    It's not over yet.

    Roughly 400,000 votes separate yes from no on Prop 8 – out of 10 million votes tallied.

    Based on turnout estimates reported yesterday, we expect that there are more than 3 million and possibly as many as 4 million absentee and provisional ballots yet to be counted.

    Given that fundamental rights are at stake, we must wait to hear from the Secretary of State tomorrow how many votes are yet to be counted as well as where they are from.

    It is clearly a very close election and we monitored the results all evening and this morning.

    As of this point, the election is too close to call.

    Because Prop 8 involves the sensitive matter of individual rights, we believe it is important to wait until we receive further information about the outcome.

    Agree!! I feel so lucky to live in Canada where same-sex marriage has been legal since 2005. But the fact that a vote with only 51% of support can now change the constitution, which was made to protect the civil and human rights of every American, and remove those rights is just plain wrong. In most school divisions, student council, and other groups/organizations, any amendment to their constitution usually requires 60-65% of members being in favour of the change. The fact that Californian voters can do this is wrong. JUST PLAIN WRONG. Didn't they all just vote for change in giving their support to Obama?? And then they turn around and say "we don't want this change." WRONG. All human beings are equal. Period. End of story. I know it's not my state, or even my country, but I feel for my fellow gay and lesbian human beings out there who are still fighting for a right that I already have.     the only state that has passed gay rights legislation without a threat from the courts or a civil law suit is new hampshire.nh approved civil unions which is inferior to marriage in my view. however, the legislature debated the bill. passed it and the govenor signed it. there was nothing pending in the courts they just did it.

    The difference between a regular vote and amending a constitution is that it really needs support of MORE than a majority to get passed. That's why 51% is UNFAIR and unjust in this change.
    Under the rules of an election, the majority of votes will determine who gets the electoral votes from each state. So, if Obama gets 51% of the vote, he gets those electoral votes.
    However, we're talking about a constitutional amendment. The constitution was created and written to protect the rights of Americans everywhere. When a constitution is amended, in most of the world, it requires in-excess of a majority of support in order for the change to occur. Having participated in various organizations and student councils, and even been present at school division board meetings, I've seen and been apart of votes to change constitutions numerous times. They always require 60-65% support for the change to be made. The constitution, while protecting the rights of individuals in the state of California, deserves to be equally protected by requiring a greater-than-majority vote to be amended. Why are such seeming small and trivial constitutions for organizations protected by such measures, but major government constitutions are not??
