. Why was Walmart wrong again? It's not fine print, any insurance company would have to take these actions to be solvent. Was Walmart saying they wouldn't continue to pay for her health care or were they hoping to recoup their expenses instead of the money being spent by her family on toys. That family should have had better lawyers who would have forseen the Walmart lawsuit. Lets not forget her lawyers got 30% plus expenses, THEY totally fucked her.

It was her stupid lawyers fault that he did not get her health care costs paid for when he settled the case - her lawyer probably settled short in order to get a quick pay day. Subrogation enables health care companies to offer lower rates to the masses. Why shouldn't the third party be responsible for paying for her medical care????? Why should she (or her health care company) have to pay for her treatment?????

    Yes, that is what I wanted to see and hear!! I was really pissed at wal mart for that whole thing. I have thought about that more than once. I had to go to wal mart the other day to put money back on a gift card of my daughters that had been used temp. and I thought about it when I was there and I had resigned not to go back there after that. That was going to be the last dollar I ever spent at wal mart. I was sickened by the fact that a multi billion dollar company couldn't make an exception for a real hardship. There is a difference between someone who is trying to use the system and someone who truly needs it. She definitely needs it. So……..they did what they should have. Gave someone a break that truly needed it. I will continue to shop at wal mart now. And I won't need to tell other people not to shop there either.

Can you imagine this accident happening to someone you love? To go from knowing someone, to having them become like a child…it's so unfair…this world is so cruel.     I actually agree with Walmart on this one even though I think they are a shit store. If they do this for one employee they should have to do it for all who win settlements. What Walmart did was standard practice in the industry. When monies are won in a settlement you are supposed to pay the insurance back. While that rule may be fucked, it's the rule that has been the standard in the industry. Fuck Walmart, they are the shittiest store out there but they were still right to get there money back. Now if after they received the money back if they were to make a generous donation to the former injured employee then that would be cool. You wait & see, people will be suing left & right now to keep their entire settlements & not have to pay the insurance back. I would bet that ALL insurance riders state that the insurance must be paid back in cases of settlements, this case should have been no different regardless of the circumstances.

    Congrats to Perez and this family! Perez, you should be proud that you used your website to help this family against such a corporate giant as Wal-Mart. It's time these big companies do the right thing. It took action on your part to alert readers to raise up and have their voices heard to say this type of behavior can't continue. Thanks again for bringing this issue and in general, worthy causes and charities to our attention.
