Reason #241 why America rocks: All defendants in a court of law are presumed innocent until proven guilty.

Elmo puppeteer Kevin Clash has not yet been found guilty of any inappropriate sexual conduct with minors, so we must assume he's innocent of these nasty charges until we see evidence to the contrary!

Still, this weekend's development hurts our heart!

Three men claim Kevin sexually abused them while they were minors and they filed lawsuits saying as much.

Kevin's lawyer Michael Berger just filed a motion to combat this lawsuit, not by maintaining his client's innocence, but by saying the men aren't entitled to any money because the statute of limitations expired on their grievances.

Lindsay Lohan could get yet ANOTHER legal break, but this time it is not so that she can go back to her hard partying ways.

…at least that is what her lawyer, Mark Heller, claims.

After his failed attempt to get the case thrown out because the cops went all Regina George on her, LiLo's attorney motioned Friday to slow down the case—in which she violated her probation—so that she can work on being a better person.

In the document, Mark promises that delaying the case "will enable the Defendant who is pursuing and participating in certain activities which will benefit her and afford her more of an opportunity to be a productive and responsible person and contributor to society."

Nicollette Sheridan's wrongful termination lawsuit against ABC for killing off her character on Desperate Housewives has resulted in a mistrial, since the jury was deadlocked in an 8-4 vote on the matter.

While ABC and Touchstone Television are asking El Lay Superior Court Judge Elizabeth Allen to grant a verdict in their favor, Sheridan's lawyers are demanding a retrial. Since eight jury members voted in favor of the actress receiving punitive damages and they needed nine, her legal team thinks they can win a retrial and filed papers that state:

This is truly disappointing.

The Ninth Circuit Court of Appeals denied a motion today to lift the stay on same-sex marriages in the state of California, while the federal decision to reverse Proposition 8 is appealed, without giving any explanation as to why.

As a response, the American Foundation for Equal Rights released this statement:

“Several weeks ago, we filed a motion with the US Court of Appeals for the Ninth Circuit asking the Court to lift its stay and allow California’s gay and lesbian couples to marry. We felt then, as we do now, that it is decidedly unjust and unreasonable to expect California’s gay and lesbian couples to put their lives on hold and suffer daily discrimination as second-class citizens while their U.S. District Court victory comes to its final conclusion.

It is un-American to deprive gay and lesbian couples of their fundamental constitutional right to marry. These are adults in committed, loving relationships who just want to live their lives without government interference.

Last August, the U.S. District Court declared Proposition 8 unconstitutional. We believe that the courts will permanently secure the freedom to marry for all Californians."

Exactly!

Once again, the rights of gays and lesbians across this state have been STRIPPED from us, and we don't even get the decency of explanation as to why!

Shameful and so, so wrong.

Especially since it's only delaying the inevitable! EQUAL RIGHTS FOR ALL.
