eBay is in some deep trouble!

Yesterday, a French court ordered eBay to pay almost $40 million euros (over $60M US) in damages to Louis Vuitton for allowing the sale of fake LV items.

The court has now stopped eBay from selling four kinds of perfumes, which are Givenchy, Christian Dior, Guerlain, and Kenzo.

They will also not be allowed to sell six LVMH brands.

The court determined that eBay had committed "serious errors" by allowing the sales of fake LVMH goods.

They also said eBay violated the perfume sales distribution network, which was setup by Louis Vuitton and Christian Dior Couture.

Of course, eBay said they are going to launch an appeal, believing the court did not uphold copyright law.

A spokesperson for eBay has said, "This decision is not based on combating counterfeit material. It is based on LVMH's desire to protect its commercial practices and exclude competition. This is being done at the expense of the consumers and sellers to whom eBay is always offering opportunities."

Hmmm. They have a point!

The case, which started a year and a half ago, stated that eBay knowingly allowed the sales of counterfeit products on its site.

The court also issued eBay a cease and desist order preventing it from running ads for the perfume and cosmetic brands. If they don't oblige, they'll face a fine of 50,000 euros per day, over $78K.

Gosh. Why can't they run ads??? That seems a tad excessive, no???

A rep for LVMH says, "It is a major first because of the principles that it recognizes and the amount sought."

    I love eBay… i'm on their side on this. LV is yuck anyways :-) not to mention 2 expensive… LV should shut the fuck up, what, they r not rich enough, they need more money? Ebay does a great job at stopping fakes, eBay is the best thing that ever happend both to buyers and sellers.

    Fact: LV purses are ugly as sin. The only reason people buy them (and the knock offs) is because they want to look like they are rich and are just showing off. Paying $500 for a purse is stupid. Paying $500 for an ugly purse is insane. Get real people.

    While there are some good deals on eBay, I think the company itself is crooked as hell. I believe they allowed, and even nurtured, an environment for shill bidding & trotting. And, sometimes, S&H fees were so ridiculous that Amazon proved to be a better way to go with Free Shpping options on many items. Only recently did eBay stop allowing sellers to retaliate with negative ratings on customers who complained about sellers. I only buy from eBay about 10% of the time, compared to my previous purchases. Also, I've cut down on PayPal because they're with the same company (as eBay), and have increased my use of Google Checkout, instead. eBay's time is almost up. New companies are just around the corner, which I believe will be more customer friendly. eBay, you had it coming.

    Fuck ebay. Their statement pretending to care about Sellers / Buyers is laughable. eBay only cares about their own profits at the expense of Sellers / Buyers. I reported a thief one time that was using multiple ID's on eBay and had to go through a series of back and forth emails proving the obvious. The thief was a Power Seller. eBay wrote me an email saying they don't get involved in personal things. WTF? They didn't care that the guy was ripping off Buyers as long as eBay kept raking in the fees. I haven't been on that site in 4 years. Good riddance and bravo to this recent court judgment.

    I think that as most companies try to do, their approach to maximizing profits is to keep their product exclusive and hard to get. This is an artificial approach that does keep prices high (see gas prices) at the expense of the consumer.

    I tried to buy a fake on ebay–about impossible! Just the look alike "designer inspired" that I didn't want or old bags that were real…the one bid I put in for what was possibly a fake was taken off after one day due to "potential problems". Ebay is pretty strict about that stuff so they won't get sued…looks like they were sued anyway. No fair!

    People with fake LV are not fooling anyone. The leather on a fake won't turn that nice golden brown like an authentic one does. The stitching will be perfect, on the fakes it looks like it was stitched crooked and half assed. On the authentic the pattern will match each other on the edges it won't just randomly be cut. People that own authentic can spot a fake a mile away.

    as somone who purchased a LV bag from ebay - the seller claimed the serial number was stamped inside the bag and it would be sent with the original paper work - it was not - and when i reported it as a fake Ebay didnt do anything about it - they told me I had to prove it by taking it to an 'authenticator' - how about making your seller's provide what they state in the sale! Good. I hope ebay makes a poop swirl when it goes down the toilet. bastards.

Why on earth would ANYONE pay a lot of money to advertise someone else's business interest (as in their LOGO)?     People buy LV because of the quality. It's not going to fall apart on you, it's something you can pass down to your daughter and it will still be a good quality bag. If anything does happen to your bag you can send it back to LV and they will fix it. They stand by their product. Most people that down LV are those that can't afford it.

    I love eBay, and while I think LV is probably more concerned with their own end of things, it is important to consider where the fakes come from. I used to buy them for fun since the real ones are only getting more expensive, but I don't want to promote and contribute to child labor in any way - and the majority of these types of counterfeits are traced to these circumstances.

I probably could too, but I prefer to spend my money on more important things like food and bills. There are so many more important things in the world then blowing a couple grand on one purse.     Good for the French court!! I totally agree. Selling fake designer bags with a designer's logo and name on it goes toward making money for someone else at the designer's expense. Designers and fashion houses are artists and groups of artists who have worked long and hard to build up their brand and name and careers. Why should some no-life in the middle of a rundown neighborhood be able to sell stuff illegally that bears the name of a respected, hard working art group?

    Even when the work doesn't bear the name of the designers but uses their designs, that is STEALING! That is THEIR DESIGN, not everyone's. The fraudulent maker didn't come up with it. The design is the art, the WHOLE point. You people who say "well, I can't afford the real thing!" too bad!! Either drop the $3000 on the LV or go to Wal-Mart and get cheap crap!     The US and other countries need to create and enforce laws that ban any production of products that are implemented or fashioned from designs by other makers, or designers, also strictly banning the sale of such items. They should boot all these rinky dink sunglass and handbag stands from malls that advertise with the names of famous designers and copy designers' work.

    If you can't afford a LV product, then you have NO RIGHT to get a fake. It devalues the brands image to include scum. I don't see anyone having a whinge at ferrari for charging AU$500K for a car. If you actually bothered to visit a LV and look at their products, you'd know that most of their products are made in France and Spain, with the exception of watches (Switzerland) and sunglasses (Italy). The hourly manufacturing wage these countries is (as it should be) significantly higher than that in China/india.. we're talking 50c vs $20 PER HOUR. LV's handbags are bespoke (i.e handmade for you dummies) products meaning that they use high quality leather and canvas.
    If you retards have never actually owned a real leather LV bag, you'd never appreciate the smell, the supple feel of the material, the beyond superior quality and the overall feel-good factor of each bag.
    Like most people have been saying.. anyone who knows fashion can spot a fake a mile away. For me, it degrades the person socially.. i wouldn't bother associating with someone who is trying to be someone they clearly are not (IE FAKE). Any other bag is better than a fake.

    Most of us worked hard for our LV bags - they are a symbol of our hard work and motivation to succeed professionally. A luxury bag isn't a luxury bag when everyone has one (or a fake).
    Going back to the car analogy, while there is a premium for luxury brands, a $1 million Rolls is not the same as a $12K Kia. The difference is due to more sophisticated materials, labour and technology; and the fact that the Rolls is handmade vs 100 every hour for Kia.
    Perez, as someone who can afford Louis, you shouldn't be siding with eBay. Real LV bags last a lifetime, fakes do not.
    PS. to whoever was dissing brand names about not being creative: SO WHAT! the world does not revolve around you. 'Creative' hippies like yourself attempt to 'create' fashion by wearing a bag made out of curtains or whatever. You whinge about brands because you are not talented or professionally gifted.     I have bought and sold on ebay for 7 years, and they have always been very cautious about misrepresentation of name brands. They have policies and disciplines for that. I am surprised they could have let that happen. It's too bad.

    the main problem with the fake bags is that they are often sold by organised crime synicates to help fund their drug and counterfieting operations - fake LV bags are not a victimless crime.

    did you ever think how people get the money to set up the factories to make these fake bags in the first place? there's big money behind this, and buying fake bags is supporting an evil industry.

    Buying LV or any other "new" luxury item on ebay is risky. What gets me is that I reported what I knew were obviously fake Yurmans to them and they never did anything about it. ever. So, I gave up. Stick to used items or less popular styles and you reduce your chances of getting burned. You have to use common sense. By doing so, I've never had a problem.
