Nelly Rape Investigation STILL Going Despite Accuser Backing Out!

Nelly is not off the hook for those rape charges yet.

His accuser may have dropped her case and refused to testify against the rapper, but the police are not giving up their investigation so easily.

TMZ has learned through their law enforcement sources that Auburn police still plan to present evidence to prosecutors within the next week. The district attorney will then decide if the case is strong enough to go forward without the accuser's help.

Nelly's lawyer, Scott Rosenblum, says it's just police doing their "due diligence" but that he's confident the case will be closed soon.

If the only evidence is testimony they no longer have, it seems strange to us they would even be proceeding… Could there be something more?

Nelly's Rape Accuser Is Dropping Her Case Against The Rapper!

It's over…

As we reported earlier this month, Nelly was arrested after a woman claimed he raped her on his tour bus in Washington.

According to a letter obtained by TMZ on Friday, the accuser's lawyer, Karen Koehler, says her client is dropping her case and will not testify against the rapper.

In the document, Koehler says the young lady told Auburn Police Department and the King County Prosecutor's Office "to put a halt to the criminal investigation."

Contrary to rumors, the "21 year old college student" never wanted "notoriety" or "a dime from that man," and feels utterly powerless against a celebrity. (You can read the full letter HERE.)

Scott Rosenblum, the Country Grammar artist's attorney, responded by saying the woman's "reckless accusation, once investigated thoroughly, was exposed for what it was-a fabrication. A fabrication that has caused Nelly and his family to suffer emotionally and financially."

Additionally, Rosenblum wants a public apology, and will recommend that Nelly pursue legal action against her. Yikes.

The allegations surrounding Nelly are getting more and more controversial by each passing day…

Now, we are learning more about the woman who came forward and accused him in the first place: a 21-year-old from Seattle who met the rapper at a club after his Friday night concert in Washington, and later went to his tour bus after they partied together.

Apparently, after the woman was invited onto the bus, she was in Nelly's room when he tried to have sex with her — to her objection.

UPDATE, 1:30 p.m. ET:

Nelly's lawyer has released a statement about the rape allegation:

"Nelly is the victim of a completely fabricated allegation. Our initial investigation, clearly establishes the allegation is devoid of credibility and is motivated by greed and vindictiveness. I am confident, once the scurrilous accusation is thoroughly investigated, there will be no charges. Nelly is prepared to pursue all all legal avenues to redress any damage caused by this clearly false allegation."

Details are still coming in at this point, but media reports are confirming that rapper Nelly has been arrested and is being investigated for allegedly raping a woman.

According to TMZ, the rapper was arrested after a woman claimed she was raped on his tour bus in Washington, where he's been performing.
