Guess when you have a lot of daddy's money to spend, it's easier to waste it.

Rudy Giuliani's son is suing Duke Univeristy and the men's golf coach.

Why?

Turns out Andrew Giuliani was kicked off the team.

Really!

And he's suing because of that!!!!!!!

Andrew, a senior at Duke, claims in the lawsuit that he was illegally terminated from the team this past February without any warning.

Uhmmm, who says you need a reason to be terminated from a college sports team????

It's not like you signed a contract!

According to the lawsuit, the men's golf coach, O.D. Vincent "announced to the team that he was unilaterally canceling Andrew's eligibility to participate in the University's Athletics Program immediately and indefinitely. Andrew and his teammates were shocked. Andrew had no prior notice of what was about to happen. At no time was Andrew ever given an opportunity to defend himself; instead he was summarily dismissed."

Poor Andrew.

Did he suck at golf or was it just his attitude?????

Well, according to the coach's rules, the only way Giuliani can get back on the team is to have written letters of support submitted by each team member.

But obviously that isn't happening!

So instead, he's going to sue.

We're guessing maybe the whole team doesn't like him?

The claim continues, "Andrew's suspension would become a permanent cancellation of his athletic eligibility at Duke unless every single one of his twelve teammates wrote a letter to O.D. Vincent that O.D. Vincent deemed 'satisfactory' supporting Andrew's reinstatement to the team and explaining the reasons why."

The document also alleges that coach Vincent "strong armed other team members to not support Giuliani's return by threatening to kick them off the team."

The suit continues, "It was plainly obvious to each team member that their own personal interests were directly in conflict with Andrew's reinstatement to the team. They feared that O.D. Vincent could unilaterally dismiss them from the team without warning or notice."

Riiiiight.

As for daddy's help, Andrew said he's asked not to receive any.

He says, "I love my father very much. I just decided not to ask him to get involved in the situation."

    I go to Duke University and I've had a few classes with this kid. He is a REAL asshole! I highly doubt that his teammates were 'strong-armed' to not support Andrew. They probably agree with him being gone and just want to make it look like they aren't selling out their teammate. Trust me, this guy is a class act and he deserves whatever comes at him. I really dont see him winning this case at all.

    It's weird because the arguments they are using to substantiate the lawsuit amount to constitutional due process arguments (i.e. no notice, no hearing.) That won't fly because Duke is a private university and they can do what they want. It sould have to be a state university for them to sue for violating a consitutional right. So I'm thinking there must be a contract and the contract states there should be a hearing before dismissal. If not, Giuliani knows he is on shaky legal ground.

    I graduated from Duke the year this kid started there. The study body was rather appalled that he'd gotten in on a golf scholarship. That's right; even though his daddy's loaded, this kid got a FULL ride to one of the top schools in the nation because he's good at golf.

    And now he's suing the school?! He should have declined the scholarship and just gone to the school but now he wants more money when he has plenty. I think this is just ridiculous.

    However, I want to believe that Duke University had some sort of valid reason to dump Andrew Guiliani from the golf team. Doesn't seem like they would want the controversy and the bad publicity that would result from dissing a pretty well-known family name, with lots of money. Just curious, I would like to know more facts about this case.

    First I'd be shocked if this kid was on a full ride. Most schools don't give out Full Rides for Golf. He was probably on a partial scholarship. Second, LOI or contracts to play college sports are only valid for one year and are renewed each year. Where the problem lies is if the kid didn't violate any rules and he was kicked off the team for other reasons. Duke has just ruined his D1 eligibility without cause.

    While I most certainly would have chose different words, you are correct. Athletes on scholarship, and generally all team members, sign a contract or agreement in some form. Additionally, when a player is 'dismissed' from a team the NCAA outlines certain regulations which the coach, the athletic department, and the University must follow to dismiss the player.

    Honestly, one cannot expect Perez to be aware of this….unless being flamboyantly gay is a new college sport.

    i love you perez, but i gotta say: you do sign a contract, it's for the full academic year/season, and i'd assume he's on a scholarship, so the contract entitles him to a full year at a time at the scholarship value. but you can be dropped from the team for lots of different things, like being stupid/academically ineligible to compete, poor performance, blah blah blah. sucks to be him, but i'm sure he can play golf anywhere else, in school or just out on the course, duh!

    i live in raleigh and i have a lot of friends who go to duke. 99% of them are not snobs, they don't look down on people and they don't look for a free ride. everyone i know has to work hard as hell to get where they are. i know a few who dorm with him and they can't stand him. he wants everything on a silver platter. he didn't try to run into a collapsing building on 9/11 so he shouldn't expect any special treatment for it. after all, he didn't do it, his dad did. and god knows, he probably wouldn't have done it, he probably would have ran like everyone else did.

    College sports ARE important if you want to play professionally. Besides I don't care who you are - it never looks good to get "fired", even if it's just off a sports team.

    Fact Checker For Some Idiots That Think They Know: You only sign anything if you are on scholarship. Any scholarship is purely a one year agreement–in all sports and all schools. Even if he is on scholarship (which he probably isn't) Duke will probably honor that scholarship even though he is not on the team. Anyone who thinks a crap golfer with a bad attitude on a team full of guys who can't stand him should be allowed to stay on the team must be able to relate.

    haha i love the people here who have no idea what they´re talking about…how many of you played Division I athletics like I did and know the system…how many of you know that in Division I athletics you sign into a CONTRACT that is worth 10s of thousands of dollars…and is tough to be broken by both parties. I don´t know if he was on scholarship but he can do whatever he wants…why are people cutting him down because he loves to play a sport and is very passionate about it! and yes, I went to Duke, and No, it´s not an Ivy League school like some people here say (those who clearly don´t know the educational system in the States very well…), but it´s a damn good one…everyone needs to get their facts straight, spend a little more time on their own lives and doing something productive rather than criticizing others…even if he´s being a brat, who hasn´t done bratty and stupid things in their lives!

    Actually for Division I programs such as Duke (depending on the sport) many student-athletes are asked to sign "letters of intent" that state one's desire and legal obligation to play for the school. If the golf team was a scholarship-based sport and A.G. was on scholarship, they can't just "kick him off".

    Hey Perez - just to clear a little something up, you do actually sign a contract to play on a college sports team in most circumstances. I played Division 1 lacrosse for the NCAA and in order to get my scholarship or even play on the team i basically had to sign my life away, including multiple contracts. You can be terminated from the team for many reasons, however - the most usual one is breaking team rules - but even then you typically have to go through an arbitration process. With all the trouble Duke athletic department has faced in the past, i would be surprised that they would make an erroneous termination, especially of someone like this who they know has access to the media. Unless they are complete morons, i am sure that the athletic department at Duke had reason for the termination.

    You have to understand division 1 golf before making any comments. He might have just been kicked off bc he exceeded his 4 year playing limit (he can still be a member but just can't play). Also, the coach just might be a total asshole and they usually do give a warning before you get the boot.
