Iowa Judge Denies Chris Soules' Motion To Dismiss Felony Charge Against Him In Deadly 2017 Wreck

no title

Looks like one way or another, Chris Soules is going to have to face down some tough time in court.

Nearly a year ago now, the former Bachelor star and Dancing With The Stars alum was involved in a car accident in rural Iowa which left 66-year-old tractor driver Kenneth Mosher dead at the scene.

Soules left the scene of the accident early, and was later arrested for doing so.

After entering a not guilty plea back in May to the charges of leaving the scene of an accident — which is a felony — Soules' legal team has been filing motions to delay and dismiss various charges and other court hearings around the case.

Well, just a couple weeks ago, Soules again filed a motion to dismiss the felony charge against him, and now, we can report that

Former Bachelor Chris Soules Motions To Dismiss Hit-And-Run Charge, Says He Didn't Technically Break The Law

Chris Soules

Chris Soules is still dealing with the aftermath of his deadly car crash back in April.

As we reported, the former Bachelor was arrested after he allegedly left the scene of a fatal accident after his truck rammed into a John Deere tractor trailer, sending it into a ditch. Kenneth Moser — the driver of the tractor — died as a result of his injuries.

In September, the former reality star appeared at a five-minute pre-trial hearing in Iowa, where his attorneys asked the judge to dismiss his charge, which is considered a class D felony.

On Monday, Soules appeared in court once again — and his lawyer Robert Montgomery argued that the charge of failing to remain at the scene of a fatal collision should be dismissed because Soules did everything required of him by law. In the argument, the rep said Soules identified himself to a 911 dispatcher, provided aid to Mosher, and waited until emergency responders arrived.

On the other side, prosecutor Scott Brown refuted that argument by saying the law implies that drivers responsible for fatal crashes must remain until they speak with an officer. Brown insisted Soules took off in his truck, leaving before even the witnesses.

Whether or not the motion to dismiss the case will be determined by Judge Andrea Dryer at a later date. The trial is scheduled to start January 18.

More drama than an episode of The Bachelor

Back in April, Chris Soules was arrested after he allegedly left the scene of a deadly car crash after his Chevy pickup rammed into a John Deere tractor trailer, sending it into a ditch. Kenneth Moser — the driver of the tractor — died as a result of his injuries.

On Thursday, the reality TV star appeared at a five-minute pre-trial hearing in Iowa, wearing a navy suit, red tie, and brown shoes.

According to the Associated Press, his attorneys asked the judge to dismiss his charge, which is considered a class D felony.

NBC affiliate KWWL says Soules' legal team reached an agreement with the prosecution to withdraw a bill of particulars (a written statement of charges or claims by a plaintiff), and that the State of Iowa is going to amend the trial information.

While his charge will remain the same, the narrative surrounding it will change to allow possible dismissal.

The dismissal hearing is scheduled for October 10, while a jury trial has been scheduled for November 16.

Chris Soules Doesn't Want You To Call Deceased Car Crash Victim A 'Victim'!

no title

Then what else do you call him??

Back in April, Chris Soules was arrested after he allegedly left the scene of a deadly car crash after his Chevy pickup rammed into a John Deere tractor trailer, sending it into a ditch. Kenneth Moser — the driver of the tractor — died as a result of his injuries.

Fast forward to now, the former Bachelor star is currently a defendant in the hit-and-run trial, and wants to control how Moser is portrayed during the proceedings.

According to legal docs, the reality TV personality and his lawyers want to remove any mention of Kenneth as a "victim," as Soules has not been charged for causing the accident. Remember, he was arraigned for fleeing the scene of a deadly car crash.

Additionally, Soules and his counsel want to eliminate any mention that he bought or drank alcohol on the day of the incident. When he was later tested, there was no trace of drugs or booze in his system.

As we reported last month, the 35-year-old plead not guilty.

We just hope justice is brought down on anyone who breaks the law!

Chris Soules' Motion To Have Hit-And-Run Felony Charge Dismissed Denied By Iowa Judge

chris soules motion denied

Denied.

Chris Soules' attempt to have a class D felony charge dismissed has been officially shut down by an Iowa judge. Reportedly, the motion to dismiss is considered to be "procedurally moot" by the court. Oof.

This is just the first set back in what will likely be a lengthy legal battle for the Bachelor alum. As you surely know, the reality TV vet was arrested back in April for allegedly leaving the scene of a fatal car accident. Soules' legal team has since tried to defend that Chris didn't flee the crash scene as he called 911 and checked victim Kenneth Mosher's pulse before taking off.

Obviously, the court was not buying this defense. The scandalized celeb is currently house bound with an ankle monitor — and he should consider himself lucky!

Be sure to check back for updates as the 35-year-old is supposed to be arraigned on May 23.
