The murderer was just found not guilty by reason of insanity!

He will be sent to an institution, without serving any jail time, and will be mentally evaluated every year. If and when he is deemed "sane" again, the murderer will be released.

    This act was indeed horrendous. God told him to do it.
    The man had no criminal record, but did have schizophrenia, and was found not
    criminally responsible; or in other words, mentally ill.
    He will be in a high security mental facility, and has to contribute DNA to a databank. These types are mostly never released back into society.
    Time will tell.

    Insane? No kidding. Jails are not equipped to deal with someone like this, he belongs in an institution. He will be housed at a psychiatric facility for the criminally insane - just like a jail but with staff trained to deal with not just criminals but the crazy ones.

    People to need to realize that mental illness is a serious problem, and people with schizophrenia, the disease that the killer suffers with, causes many incredibly challenging side-effects. Schizophrenia untreated, as his was, leads to hallucinations and voice hearing which cannot be ignored. I feel terrible for the McLean family and what they have gone through, and also think that Greyhound should make some serious security changes. In Canada being found not guilty by reason of insanity is legal. In this case it was proven beyond a reasonable doubt that the accused is in fact insane because of his untreated mental illness. It is comments like yours Perez about this ruling being "so fehked" that perpetuate the stigma that people with mental illness face. Maybe you should include an ad on your site that attempts that educate people about mental illness and the seriousness of it instead of bitching about the people that suffer.

    Rediculous. The laws definitely need to be changed. If someone is mentally unstable and commits crimes, I believe that is EVEN MORE reason to put them behind bars. I believe that they should build a prision or make a section of a prision dedicated to mentally unsound criminals.     The details of the mutilation of the body if you follow the link are just downright disturbing. But if a guy is throwing around body parts, putting them in his pocket or eating them, you can be pretty sure they are not in their right minds. The victim's family is trying to change the law in Canada so that even if someone is found not guilty by reason of insanity, they still have to remain locked up for the rest of their lives. The problem with schizophrenia is that a person can stop taking the medication. Would you want to live next door to this guy if he stopped taking his meds? Uh - NOPE!

    Perez, jail does not solve every crime. This guy has some serious mental issues…he said god made him do it. He will never see the outside world, as it is very hard to be released from a mental institution when one has committed murder. What the hell would be the sense in locking him up in jail and not treat his mental issues. If he was sent to jail, the probability of him killing other inmates or guards would be high. Honestly…when the hell did you get a degree in psychology??? What makes you so self righteous to think that it is messed up that he is locked up in a mental institution? Have you ever been to one…it is a jail in itself. It is not like he has an easy ride ahead of him. Get a life, and seriously, why the hell are you reporting on this anyways??     I'm ashamed of being a Canadian today, and of the Canadian justice system. Though the odds of him being let out are very very low, in the event that he is released, he won't have a criminal record. This is outrageous! This young man died a terrible death needlessly. On top of that, the things he did to his body following death were disgusting! He mutilated his body after he stabbed him to death and beheaded him. The tongue and eyes were NEVER FOUND and presumed eaten, and his ears were found in the murderers pockets! Tell me that he doesn't deserve to go to jail for life, crazy or not!

    Yes it was a brutal crime, but it would never have happened if this country had a decent mental health system - if this man actually received treatment for his illness that he needed when he needed it!

    The only way for people to get help for their mental illness is either through prohibitively expensive private treatment or through the legal system because they've broken the law.

    The mental health system in Canada needs to be changed, not the law.

    MCFly88, that was a great post. This guy def needs help and should be in an institution, not running around a jail. As well, from what I understand, they can keep him in an institution "indefinitely" rather than being released from jail in a few years. It is the best place for him.
    This is why there are less Canadians in jails than Americans!! We want to make the people better, not just let them rot!!!

    FYI when someone in Canada is found NCR (not criminally responsible) they are detained at a mental health facility based on their level of danger to the community, he obviously will be held in a maximum security facility. Anyways it doesn't work that easy "once he is sane he gets out" His mental state is evaluated DAILY, but a major review with a panel is held yearly, there it is decided weather he stays in MAX or gets to move somewhere else like medium security, If your in max, you have to go through lots of steps, MAX, Medium, Minimum then possibly community. The facts in all actuality are that someone who is found NCR may in fact end up serving MORE TIME than someone who went the jail route. Someone who has been found NCR for say "mischef" could end up being in an institution for 10 yrs OR MORE, where as if he went through the criminal code way may just get a fine and probation. This guy is "doing time" just in a different way. These things are not taken lightly, he in fact may never get out. I know all this info because I work for a medium secure facility in Ontario!

    These types of cases are SO tough, and are the reason why I stayed away from the criminal branch of law, especially as it stands in Canada. Both the Crown and Defence in this case thought this was the best method to deal with Mr. Li. I am torn, and perhaps it is because i have an extremely basic understanding of mental illnesses. As much as I am a proponent of jail time as punishment and deterrence as opposed to rehabilitation, the only way I can justify this in my mind is that hopefully the doctors in the institution will be realistic in their evaluations and not want to have it on their consciences if this guy brutally kills another person. I guess those in the criminal justice system in Canada are the eternal optimists.

    Canadians are smart enough to accept this ruling. It does not mean Vince gets away with ANYTHING. He is going to be locked up in a hospital forever. This man is sick. He needs treatment. His lawyer has said that Vince accepts full responsibility for his actions. Mental health care is SHIT in Canada. ABSOLUTE SHIT.

    A teenager killed herself in jail as guards WATCHED. Because she was not able to get the proper mental health care. The guards were ordered to leave her alone and she died.

    Mental conditions always go by the wayside and nobody cares. Look at all of the fundraising that goes to cancer, (not that patients don't deserve it), and look at the fundraisers for mental health. There are next to none and people suffer.

    Andrea Yates, the Columbine boys, and the shooter at Virginia Tech are just some examples of the horrid violence that has occurred in your country due to no help for the mentally ill.

    All people from this world have the RESPONSIBILITY to help the mentally ill or we ALL pay.

    I'm Canadian, and I'm studying Criminology!
    We just talked about this yesterday in class. Just because he has been house not guilty due to insanity (or NCRMD… Not criminally responsible due to metal disorder, as we call it), does NOT mean that his is going to get off easy!

    The psych analysts that will evaluate him every year are not going to take the chance of releasing someone like that back into the public, even if he appears to be 'sane'.
    I mean, do you think the Canadian justice system wants the blood on their hands if he commits another murder because of his mental disorder?
    I HIGHLY doubt that he is ever going to be released into the public. I mean, his case was so high profile that it's not like he's just going to disappear.

    Yes, what he did was truly fucked up, but I think it's safe to say that he's not going to be walking free again… I mean, when BOTH the defense and the prosection want to plead insanity, then it's safe to say that the guy is insane, and will have to be kept in a facility for the rest of his life.

    …But it gives me one more reason to hate greyhound. Afterall, how do you know the person sitting beside you isn't a psycho? Luckily, they've taken some extra procautions since to make sure they know who's on the bus.

Canadian judgments are cited worldwide by other common law legal systems, as precedent and evidence for their own decisions. Every system has its faults - name one program/institution/government that runs perfectly. While I agree Canadian courts cater FAR too much to the demands of individuals, I have no idea where you are getting this infestation of zealots calling for Sharia law - any incidents where this happens is an anomaly in everyday life here.     Re: LeAfY – Actually the Harper government has instituted mandatory sentences for violent crimes, which gives judges and juries no leeway to give a criminal a lesser sentence than the mandatory. There is no way that "guilty by reason of insanity" will ever be dismissed from the legal system, and no politicians (being politicians) will pass a bill that takes this away - they would be far too worried about losing their share of the "social justice" and supporters of the mentally ill vote.
    Even if they did, there would likely be a Charter challenge, and my guess is that the Supreme Court of Canada, as it stands, would not uphold the legislative change.

    I am an American living in Vancouver Canada and I can tell you, I am so appalled by the lax law enforcement in this country. I was living here when this psycho killed that poor guy last summer. They need lock him up for the rest of his life in an institution, you don't ever let him out. I live in downtown Vancouver across the street from a half way house which is where they put recently released criminals, and I can tell you it frightens me to no end. Last fall they released a repeat sex offender to one of these places and guess what! he did it again! That's all we need is a man who decapitated someone and ate them to be deemed " fit" to be released, what if he decides he doesn't need his meds. There's a gang war going on here and almost all of the people shooting people in broad daylight are repeat offenders that the canadian government just decided were fit to return. I can wait to get the fuck out of this messed up place. I never thought I would miss american justice

    As scary as it sounds to hear "if he is deemed 'sane' again he can be released", that isn't very likely. If ever there was a murder case where the murderer could appropriately be considered to be "not guilty by reason of insanity", it would obviously be this one. You don't GET more crazy than this guy, he's crazier than Hannibal Lecter. Chances of him ever beeing deemed "sane" are pretty much zero. He'll be locked up in a facility that's appropriate for people with dangerous mental illness probably until he dies.

You have to be assessed to be not of sound mind AT THE TIME OF THE CRIME, and if you read li's case he clearly wasn't of sound mind.     I live in Winnipeg (where this is taking place), and public transit is a big thing in our city with nearly half of all travel using such a means. The greyhound bus is said to have been crippled by this and I dont blame ppl for not feeling safe anymore.
    The crack heads that ride the bus to stay warm are one thing, but those with weapons obviously of the intent to preform a butcher are a different story. By the sounds of what went around shortly after the incident, to the conflicting psychological examinations, this man sounds crazy yes, but he KNEW what he was doing and KNEW that it was wrong… he stabbed this kid that was sleeping! For no reason except he was the closest victim!
    he then proceeded to behead him, consume pieces of him, and then taunt those outside the bus with the head… he was also later found with other parts of the victim's body hidden in pockets and other places on his body. Our mental health institution is so full of holes that I'm terrified of the real possibility that in the likely situation of 5 years, some dumbass psychologist is going to let this monster loose on the public… i wonder how many victims there needs to be before change occurs…

    I have a brother with schizophrenia and I it makes me so sad that we live in a society where the public is SO MISINFORMED about mental illness. I bet none of you knew that 95% of ALL murders are committed by SANE individuals who know exactly what they are doing. It happens A LOT this just happened to get a lot of media attention, the forensic mental health system is doing its job, and for those who said its his fault, he didn't get treatment… HE HAS SCHIZOPHRENIA!     This case aside, I do think Canada is far to lax on crime and cares more about the criminals than the victims. It is almost like "Oh the victim is dead anyways so who cares." They had some serial killer named Karla something or other who tortued and killed teen girls with her sicko husband and they let that bitch out after a few years. They are really too liberal for their own good.

    They way I look at it is that once the criminal makes the decision to take someone else's life…they are taking theirs as well through their own actions. The state is just carrying out justice.

    I actually live in Winnipeg, Manitoba Canada (where the trial is taking place) and it's a farce. The mother if Tim made a comment after the judgment was sent down and she said:
    "It's one thing when you're not physiologically responsible for what you do, but to not be criminally responsible, it doesn't make sense.."
    I agree with her, Vince Li broke a law and took a life, he should loose his freedom in return.

    Re: @v@ – In Canada, people who commit serious offences and are in Mental Facilities get released all the time. Murders spend only a few years in jail and get paroled. Convicted rapists walk away from halfway houses. He should be held responsible, even with a mental illness. Our premier closed a mental facility in our province a few years ago….guess where everyone went? On the streets. Our justice system is a joke, it makes every criminal out to be a victim which is total BS. USA has a 3 strike rule, Canada has a 30 strike rule.     the guy is mentall ill, if he is sent to prison chances are his lowers would appeal to the supreme court and get that overruled. In the last week one mentally ill girl committed suicide in prison (she threw apples at a postal worker and was in jail since she was 13, she died at 19 and the guards just watch her kill herself). The killer did something bad, but he is very crazy, chances are he won't be let our of the institution for a looooong time-keep in mind he could stay there indefinetlly, there is not max time for mental institutions.

    The Canadian Justice System has done it again! If an immigrant can't behave themselves they need to be deported. We have a lot of sick bastards living in this country, I don't think he will last long on the streets.

    I agree that he shouldn't be put in jail; I think that jails, quite frankly, are way too cushy for someone like this. Also, being in jail for him would be just like asking for him to kill many other prisoners and/or guards. They wouldn't be able to handle him in prison correctly. I think why everyone is so bothered by this verdict is that he is found "not guilty" by reason of insanity, and that he has nothing on his criminal record. That is wrong; he should be found GUILTY by reason of insanity. It should go on his record, so it is known that he could potentially be a dangerous person. I also think that anyone found guilty of brutal murder by insanity should be made to stay in a mental institution INDEFINITELY.

    I have a cousin who has schizophrenia, and I know they can get rid of most symptoms of it for some people, as they did for him. However, he has never been even close to violent (his voices tell him to steal things). But, I know how awful the drugs are (many make them feel not well at all; my cousin feels jittery and fidgets all the time), and how easy it is for someone to miss a pill or two. In this way, they can call the patient "cured" and let him out, and he can stop taking the drugs. I wouldn't even have a problem with them being let out (much later in their treatment, obviously, and after they have been deemed "sane") for work programs and the like, as long as they are required to go back and take their meds.

    First of all, I hope something like this doesn't make people think all mentally ill or schizophrenic people are dangerous, because only 2% actually are. Those people are misunderstood enough without one person doing some violent thing that puts everyone in a state of fear. Know that he's an exception, not a rule. As for him, it makes sense he would go to an institution as he's obviously completely insane. He won't be released back onto the streets in a year, I can guarantee you that. He'll probably spend the rest of his life there. Sad.
