Kevin Roper, the Walmart truck driver who hit Tracy Morgan's limo last year, wanted to get his criminal charges thrown out — but it looks like that didn't work exactly out.
On Wednesday, a New Jersey grand jury indicted Kevin for his involvement in the accident that killed comedian James McNair and injured the 30 Rock alum.
The grand jury formally charged the driver with first-degree aggravated manslaughter, second-degree vehicular homicide, and third-degree aggravated assault.

The trucker wanted the charges dismissed because his lawyer, David Glassman, said the actor's settlement with the department store drew a lot of attention toward the case.
The attorney claimed this would prevent Roper's trial from being a fair and impartial one.

According to legal reps, the truck driver AKA Kevin Roper wants criminal charges thrown out against him despite the severity of the case. For those who don't know, the crash killed Tracy's close friend and fellow comedian, James McNair.

Here's the tricky part: Morgan recently won a MASSIVE amount of money from a lawsuit against Walmart, the company Roper was driving for at the time of the incident. Given that Walmart essentially admitted wrongdoing by giving T.M. the cash, we have a feeling Kevin's request will be denied.
Despite the evidence against him, Roper believes the case should be dropped due to the public nature. Now that the legal matter is all over the news, the former truck driver thinks he won't be able to get a fair trial.
Unsurprisingly enough, this isn't the first time Kevin tried to get the charges dropped.
