    205

Well that's nice of Walmart. They probably had enough people sending them complaints calls & letters about this.

Still, what's up with her lawyer taking so much of the settlement? I can understand taking a percentage of a settlement if it's a small amount but he took a LOT of money she could really use.

I think Perez meant we as in we the people, everybody who read about this here or on CNN or wherever and complained.

Re: Mad@Walmart – Yes, shitbag, it DOES make me happy. Because this woman's family needs the money more than I do. Tragedy can strike anyone–even you. We should have compassion and human decency–not be a bunch of CORPORATE DRONES who do not give a fuck about anyone but themselves. FUCK WALMART FOR EVEN HESITATING ON THIS SAD SITUATION. AND FUCK YOU FOR BEING SO CARELESS.

Debbie has such a sweet face. I bet she has always been a kind person. I wish i could take her family's grief away. I send love to her and her family, across distance, into your hearts…may we all do this to those in pain. Connected through kindness and a respect for enduring hardships. survival brings wisdom, though we never choose tragedy…when one day it is my turn to cry i will remember the bravery i see in all of you…

    1. Perez, you had absolutely nothing to do with this, but I admire you for bringing it to your devoted readers. By the looks of these comments many of them don't stray too far into intellegent websites.
    2. Shame on all of you who are bashing this poor woman. I have lived through tradgedy and I have witnessed family members fight insurance companies. It's sad, really. I pray none of you will ever encounter such a horrific even in your lives. Heaven knows you won't be smart enough to handle it. ****Side note: Why must you drop the f-bomb in every sentence? Are you at all aware of how unintelligent you sound? Really, people. It's just uncuth. (Go ahead and look that word up.)

  18. 0utspoken says – reply to this

That is awesome that they did the right thing… it's a shame though that it took numerous people voicing their oppinion on it for Walmart to do the right thing….

  19. dee says – reply to this

    219

"WE" did it??? Are you using the editorial "We", as your usual affectation, or are you giving credit to the real people who wrote and called and brought Walmart to their knees? You never cease to surprise me…at how gigantic your ego has become…someone needs to stick a pin in your fat head…there's nothing you won't take credit for, you talentless scumbag!

  20. Kim says – reply to this

Thank you for putting this story out there. I used to be an Asst. Manager for the Chain and hated them for what I heard they did to a lot of families I knew. I am glad that this time the right thing was done.

wal mart is un-%$#ing believable. they make billions off the slave labor of sweatshop workers/children in third world countries and then want for them a measly $400,000 from a woman who has no way in hell of paying it considering her expenses. what utter bullsh*t. wal mart and target need to be blown up. f&%# them.

Insurance companies being paid to insure people for disability should not be able to go after cash settlements received elsewhere by the client.
This practice should be made illegal.
Walmart or any other corporation with as much power as they have should not purchase insurance from companies that allows them to do that. What a bunch of leaches insurance companies are. Not all insurance companies are like this. I don't think it is Wal Marts fault as much as the insurance company.

  24. Perez is an idiot: says – reply to this

    224

    Perez,
Do you really thing "you" or "we" did it?
Do you think there were attorneys, EOW, Walmarts execs, insurance underwritters, ect. involved?
Do you think Walmart wanted to tarnish their name?
Get real, you copied a story you got from the news.
You had NOTHING to do with it.
    "copied"
I really don't think you'd reach out to anyone, you're too selfish.
    Get off you're high horse.

  35. Insurance Person says – reply to this

    235

First off its not Walmart being greedy…its the insurance company. Its the insurance company's policy to get back money that put forth if there is a lawsuit. Its a common practice on ALL insurance carriers. I am glad Debbie will be getting the care she needs but what about all the other people out there from MANY different companies that had to forfiet their judgements? Where's their voice???

  49. jaye says – reply to this

    249

his is not a case of Walmart being the BAD guy. Most insurance companies have a Subrogation clause. if you have insurance of ANY kind, read your policy. I'm happy for the woman and her family, but don't expect this 'kindness' to extend to everyone who has a claim. All companies have to protect their assets as harsh as it seems. If it didn't the company would fold and people would be out of jobs. The purpose of subrogation is for people not to collect TWICE for he same thing. The extent of the injury shouldn't be a consideration as far as subrogation is concerned. Walmart was only following through on what is stated in their policy which is a CONTRACT. Before someone ask, no i do not work for walmart nor does any member of my family. Facts are facts. Behind bill gates and his family walmart owners are the 2nd in the amount they give in the form of charitable donations.

    251

If she gets to keep the insurance money, then the insurance company is nice not wal-mart. To tell the truth the insurance company is not all that nice in return for letting her keep the money insurance premiums are not going to increase. Soon we will hear how wal-mart is the devil, because their insurance is going up. Hope none of you work at wal-mart.

  52. haha says – reply to this

    252

this is, in no way, a case of Walmart "doing the right thing". They were backed against a wall and had no other choice but to drop their suit!

  53. Allie says – reply to this

    253

What exactly did YOU do. You are the most selft centered, pompus, arrogant, conceited ass-wipe I have ever seen. You didn't do squat and neither did anybody who read your peice on this. I would have had so much more respect for you if you'd just left it at the headline, instead of turning into the gay oprah who needs credit for everything he plays a minor (and a very minor) role in. This stupid little sentence makes you look like you'll do nothing based on the "goodness" of the cause. You'll only do it if you can take credit for it's success. WE DIDN'T DO ANYTHING!!

  54. Allie says – reply to this

  56. Walfart.. says – reply to this

    256

Walmart is a billion dollar coorperation that is greedy and treats their employees like shit. They claim to be a family first company, when in reality they are not!! If an employee wants to take time off for a sick family member or maybe they are sick themselves, then walmarts policy is to have them go in for a coaching which can lead to termination. Family first my ass. I know how they work, I've been there and heard all the lingo. Walmart takes advantage of its workers need for this job and they will legal their way out of anything. Walmart isn't that good for America either, most of their products are made overseas. Thus lower cost , thus lower wages. Its a disease that spreads throughout our econamy. Walmart is part of whats wrong in America with big companies taking the front seat while hard working Americans pay the price in more ways then one…

  57. sad celebration says – reply to this

    257

p - its like celebrating 'look my husband did the dishes!' You're supposed to do the dishes–deadbeat. Just like walmart is. Also this sentence: "That settlement money, plus $51,739 that Shank will have to pay out of pocket, must be paid to Wal-Mart. " Implies that Shank gets ZERO dollars in the end?

Another postively-spun press release story that walmart PR submitted to make it sound like the have decent benefits and take care of their employees. We shouldn't celebrate anything but Ms. Shank's recovery. That is all.

  58. media_lush says – reply to this

    258

"we" did it?….. oh, puh leeze!

Keith Olberman was the reason - don't try and get yourself my little fat one.

To even attempt to claim credit for this is just soooo tacky - your delusions of self-worth are starting to take control of your personae now!

  59. Mad@Walmart says – reply to this

    259

Debbie and her family should be ashamed. How dare they steal from all of the people that go to Walmart and Walmart employees by now forcing those people to fund the extra money.

Her lawyer should be shot for now settling for enough money to cover her health care benefits!

Also, Debbie's health insurance payments were to cover normal life events. The third party's inurance was to pay for any harm caused by the third party. Stupid lawyer. Shame on Debbie and her family for being so greedy. Shame on the media for being so mis-informed.

  60. really? says – reply to this

    261

dude, WE did it? You reported on this story half a week AFTER it was ALL OVER THE MAINSTREAM MEDIA. Get over yourself. Your shot at real time news is a joke considering literally everything you write non gossip related is repotred in other outlets long before it gets here. I'm happy about the walmart story but give me a break-credit does not come soley from this site. Oh brother.

  62. Wal*Mart forever says – reply to this

    262

Screw that! I wish Wal*Mart would have stuck to their guns! Everyone in this country feels entitled to things that are not theirs. There was a signed insurance form and this money was not hers, Wal*Mart was not entitled to let her keep it. People need to start realizing that they have to do things for themselves and stop expecting everyone else to take care of them. Wal*Mart, you're great, but I'm a little disappointed with this decision.

  63. Keith Olbermann sucks! says – reply to this

    263

Re: media_lush – Keith Olbermann was NOT the reason for this decision!! He has such low ratings that Walmart could care less. Its because of the media frenzy surrounding this case, on CNN FoxNews ABCNews CBS Evening news and the many many newspapers that covered this story. Keith Olbermann is not a smart man, he was a sportscaster on ESPN and a wannabe comedian. He was hired by MSNBC for comic relief and instead he ends up pushing his views on Americans in his cocky arrogant manor. MSNBC never intended for him to give the news, its not his job description, thats why he does a "comedy show", the countdown is not news. And for many years he should of had himself as the worst person in the world..He needs to stick with sports, just like movie stars need to stick with movies.

    265

WE did it? Based on how you consistently refer to yourself in the 3rd person, a reader might interpret this as YOU did it. Either way, you had absolutely nothing to do with changing this situation. You may have minor impact on other areas due to your blog, but your head, ego and waistline are getting just a little too big.

  66. Jackie says – reply to this

    266

"Occasionally others help us step back and look at a situation in a different way. This is one of those times."

    273

Thankfully WalMart did the right thing. If Sam Walton, the founder, were alive he would have done the right thing to begin with…His kids just see money signs in all they do…so unlike their father. This family just lost one of their sons in Iraq. I think they deserve the money to keep her comfortable. It's not like they are profiting from her accident.

  74. galen says – reply to this

    274

Now tell her lawyer to give her back part of his fee's. If you did the math, his lawfirm got over half of her settlement. Over half, does that seem quite fair and just to you. I commend the man for doing hard work, but I don't see how he deserves that much money. He, if he really has their best interests in mind, should give some of that back for her long term care. You can email him at mgraham@grgpc.com and tell him so.

#250 Samantha - I can't believe I wrote almost what you said verbatim! It doesn't take much to know what's really going on, most people just like to dump on corporations as the big evil giants against the little Po' folks. It isn't always that simple.

That's so awesome to hear! Perez you rock!!! You have made a difference in so many people's lives. I think inadvertently you even managed to save Britney Spears life. By constantly putting her in the news on your site everyone knew she needed help, and finally it was accomplished. Your site has power and reaches so many people it's unbelievable! I had made the decision to stop shopping at Walmart here in Ottawa Ontario Canada and just shop at a different place instead. Now I guess I won't have to do that.. If my daughter and I had to visit with any celeb I think we'd both agree that you'd be the one to visit with, you are just so cool and interesting.

ANY way, FUCK WALMART! ANY PERSON WITH ABOVE AN 8th GRADE EDUCATION HATES THIS STORE AND OTHERS LIKE THEM.
IF YOU WOULD LIKE AN EDUCATION , THEN READ:
    NO LOGO, BY NAOMI KLEIN.
..after you read that, you will either cease to be ignorant on this topic, or else realize that you are a greedy, corporate, pig who gets paid-off to flush the American economy down the toilet. i would rather not be robbed by Walmart, just to watch my money "returned" to creepy, sexist, racist, homophobic religious groups or to pay of politicians with similar values…factor in the slave-labor used for walmart's "cheap" products and then how they treat employees? BOYCOTT! BOYCOTT! BOYCOTT! FUCK WALMART! THEY MUST BE FINANCIALLY DESTROYED!
