OMG. Why won't they let this GO!?
The Obama Administration is putting taxpayer's money to good use by asking the Supreme Court to decide whether or not CBS should be fined $550,000 for Janet Jackson's infamous wardrobe malfunction during the Super Bowl halftime show in 2004.
As we mentioned last year, a federal appeals court ruled in favor of CBS, saying the Federal Communications Commission were improper since they never fined anyone before nipple gate took place.
Now the Supreme Court has to figure out whether or not the FCC's policies "violate the free speech rights of broadcasters airing profanity and sexual content, both in live and scripted form".
The high court won't decide on accepting the appeal until after it's reviewed in June or even the fall. If they end up putting the case on the docket a ruling would come down sometime next year at the earliest.
Who knew a nipple would cause almost a decade long legal battle!?
