Will McCain Need To Drop Out Of The Race?

This has been brewing around for some time, but The New York Times has a new report on the issue.

Gabriel J. Chin, a law professor at the University of Arizona, has noticed what many have seemed to overlook.

According to the United States 14th Amendment, it clearly states "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.”

However, John McCain was NOT born in the US!

McCain was actually born to American parents but in the Panama Canal Zone, not in the US.

According to Prof. Chin, that is not enough to satisfy the constitutional requirement stating that our president must be a “natural-born citizen.”

It wasn't until 1937 that a law was enacted giving children of American parents born after 1904 in the Panama Canal Zone citizenship.

Though, according to Chin, the law came too late to make McCain a natural-born citizen.

Prof. Chin adds, “It’s preposterous that a technicality like this can make a difference in an advanced democracy. But this is the constitutional text that we have.”

Funny. Somehow we're almost certain that if it would have been Obama who was born in the Canal Zone, the Republicans would have fought to make him ineligible.

And, although several legal experts agree with Prof. Chin's findings, they add that nothing will probably come of it.

Peter Spiro, who focuses on the law of citizenship at Temple University says, “No court will get close to it, and everyone else is on board, so there’s a constitutional consensus, the merits of arguments such as this one aside.”

And, in April, the Senate approved a nonbinding resolution stating that McCain would be eligible to become president. They declared that our founders wouldn't have wanted to decline the offspring of military personnel stationed out of the country the right to presidency.

However, a lawsuit challenging McCain's qualifications is currently pending in the Federal District Court in Concord, N.H.

So, even though the 1937 law made McCain a citizen, it didn't make him one that was naturally born because the citizenship was conferred after his birth.

Sounds all a bit confusing!

    I think any man who is a POW for years to protect the USA is a citizen of the USA. Plus, any of us could have been born out of the country if our mother went into labor on vacation or something. We come back to the USA and become a citizen. It happens all the time.

The same debate happened to Lyndon Johnson, he was born in Arizona and it wasnt considered a state until 1912 and he was born in 1908. old news

    I don't know if any of you have actually read the constitution, but…

    Section 1 of Article II of the Constitution contains the clause:

    “ No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

    OK, any child born of a US citizen is automatically a US citizen themselves ("or a Citizen of the United States"), so guess what? He passes!! Are you all that scared??

    I hope people really read the platforms these two politicians have. I feel that Mr Barack Obama is only interested in firsts, and his policies aren't sustainable for the US, which needs stricter policies.

    I don't know if John McCain will win, but the troops shouldn't be taken out of IRAQ, the country will collapse, and there will be far greater dangers than before.

    Obama claims to have been born in Hawaii. Birth records are supposedly public. Yet Hawaii has no record whatsoever of his birth there. I know you love breaking big stories, so I figured I'd throw this your way. It's actually already known by the powers that be in the mainstream media, but they love Obama way too much to bring this out, even though it's true. And they claim there's no media bias…. but seriously, check it out. Hopefully you'll have the courage to bring this out in the media, even though I know he's your candidate of choice.

    A rule is a rule is a rule. He knows the guidelines for running for presidency and he knows that was NOT born a U.S. Citizen so he's no different than "Aahnold" running for presidency. It CAN'T and SHOULDN'T happen… He knew a long time ago he wanted to run for president so just like every other law or rule that's been changed he should have attempted to pass a bill/law or an admendment to the constitution that changed it. He though did not do so.

    You dont have to be a US BORN citizen to be in the military or fight for our country or whatever other lame crap excuses you people want to make.

    He knows the rules and he IS not and WAS not a U.S. Born Citizen thats the rules for being allowed to run for Presidency. PERIOD.

If you are born on an American military base to American parents, you are considered on US territory. I was born and raised on a German Army base and didn't set foot in the US until I was 15, and I have been a US citizen since the day I was born.

    Unfuckingfortunately, he's fine because it says you can be a "naturalized" citizen…which he is since the amendment allowed for citizenship as long as the parents were American and because he's lived here long enough. If anything he'd need to take the simple citizenship test which should be a breeze (especially since Republicans are notorious assholes about patriotic things) Sorry, but he's still in.

    When children of active duty military are born out of the US, they have DUAL citizenship from BIRTH. From the country they are in and THE US as their parents are US citizens and the parent is serving their country, THE UNITED STATES. The professor is full of S___.     i think that the panama canal zone was a duly constituted insular area of the united states at the time that john mccain was born there and therefore he has natural born birthright citizenship as defined by article 2, section 1, clause 5 of the federal constitution. i don't know who i'm voting for, but this is a completely fraudulent issue made up by some hack political enemies of mccain. case closed.

    It would be an absolute conservative's dream to have McCain become disqualified as the Republican's nominee. He was never the conservative's choice. The reason why this will never be an issue is the the democrats want McCain right where he is because it pretty much guarantee's a win for Obama.     wait a minute..he was born in panama because of his fathers military duty. not because his parents were off in a vacation or his parents were ex pats but because of MILITARY DUTY…..we give up our "normal" lives to go live on bases..move around where this country needs us to be..and our children are considered LESS AMERICAN!? give me a fucking break.
