Sofia Vergara's Ex Nick Loeb's Awful Embryo Lawsuit FINALLY Thrown Out!

no title

Finally Sofia Vergara can put this ridiculousness behind her!

And we like the legal precedent too!

In case it's been going on so long you've forgotten, Sofia's ex Nick Loeb — yes, her damn ex who had no reason to do this at all — had filed suit on behalf of two of her frozen embryos.

Using Louisiana's specific laws, he even named the embryos (Emma and Isabella) and cosigned their claim that Sofia's refusal to allow them to be put into a uterus and brought to term — something she would have no reason to do because AGAIN this is her damn ex — was depriving them of their inheritance.

Well, Louisiana's laws aren't going to help Nick anymore. On Friday, federal judge Mary Ann Vial Lemmon dismissed the suit, writing:

His latest court documents include a letter he wrote to the Modern Family star prior to their breakup, intended to prove something about their fights over the embryos.

But whatever, we don't care about that right now. Because he also said to her:

Sofia Vergara's Lawyer Responds To 'Unnecessary' Lawsuit Reportedly Filed On Behalf Of The Actress' Frozen Embryos

Sofia Vergara and Nick Loeb

What a mess.

As you probably know, Sofia Vergara's ex-fiancé Nick Loeb sued the Modern Family actress for the rights to two frozen embryos that were created when the pair were an item back in 2013.

According to a report yesterday, a new right-to-live lawsuit had been filed in Louisiana on behalf of the female fertilized eggs — reportedly referred to as "Isabella" and "Emma" — which asks the court to grant Loeb full custody so that he can have them implanted in a surrogate and they could receive a trust fund set up for them after birth.

This all comes after a California judge's request for Loeb to submit the names of two of his ex-girlfriends who underwent abortions around 20 years ago.

Sofia Vergara's Bizarre Custody Battle Rages On As The Actress Is Sued By Her Own Embryos

Sofia Vergara and Nick Loeb

Well, you don't hear this one every day.

As you know, Sofia Vergara is in the midst of a bitter legal war with ex-fiancé Nick Loeb over the rights to two frozen embryos that were created when the pair were an item back in 2013.

The custody battle took a bizarre turn on Tuesday when a new lawsuit was filed in a Louisiana court against the Modern Family star on behalf of the fertilized eggs — referred to in the legal docs as "Emma" and "Isabella."

According to Page Six, the suit argues the female embryos have the right to live so they can receive a trust that has been set up for them in Louisiana by the plaintiff and "trustee" James Carbonnet.

The trust reportedly promises to pay for things like the embryos' future health care and education. Hm.

The suit — which argues the exes' former agreement never specified what would happen in the event of a breakup — asks for the embryos to be put in Loeb's full custody so that they can be implanted in a surrogate, and eventually see the money from the reported trust.

Obviously, this unique case has the potential to set a huge precedent for embryo rights.

We'll certainly keep you updated as this complicated battle continues.

Sofia Vergara's embryo battle continues…

As we told you yesterday, a California judge ruled her former fiancé Nick Loeb must submit the names of two of his ex-girlfriends who underwent abortions around 20 years ago.

A little background, the 41-year-old — whose pro-life stance is the basis of his suit — is looking to implant two frozen embryos he created with the Modern Family actress when they were together, in order to realize his dream of becoming a father. Vergara and Loeb wrote an agreement that neither party would be able to take any action regarding the embryos without the other's consent — which is what Loeb is trying to get around.
