Can You Sing? Group Contest Rules

Each entrant ("Entrant") by entering the Perez Hilton Can You Sing Contest (the "Contest"), agrees to abide by and be bound by the Contest rules as set forth herein, as well as the official judge’s decisions, which shall be final and non-appealable. Therefore, please read these rules prior to entry to ensure you understand and agree. You, the Entrant, agree that submission of an entry in the Contest constitutes agreement to these rules. The Entrants may not submit an entry to the Contest and are not eligible to receive the prizes described in these rules unless such Entrants agree to these rules. These rules form a binding legal agreement between the Entrant and 323 Enterprises, LP with respect to the Contest.
There is no cost for submission (entry fee) or to gain any further level of participation in this Contest.
All entrants must be at least 18 years of age or older and be a U.S. citizen or permanent U.S. resident, unless otherwise stated and/or posted.
Employees of 323 Enterprises, LP as well as its parents, affiliates and subsidiaries are not eligible. Immediate family members and/or those living in the same households of 323 Enterprises, LP employees are not eligible.
The purpose of this contest is to identify the best singer of the group of entrants and provide exposure on Perezhilton.com
The odds of winning will depend on the number of eligible Entrant submissions received.
Beginning September 22, 2014 at 12:01AM (ET), through October 6, 2014 at 11:59PM (ET). Entrants must submit entries by uploading a video to YouTube.com and emailing the URL to videocontest@perezhilton.com. Entrants must cover part or all of Meghan Trainor's "All About That Bass." Entrants must verbally state at the beginning of the video that "this is an entry in the Perez Hilton Can You Sing Cover Competition." All Entrant submission videos will be added to the Perezhilton.com video channel "Can You Sing" playlist for review by the general public and the judge.
Entrants must consist of groups of two (2) or more singers. Entrants with only one (1) singer will not be considered. Only one entry per group.
Entrant hereby grants 323 Enterprises, LP the right to use, exhibit, distribute and exploit Entrant’s entry video in 323 Enterprises, LP’s sole discretion in any manner or medium throughout the universe in perpetuity, including without limitation, on Perezhilton.com and Perez Hilton’s Youtube channel.
All submissions must include a valid email address and phone number through which the Entrant can be contacted. All submissions are final and submitted entry videos may not be edited or resubmitted. 323 Enterprises, LP estimates the entries at roughly 500; however there is no minimum requirement for entries in order to win.
323 Enterprises, LP will not accept any submission sent through any other channel besides the official Contest entry email at videocontest@perezhilton.com. Entrants will receive a confirmation email to the email address they provided upon submission of their manuscript entry and its accompanying materials. If you submitted an entry to the Contest via the official form or email address and believe you did not receive a confirmation email in error, please contact info@perezhilton.com.
Two (2) winners will be picked from the Entrant videos.
One (1) winner (the "Perez Judged Winner") will be handpicked by Perez Hilton, based on Perez’s subjective, professional opinion of the following criteria (which will be equally weighted): vocal ability, stage presence, appropriateness of the music, appearance and entertainment value. Each category will be judged on a 1-20 basis, with a total score possible of 100.
In the case of a tie, the submission with the highest score out of 20 in category 1 (vocal ability) will be selected. If two submissions have the same score out of 20 and the same score in category 1, the submission with the highest score out of 20 in category 2 (stage presence) will be selected. If two submissions have the same total score and the same score in categories 1 and 2, the submission with the highest score out of 20 in category 3 (appropriateness of the music) will be selected.
323 Enterprises, LP reserves the right to judge each submission based on the above categories and to give each submission a final score out of 100 points without further explanation.
One (1) winner (the "Audience Favorite Winner") will be judged specifically based on the Entrant who receives the most YouTube "likes" as viewed on the Perez Hilton video channel "Can You Sing" playlist.
The two Contest winners will be announced publicly and will be presented their awards by 323 Enterprises, LP no later than October 31, 2014.
The two Contest winners will be notified individually via the contact information they provided via email 15 days prior to the announcement.
Non-placing entrants will receive no notification of their submissions’ status, nor will they receive any feedback.
The Perez Judged Winner will receive a cash prize of Five Hundred Dollars ($500).
The Audience Favorite Winner will receive a cash prize of Three Hundred Fifty Dollars ($350).
If the Perez Judged Winner and the Audience Favorite Winner are the same Entrant, such Entrant Winner shall receive a cash prize of One Thousand Dollars ($1,000).
Winners may not request substitutions of prize winnings. All winners are solely responsible for any and all taxes and/or fees, and all such additional costs that may be incurred. If the specified prize becomes unavailable due to unforeseen circumstances, 323 Enterprises, LP may substitute a prize of like or equal value. Any winner’s acceptance of a prize hereunder constitutes the grant of an unconditional right to use such winner’s name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, in any media, worldwide, in perpetuity, except where prohibited by law. Any portion of the prizes not accepted will be forfeited; 323 Enterprises, LP is not responsible for the inability of the winners to accept any prize for any reason.
You may request a list of the winner(s) after the end of the Contest by sending a self-addressed stamped envelope to 323 Enterprises, LP at the address listed on the Perezhilton.com website.
In the event of any conflict or discrepancy between the Contest rules and the Perezhilton.com terms and conditions, these Contest rules shall govern.
By participating in the Contest, all Entrants hereby release 323 Enterprises, LP, the Contest and their judges, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of the Contest, from any and against any and all injury, loss, or damage caused or claimed to be caused by such entrant’s participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and/or any and all tax and/or VAT liabilities or requirements related to any prizes, and such Entrant agrees that these entities are in no way or matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize.
Any dispute, claim or controversy arising out of or relating to the Contest and/or Entrant’s submission, these Contest rules and/or the termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Los Angeles, CA, before one (1) arbitrator. The arbitration shall be initiated and conducted according to either the JAMS Streamlined (for claims under $250,000) or the JAMS Comprehensive (for claims over $250,000) Arbitration Rules and Procedures at the Century City, California office of JAMS including the Optional Appeals Procedure. The arbitrator shall be a disinterested attorney or retired judge experienced in entertainment matters. Judgment on any award may be entered in any court of competent jurisdiction. You hereto consent to the jurisdiction of the Los Angeles federal and state courts for purposes of enforcing this arbitration agreement and proceedings and entry of judgment on any award and further consent that any process or notice of motion or other application to the Court or the judge thereof may be served by certified or registered mail, return receipt requested. The prevailing party shall be awarded reasonable costs, including, but not limited to, reasonable attorneys’ fees, associated with the arbitration. The arbitration will be conducted in private, and will not be open to the public or the media. No matter relating to the arbitration, including, without limitation, the nature of the dispute, testimony, evidence or result may be made public, reported to any news agency or publisher or disclosed to party not involved in the arbitration. Since a public hearing or arbitration arising hereunder might cause disclosure of confidential information contrary to the intent of 323 Enterprises, LP, you hereby stipulate that, in the event there is litigation or arbitration arising out of this release, all proprietary or other confidential information, shall be filed under seal and the court or the arbitrator(s) may issue a protective order restricting the disclosure and limiting the use of such information to any such proceedings.
323 Enterprises, LP reserves the right to alter the rules of the Contest at any time.
