    Re: itsallinlove – No. They were put in place to uphold the constitution. If a law is unconstitutional it will be overturned. The biggest risk here is not that Prop 8 passed but whether or not the constitution will be rewritten to add that marriage can only exist between one man and one woman. If that happens this fight will get a heck of a lot harder.

    Most states take their constitution seriously and require super majorities at the very least to change the constitution. I would suggest lobbying for such a change in CA now. OF course there is hope there seems to be some legal confusion around Prop 8. If the constitution gave marriage rights and now they are being taken away it's a revision and not a simple amendment. A 2/3 majority is required and Prop 8 will have to go back to the drawing board.

    I honestly STILL can't believe in the year 2008, after all the advancements we have made in bringing discrimination to a halt, we are still closed minded enough to not let people in love be together with the same civil rights as everyone else in this world has, solely because they are attracted to someone of the same gender.     Marriage is the union between a man and a woman, and I guarantee you at the time that was documented to be the "be all, end all" of marriage.. that the people who documented it, at least one of them, was attracted to someone of the same sex. The ONLY reason it was not looked at as something that should be done is because back then it was such taboo, so fucking hidden, that most people wouldn't dare have the balls to openly express their love for someone of the same sex, most forced themselves to be miserable and depressed attached to someone of the opposite sex while they snuck around and did things they actually liked behind closed doors. Now that being "gay" has been something people have been able to be honest about and no longer feel the need to have to hide.. there is NO DOUBT in my mind that that little rule there should be changed to adapt to the times that have also changed drastically. You can't honestly tell me back then that no one who had anything to do with the "Bible" was never, and never thought, about being with someone of the same fucking sex, it isn't a fucking choice, it's something your born with- back then they couldn't be happy and embrace that, now that people are able to do so publicly, why the fuck shouldn't they be able to have every right every straight person has?

    The statement Perez made is spot on.
    A constitution should not be ammended any time the political winds change direction. It is in place to protect fundamental rights of minority groups from being trampled upon. For this reason the U.S. constitution may only be ammended by a two-thirds majority in both the Senate and the House of Representatives.
    Those of you who rant about simple majority rule really should have paid attention in civics! Perhaps you should start by reading the Federalist papers by Hamilton, Madison, etc.
    Imagine a nation in which African-americans or women could be denied the right to vote just because 51% of people thought they shouldn't! How about denying interracial couples the right to marry…again.
    It is awful that the Florida proposition passed but at least they have some sort of standards for ammending their constitution (though it would have failed by 1% if they required a 2/3 majority instead of merely 60%).
    CA needs to seriously evaluate our ammendment process.
    The potential approval of prop 8 is an abomination and an assault on everything America stands for but it's not over yet! Wait till all the votes are counted.
    P.S. It's not "whining" it's called engaging in a political discussion and making your voice heard.

    well, the constitution was never designed to GRANT government the power to do anything. Read the Bill of Rights, and notice that the writers took great care to clearly say, "Congress shall make no law…."; "The judicial power of the United States shall not…"; "The right of the people… shall not be violated…"
