Louboutin Starts Fighting Dirty! Attacks YSL In French Newspaper

Let the mudslinging begin!

Christian Louboutin launched a verbal attack against Yves Saint Laurent in France's Libération newspaper last month and he didn't hold back.

In the article titled "Pinault doesn’t care about plagiarizing my red sole", Louboutin believes the fashion house's parent company PPR is being hypocritical:

"I find it most incredible that a group like PPR would take the risk of defending itself as a plagiarist. They claim to fight against counterfeiting and plagiarism of which they are victims and yet behave like this."

YSL's legal eagles were quick to fire back at Louboutin's claims, saying:

"YSL's use of red outsoles is not plagiarism of anyone else’s design. YSL is one of the most celebrated and original fashion houses in the world, and it has been using red outsoles to give life to its own venerated style traditions since long before Louboutin was even designing shoes."

The case went to an appeals judge last month and Louboutin expects a ruling by the summer.

Law professors have come to the defense of Yves Saint Laurent in the Christian Louboutin red-soled shoe saga.

On Tuesday 11 professors filed an amicus brief with the Federal Court of Appeals for the Second Circuit saying Louboutin's request to trademark a single color should be rejected because it goes against the doctrine of aesthetic functionality.

In a nutshell the aesthetic of functionality prevents companies from "using trademark as a kind of back door to perpetual patentlike protection for attractive but non-novel product features".
