Nicollette Sheridan Won't Return For Final Season Of Desperate Housewives

Not that shocking of news considering the the circumstances, but still, nice to know for sure where she stands.

Nicollete Sheridan was on The Today Show on Monday to promote her new Hallmark Channel movie, but the conversation verged into more familiar territory when Kathie Lee Gifford and Billy Bush (filling in for Hoda Kotb) asked if she would consider having a cameo on the final season of Desperate Housewives.

Her answer: "[Edie's] dead."

That sounds like a no to us! LOLz!

If the situation were different, we would love to see her make a comeback in flashbacks or something. But it's so not going to happen. Anyone who thinks otherwise is kidding themselves.

Desperate Housewives Lawsuit Dramz Continues! Nicolette Sheridan Files New Legal Papers

This lawsuit keeps getting uglier.

To recap, Desperate Housewives' Nicollette Sheridan is suing show creator Marc Cherry for wrongful termination, breach of contract, and battery after her character was killed off the show.

Earlier this week, Cherry was disputing the claims of wrongful termination because "her contract only had a one year deal and the option to renew it wasn't utilized after the fifth season."

Now, Nicolette has filed new papers against Cherry claiming that she was fired from the show "for being a woman"

Here's what she said in the legal docs:

"Mr. Cherry harassed and discriminated against me because I am a woman."

"Mr. Cherry sang the praises of the other four leading actresses on the show but made disparaging comments about me and my character Edie Britt."

"Mr. Cherry was extremely controlling with respect to the scripts, particularly when the female actors on the show would propose script changes."

As we've said before, ABC and Marc Cherry should REALLY try to settle with Nicollette before it goes to trial this fall. It's just gonna get uglier.

Marc Cherry Wants Parts Of Nicolette Sheridan's Lawsuit Dismissed

This lawsuit is still happening??

Desperate Housewives creator Marc Cherry and the show's former star Nicolette Sheridan have been in what's felt like a years long legal battle. Sheridan is suing Cherry for wrongful termination, breach of contract, and battery after her character was killed off the show.

However, Cherry is disputing the claims of wrongful termination because her contract only had a one year deal and the option to renew it wasn't utilized after the fifth season.

His lawyers say:

"Sheridan's services were governed by - as they had been, year after year - a one year fixed term contract between Touchstone and Starlike, which gave Touchstone the option to renew Sheridan's services for six additional one year-terms (or Seasons)…Sheridan had no more expectation of renewed employment for a sixth season than she had after the first season."

Sheridan claims that he also physically assaulted, but dropped those charges back in December. Hmm, interesting.

The case is set to go to trial in the fall where we're sure to see PLEN-TY of fireworks between the two parties.

Nicollette Sheridan's Lawsuit Against Desperate Housewives To Go To Trial!

All the drama surrounding this TV show could be a show in and of itself!

As a reminder, it was around a year ago that Nicollette Sheridan filed a $20 million lawsuit against ABC and the creator behind Desperate Housewives Marc Cherry for sex discrimination and wrongful termination. As we mentioned last month, she claimed that she was struck by Marc in the face and that her character was killed off the show just so she could be fired.

Former staff writer Lori Kirkland Baker had come forward to back up Nicollette, but of course ABC countered Baker's testimony.

Now, Judge Elizabeth Allen White of L.A. County Superior Court has given Nicollette's lawsuit the OK to go to trial in June.

Nicollette's assault/sexual harassment charges against Marc Cherry were dismissed, but she was given approval to move forward with her lawsuit seeking damages for "wrongful termination and unlawful retaliation."

Hmm…MIGHT wanna consider trying to settle with Nicollette, ABC. Just sayin'!

Former Executive Producer Of Desperate Housewives Backs Nicollette Sheridan's Lawsuit Against Show

This is a big win for Nicollette Sheridan. With this deposition in place, she might finally have the leverage she needs to make ABC/Marc Cherry cave.

Almost a year ago to the day, Nicollette filed a $20 million lawsuit against the network and creator behind Desperate Housewives for sex discrimination and wrongful termination. She claimed that she was struck by Marc in the face and her character was killed off the show just so she could be fired. ABC and Marc have continually denied this accusation and insist the decision to off Edie Britt from Wistera Lane was a creative one made MONTHS before her alleged altercation with Marc in September 2008.

However, a former staff writer and producer for the show has come forward in defense of Nicollette and has provided a sworn testimony to the timeline of events that led up to Nic's firing. Lori Kirkland Baker corroborates Nicollette's timeline, saying:

"In fall of 2008, Mr. Cherry began talking with the writing staff, myself included, about killing off the Edie Britt character. I have no recollection of any decision to kill off the Edie Britt character prior to fall of 2008…Mr. Cherry had expressed to the writers, in my presence, increasing frustration with Ms. Sheridan."

Of course, ABC have a counter argument to the writer's testimony. They insist that Lori just wasn't privy to the information. Though she was a writer, they alleged the storyline was being kept "highly confidential to prevent leaks."

Sounds feasible…but unlikely. Yeah, sure, you don't tell the PA who is making $10 an hour to make coffee what you are planning for the show, but your writers? Really? You expect us to believe your writing staff was kept in the dark about such a major twist until only few weeks before it happened. Doubtful!

Nicolette Sheridan Drops Physical Injury And Emotional Distress Claims Against DH Creator

Looks like she's had a change of heart!

Former Desperate Housewives actress Nicollette Sheridan is dropping two of the most extreme claims from her lawsuit against her former DH employers, creator Marc Cherry, Touchstone Television, and ABC.

Back in April, Sheridan sued Cherry, Touchstone, and ABC, for $20 million, alleging assault and battery, emotional distress, gender violence, and wrongful termination. ABC responded that all of her claims were "without merit."

In regards to her physical injury and emotional distress claims, ABC required that she submit a physical and psychiatric evaluation, however, Sheridan has dropped those claims so she will no longer need to fulfill their evaluation request.

She still alleges though, that her physical injury claims are valid, but she wants to "streamline" the case.

Something seems a little fishy here.

It's On! Judge Lets Nicollette Sheridan Sue Desperate Housewives' Creator For $20 Million!!!

Hooray! Nicollette Sheridan is taking her Desperate Housewives apple and chucking right through Marc Cherry's window today!

Judge Elizabeth Allen White has granted the former Desperate cast member permission to sue the Men's Warehouse pants right off her old boss for alleged assault and battery, gender violence, wrongful termination and discrimination based on sex, sexual orientation and age! She's after $20 million!

Marc's lawyers tried to sway the judge by asking Nicollette's lawyers to clarify the discrimination portion of her complaint, but she wasn't having it. (Obviously, she agreed that the show tanked for a good season and half once her character met her demise!)

Get ready to see an EPIC Hollywood showdown with this one. ABC will come in with guns a'blazin', while Nicollette will wear a tasteful yet uber stylish court attire. Maybe we'll even get to hear a testimony or two from some of her former costars.

Screw the next season of Housewives! Put the cameras in this courtroom!!!

ABC Hires Special Lawyer To Handle Desperate Housewives Lawsuit!

Uh-oh!

ABC must be really sweating it out over Nicollette Sheridan's lawsuit against her former Desperate Housewives boss, Mark Cherry, because they've hired an employment litigation specialist attorney named Adam Levin to take care of this mess!

And this guy is NOT fooling around! He's apparently served the actress' legal team with requests for a videotaped deposition as well as private documents.

He says:

"We have served subpoenas and are vigorously moving forward with our defense. We intend to delve into the merits of her claims, all of which we strenuously dispute."

We have a feeling this whole thing is going to get a whole lot uglier - if that's even possible - real soon!
