Will McCain Need To Drop Out Of The Race?

This has been brewing around for some time, but The New York Times has a new report on the issue.
Gabriel J. Chin, a law professor at the University of Arizona, has noticed what many have seemed to overlook.
According to the United States 14th Amendment, it clearly states "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.”
However, John McCain was NOT born in the US!
McCain was actually born to American parents but in the Panama Canal Zone, not in the US.
According to Prof. Chin, that is not enough to satisfy the constitutional requirement stating that our president must be a “natural-born citizen.”
It wasn't until 1937 that a law was enacted giving children of American parents born after 1904 in the Panama Canal Zone citizenship.
Though, according to Chin, the law came too late to make McCain a natural-born citizen.
Prof. Chin adds, “It’s preposterous that a technicality like this can make a difference in an advanced democracy. But this is the constitutional text that we have.”
Funny. Somehow we're almost certain that if it would have been Obama who was born in the Canal Zone, the Republicans would have fought to make him ineligible.
And, although several legal experts agree with Prof. Chin's findings, they add that nothing will probably come of it.
Peter Spiro, who focuses on the law of citizenship at Temple University says, “No court will get close to it, and everyone else is on board, so there’s a constitutional consensus, the merits of arguments such as this one aside.”
And, in April, the Senate approved a nonbinding resolution stating that McCain would be eligible to become president. They declared that our founders wouldn't have wanted to decline the offspring of military personnel stationed out of the country the right to presidency.
However, a lawsuit challenging McCain's qualifications is currently pending in the Federal District Court in Concord, N.H.
So, even though the 1937 law made McCain a citizen, it didn't make him one that was naturally born because the citizenship was conferred after his birth.
Sounds all a bit confusing!

#228: That's wrong. Hawaii was made a state 2-3 years BEFORE Obama was born (1961). Also, even if Hawaii hadn't been a state people living in overseas territories are still US citizens at birth. Barry Goldwater ran for president in 1964 and he was born before Arizona became a state.

The framers of the constitution made a distinction, and said only naturalized citizens may be president. One year after McCain was born, Congress passed a bill when made children born in American territories naturalized citizens, BUT NO BABIES WERE GRANDFATHERED IN. McCain is not eligible for the presidency. The Republicans will cheat at ANYTHING.

And the 1937 legislation actually acted to clarify that those born to american parents on American military lands outside of the contiguous 48 states, Hawaii and Alaska, are still NATURAL-BORN citizens. it was more a clarification of citizenship, not a granting of it.

If he is born in a US military-occupied area than that is considered to be the US. Even someone born in Russia could be President if they where born in an Embassy or on a Military base. It's simple US government we all learned in middle school. Get it right!
The constitution is meant to mean that a foreigner can't become president, even if he is naturalized. So the Schwarzeneggers etc. can become anything here, BUT president. that is the spirit of the law. If your both parents are US citizens then great, born on military/embassy land=US.

This article is idiotic. If you are born outside of the U.S. to U.S. Citizens, you are automatically an American citizen regardless of what country you were born in. As with any birth certificate (US), it could denote the province, state, country you were born in (even outside the US) but if you have a birth certificate from this country, you are a citizen. McCain is qualified - end of discussion. People trying to make controversy or create a technical issue out of this are IDIOTS (like Perez Hilton).

Re: Learn – I don't think they teach civics in jr high anymore. Democrats want uneducated to vote, easier to lead around that way. The son of a Navy admiral, born on a US military base and people on this site think he's a foreigner! I hope they are just "acting stupid"
