51% IS a majority… it's just that those 51% are idiots
Someone can win the PRESIDENCY of the strongest, mightiest country in the world with 51%. Why is this different????? I don't support Prop 8, but your reasoning is invalid.

Read the Constitution- it is the state's right to do so, although I wouldn't consider Prop 8 to be a done deal yet. Seriously, people- take a frikkin' civics class and understand how the system works. Then you'll be able to do something ABOUT it the RIGHT way.
Crossing my fingers that Prop 8 gets voted down, because discriminating on the basis of sexual orientation is no different than discriminating on the color of a person's skin or their cultural ancestry. Also- marriage is a religious concept and should be left to the religions. PERIOD. The states should be talking about CIVIL UNIONS and not MARRIAGE.

I do not support Prop 8 but by your logic, I would say that none of the states that were won with a very small difference percentage wise by Obama should have gone to Obama. There should have had to have been like a 10% lead or else the electorates should have been split, or a revote should have been demanded. Majority rules, even when it's a small majority - not just when it's something you like.

It should take a 2/3 majority in states to make a constitutional amendment just like in congress. However, a proposal for an amendment to our GOVERNMENT shouldn't be allowed at all if it is based on a religious doctrine. Not in a country supposedly founded on religious freedom for people to choose to believe how they wish. It is only RELIGION that defines homosexuality as wrong. No religion should decide to limit our freedoms in a country designed to allow us freedom of religion.

My heart is just breaking over this one. No one should be able to tell you that your love is not good enough to commit to one another in marriage. NO ONE. Please, California, don't let this happen. Do everything you can in order to eliminate this most ridiculous discrimination! We have had same-sex marriages in Canada for over 4 years now, and we didn't melt away in the throes of Hell. No one is holding a gun to the head's of the churches forcing anyone to marry same sex couples. We are going along just fine! If you don't want to marry same sex couples you don't have to, but don't tell them that their love means one iota less than the love two opposite sex couples share. As someone who was raised Catholic- I still believe this is so wrong. This isn't about religion people! There is no law going into effect that churches, temples etc. legally have to marry gays, lesbians, transgendered people, etc. All it does is give those who CHOOSE to marry whoever they want the same rights as everyone else. Let's not forget the country we live and the principals of this country.. Every person regardless of age, race, sexual orientation is equal. I totally think that discrimination is unacceptable to anyone. And dont you go compare gay discrimination with black and white segrigation. It is not EVEN REMOTELY close to the same. That discrimination took place 50 years ago and wasn't because of a choice that blacks made. But Gay people choose to be gay. Period. I understand there are "gender" confused people and that is a whole other topic in itself.

A) The supreme court is there to oversee the other two branches of government. It is part of the checks and balances of our system. They are allowed to overturn anything whether it gets a majority vote or not, if it violates The Constitution or Bill of Rights. They were allowed to say this was okay.
B) Your argument is based entirely on your belief in your god, which is protected by said constitution. But so is a homosexuals belief in their religion and their god, who says it is ok.
This country was founded so that religion would not affect our policies and freedoms. That is what our ancestors left their countries to find. To now use religion to limit someone else's freedom, goes against our basic rights as Americans.
I don't think Prop 8 was about Hate, but it was about religion and that is an unacceptable reason to change the state constitution. No matter how many people agree with it. It is against homosexual's federal rights.
The supreme court can overturn this too. Even though it got a majority vote.
It needs to go to the Supreme Court.

I agree with you on the fact that people should have voted no to Prop 8 and in this day, there is no reason why 51% of people should vote against allowing gay couples to marry. People should be allowed to marry whoever they want. But we live in a democratic system where people carry the power with voting.
To say that 51% is not enough of a majority does not hold water.
Granted a little different since President is based on the Electoral College; but under your arguement - People can say it is unfair Obama won because he only got 53% of the votes.

I completely agree. I think form teh bottom of my heart that Prop 8 should not have passed. I used to love the fact that I lived in a liberal state that has always pushed toward progress, but now I am horrified at the number of people who have no respect for love, equality and others attempt to lead a happy life with the ones they love.
BUT I won't give up, and I encourage everyone to continue to fight for equality, liberty and the pursuit of happiness.

My intention was only to point out that a majority vote passed Prop 22 in 2000, and looks to have passed Prop 8 in 2008.
Yet it was "totally fair" when a few supreme court judges overturned Prop 22. Is their sole purpose not to uphold the law, and the rights of the people (majority)? Or to push forward the desires of the minority?

Specifically, the constitution goes beyond poliitics, as it is the foundation for all the laws in the present, future, and in many cases, might even have a retroactive impact. The constitution is supposed to transcend political battles, because once that is changed, it cannot even be disputed by the courts. Therefore, what Perez is saying and educated people understand is that the constitution should not be changed by a mere majority vote because it is not clearly the will of the people yet it is difficult to repeal once put into place.
So if you really are proud of our democracy, I recommend you open a book/ surf the internet and learn what it's all about rather than making yourself look like an idiot.

Be careful what you ask for. Going back to the early 1900's, 70+% of the California constitutional amendments that passed would have failed if they required 2/3 vote to pass.
i don't think that the amendment was a good thing at all, but if they change that then no one should be elected to political office with that small of a margin between them. what's the difference between the two. you know how many problems that would cause.

This means they can overturn any case they choose to have visit their courts.
They are to protect the rights as governed by the constitution and it doesn't matter if that protects the majority or the minority.
If it is unconstitutional, it's unconstitutional.
