CRASH COURSE ON IMMIGRATION POLICIES:
1. Any marriage that did not occur in good faith is considered null.
2. Same sex marriages are not considered an actual marriage.
3. When you marry a US citizen, and you are given your green card, you are placed on a 2yr conditional residence period, much like a probationary period (in most cases). After that period is near over, you have to file an application to remove the conditions restricting your FULL legal permanent residence. Upon applying, you have to prove that your marriage has been a fully functional relationship, showing proof of joint residence as well as presenting letters from family, neighbors that such a union is considered vaild under law.
4. If a divorce occurs before that two year period is over….bye bye green card, unless you were divorced due to domestic violence, etc.

Although gay marriage is now legal in CA,- gay marriages does not confer any immigration benefits whatsoever, unfortunately. Immigration is controlled by the federal government, the the fed govt. does not recognize gay marriage.
We hope this situation turns around in the future- but for now- gay marriage does not provide immigration benefits.
