One of the roles of the law and our judicial system is to protect minorities from oppression, and this is oppression.

Yes it is a terrible proposition. I think people who voted for it may not have liked the wording of 'marriage' to include gays. We have civil partnerships in the UK, the term marriage isn't used and no-one seems to have a problem with it - and the UK can be a very homophobic country like the US.

Re: Wrenn – …. except that even in a democracy we don't get to take a vote on whether or not a subset of the nation's people really get to have the rights that were given to them in the constitution.
When there is a question or debate about how the constitution applies to a certain present-day situation the question goes to the supreme court (of a state or country) for their interpretation of what they think the constitution is legally saying.
The CA state Supreme Court said that the state's constitution allowed for gay marriage.
Because of that, a lot of PO'd inbred creeps got all pissy (oh no! People whio love each other can get married!?!) and put prop 8 on the ballot not to decide to allow gay marriage in the state (again,voters cannot vote for something that is unconstitutional) - prop 8 was for amending the constitution to make gay marriage unconstitutional.
I think a huge part of the problem is that this illustrates to everyone that, at least in CA, it only takes a simple majority vote to make drastic changes to such a fundamental document.Think about it: do you have any idea how rigorous it is to alter the federal (US) constitution? Hint: it's a hell of a lot harder than just getting a simle majority vote.

The primary reason for spousal benefits is because the female usually takes on the unpaid role of childcare of the offspring, and spousal benefits are a form of ensuring that she will remain supported in the absence of the primary wage-earner; whereas homosex partners could both be lifetime wage-earners. Same-gender romances already enjoy the right to live and love together. They should not be classified as marriageable, because they cannot entirely come together in the definiton of the word "marriage". To come together as one, in the human being scheme of nature, would be to pro-create. If there are no offspring, then marriage serves no real purpose other than the religious purpose. The End.

Thanks Perez for posting this, it really was by far the most amazing thing that I've heard anyone utter relative to the situation here in California. We will prevail-I am certain that the State of California Supreme Court or the United States Supreme Court will vindicate us in the end. Until then-keep fighting for equality for all…because at the end of the day this really is so much larger than just a gay vs. straight disagreement and all people should be concerned about the addition of text to the Constitution of the State of California providing specific omission of basic rights to one class of its citizens-unfair, unequal and wrong!

Yanno … back in the day there were a lot of studies done showing that blacks were less evolved "creatures" than whites. Very extensive research was done to prove that black people had smaller brains, slower reasoning abilities and were "bred" for nothing but manual labor. They were work animals, NOT human. Social studies and surveys were often conducted and the results published showing that blacks were "prone" to laziness, rape, and thievery. Despite the fact I am Republican and a conservative, I support gay marriage…but to answer your question Keith…most people do not because biblically Sodom and Gomorrah (sp?) was not defined immoral with pictures of blacks and whites, just homosexuality. The race issue was just WRONG. Even liberals I know STILL hold onto the idea of decency and what is right or wrong and view being gay as immoral. Personally to me, love and equality should prevail. I am sad for those who wanted a different outcome.

Keith Olbermann did a phenomenal job on this piece. Like him, I had no involvement in the issue….not gay, very few close friends that are….hell, I don't even live near California. After hearing Keith's commentary I now know EVERY human should have had a stake in Prop 8….and we should have dione everything in our power to see that it FAILED!

I thinks it commendable that news figures such as Keith are expressing their opinions about this. The only thing that gives me hope is that gay marriage will be legal in the years to come. That christianity's numbers are slowly going down. And that the number of young liberal Americans is growing every day. We will not "get over this". We will fight until we are treated equal under the law. We will fight for what we believe it. We will not go away. In 2 or 4 or even 8 years from now, gay marriage WILL be legal. This is just another ugly time in our country. Gay marriage is the current target right now because it just isn't cool to be a racist anymore. Don't give up the fight.

I love Keith Olbermann, and watch him every weeknight, but I disagree with him on this. I am a Democrat and voted for Obama, but voted against gay marriage in Florida, where I live. This is not a civil rights issue. How dare the gays compare themselves to African Americans. Their plight is NOWHERE near what African Americans went through in the 60's. Being gay is a choice. I know I am going to get heat for this, but being gay IS an abomination in ALL of the religious texts. Sorry, but if you are gay, and if you practice that lifestyle, you will not go to Heaven. This is great. I love to see broadcasters who aren't afraid to speak their mind. Olbermann is in a position of slight power (for the few who actually WATCH MSNBC…) and he is exercising that power to speak out against this truly H8einous proposition.
