It's sad how these huge legal settlements are paid out but the plaintiffs are rarely able to enjoy them.
This is one of those cases.
Steven Domalewski of Wayne, NJ was a little League pitcher who was hit in the chest by a line drive hit off an aluminum bat.
His heart stopped for 15 to 20 minutes before he was revived. During that time, his brain was so deprived of oxygen that now he is nearly blind, almost unable to talk and bound to a wheelchair.
His father said:
"We're thankful to God for the progress that he makes every week. His vocabulary is still very small. He can't walk on his own. I have to walk him."
Thankfully, his family just won a huge lawsuit against Hillerich & Bradsby (makers of the aluminum bat), Sports Authority and Little League Inc.
A statement from the lawsuit said:
"[The defendants] should have known that the subject baseball bat presented an unreasonable risk of harm to users and/or third parties who may come in contact with, or in the vicinity of, the subject baseball bat, and otherwise failed to design the product to reduce the risk of injuries to reasonably foreseeable users and/or third parties."
It's so sad that this family's son was effectively stolen from them.
The money will help to allow their son to be taken care of and live a more normal life.
