Louboutin Files An Appeal In The Case Of The Red Soles

Christian Louboutin is ready to give Yves Saint Laurent hell!

As promised, the shoes designer's lawyers filed an appeal on Monday to reverse the ruling made by Judge Victor Marrero, who denied Louboutin's injunction request against YSL.

The appeal basically states the judge made a mistake, saying Louboutin's

"trademark status has been conferred upon it by the consuming public…only public recognition can breathe life into another mark, whether it be a single color, several colors or another design element"

Once YSL files their papers, Team Louboutin expects a ruling sometime in the spring.

Louboutin Plans To "Fight Like Hell" Against YSL

Less than a week after a New York judge denied Christian Louboutin's request for an injunction against Yves Saint Laurent, the shoe designer is appealing the decision.

On Friday, Monsieur Louboutin's lawyer Harley Lewin filed an appeal to oppose YSL's move for summary judgment.

As of last week YSL said they were in the process of making the request for summary judgment because Judge Victor Marrero doesn't think Louboutin can prove why he needs a trademark on his shoes.

If granted, Louboutin's trademark could be canceled, which is why Lewin says his client plans to "fight like hell".

A hearing is scheduled for August 19th, so stay tuned.

Louboutin's Injunction Against YSL DENIED!

Yves Saint Laurent has come out victorious in the battle of the red outsoles!

On Wednesday, a judge denied Christian Louboutin's request for a preliminary injunction against YSL because he thinks Louboutin would have a hard time proving why his shoes deserve trademark protection.

Judge Victor Marrero wrote in his ruling:

"Because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition, the court finds that Louboutin is unlikely to be able to prove that its red outsole brand is entitled to trademark protection, even if it has gained enough public recognition in the market to have acquired secondary meaning."

He has a point there. Trademarking a color is kinda ridiculous.

Small Victory For Christian Louboutin's Red Soles

Christian Louboutin: 1 Yves Saint Laurent: 0

The judge presiding over the red sole shoe battle sided with Monsieur Louboutin on Wednesday after ruling YSL's chart of red-soled shoes inadmissible.

Loub's lawyer argued the chart's accuracy couldn't be verified and Judge Victor Marrero agreed.

Not exactly a huge victory, but a victory nonetheless.

YSL and Louboutin are still waiting on a final decision, but no one knows when it's expected.
