What better way to celebrate being awarded a fourth star by The New York Times than getting sued by 27 workers, claiming they weren't paid legal wages!
Mario Batali's new restaurant in NYC, Del Posto, is the basis of a lawsuit filed in federal court by restaurant workers who claim that their managers improperly pooled tips and withheld some gratuities on wine and cheese sales.
According to the lawsuit, workers were awarded gratuities based on a point system, which operates as follows:
Captains - highest rung on waitstaff ladder - 6 points
Bartenders - 5 points
"Front Waiters" and Food "Expediters" - 4 points
Stockers - 2 points
Also according to the lawsuit, workers claimed they were getting short-handed on their share of a 23 percent service charge that is billed to patrons, which they all assumed was a gratuity.
These workers got flat fees of $150-$250 per shift, and they're seeking compensation which includes backpay, unspecified damages, and attorney's fees.
Hopefully you can get this all sorted out, Batali! Sure, you make wonderful food, but do you really feel comfortable knowing that you're mistreating all of your workers?
