Poor Kelly Rutherford can't catch a break.
After a blissful two months with her children Hermes and Helena in NYC, a judge ruled today that the kids must be sent back to live in Monaco with their father, Daniel Girsch.
And that's despite the fact that Kel's kiddos are U.S. citizens, the judge felt that they belong overseas with Daniel while he figures out his U.S. residency issues.
Earlier today, Rutherford refused to bring her children to the courthouse on the reasoning that the courts in California and New York previously said that they have no jurisdiction over the custody battle. Sadly, the law didn't agree with the actress.
The only positive from this situation is that another court hearing will be held on September 3 in Monaco to discuss the custody arrangement once again.
Except it doesn't seem fair that Girsch's residency problems is what is barring Kelly from her children! Shouldn't the babies live with the Gossip Girl star while Daniel figures his stuff out? So sad and confusing!
