This is gonna get ugly!
Even though Larry Birkhead is the biological father of Anna Nicole Smith's daughter and she is in his custody, Howard K. Stern thinks he should have control of little Dannielynn's money.
And he's taking it to court!
Thursday morning, Howard filed papers asserting his role as the executor of Anna Nicole Smith's estate.
Stern, Anna Nicole Smith's former attorney and companion, asserts that he "has at all times been the duly appointed acting and personal representative of the estate."
In a new petition to determine distribution rights, Stern claims the 2001 will Smith signed before the birth of Dannielynn, which gave all the money to her deceased son Daniel, now applies to the little girl.
Further, Stern claims he is the sole person responsible for holding Dannielynn's money in trust, even though she is in the custody of her biological father.
How will Larry respond to this????
Or did he and Howard already come to some sort of "agreement"?????

take the trouble to learn what you are talking about. the trustee DOES NOT have access to the money that is in a trust. the trustee is entitled to a percent of the money but howard has already waived that fee and is doing this without pay. larry is probably thrilled to death to have howard take care of this matter.

This is not exactly the story Perez. Stern is trying to get the baby to inherit since the will excluded anyone other than Daniel. Read something other than a gossip rag!
Executor or Trustee does not mean they gain any income or benefit even. It is duty bordering on burden. they have the obligation to, under the supervision of the court, distribute, invest and manage any property, real or otherwise under strict consideration of the deceased entity's direction, and under the rules of CA probate code.
Isn't this just what he will do as executor anyway?
This article is a lil misleading…Howard was there filing for Dannielynn to get the Marshall money, IF and WHEN they win the case against the Marshalls. REMEMBER people, In Anna Nicole's will all her money was to go to Daniel, and for some odd reason it said even if she has other children they were not to get any, ONLY DANIEL. Well Howard was there to file for it to become Dannielynn's inheritance.

If you're going to report a story, please report it correctly. He does not want her money. He filed papers today to amend her will to name Dannilynn as Anna Nicole's sole heir since ANS died before changing her will. As Executor of Anna's Will, it is his job.

Howard filed papers in court to make Dannielynn the sole heir since at the time of Anna Nicole's death the only valid last will & testament stated that any future children were to receive nothing. So I think Howard, as executor of the estate, is doing the best he can for Dannielynn.

Furthermore, Howard is probably the named Trustee of any trust created under Anna Nicole's Will. Most people set up a testamentary trust under their Will for the benefit of any minor children. He could very rightly ask for compensation for all the work he will need to do as executor. Obviously he has NO designs on Anna's money.
