Olivier Martinez must've had a pretty rough flight, because he was NOT a happy camper when he landed at LAX last night!

After arriving in Los Angeles with Halle Berry and her daughter Nahla, the actor and his family were greeted by none other than the paparazzi. Well apparently he wasn't feeling all the flashes and things quickly got physical!

We've already learned that Gabriel Aubry will not be facing any criminal charges whatsoever for his involvement in the Thanksgiving day brawl which left he and ex Halle Berry's new fiance Olivier Martinez in the hospital after the pair resolved their issues via separate mediation sessions with the El Lay District Attorney!

However, there WAS a possibility that as a result of the incident, the Canadian model could be ordered into anger management classes!

But despite having a history of such requirements, he's been officially let off the hook!

When Halle Berry's ex and, um, Y met last November, more was given out than thanks!

According to police, Halle's baby daddy Gabriel Aubry took a swing at new fiance Olivier Martinez and earned himself a beatdown that would have ended a lot of modeling careers!

But Halle and Olivier decided to try to forgive and forget. Instead of pressing charges, Gabriel and Olivier met with the Los Angeles City Attorney- on different days, just to be on the safe side- to hash out amicable terms.

The final ruling is simple: NO criminal charges whatsoever! With one condition

McDonald's sales had dropped 2.2% in October, so they stayed open on Thanksgiving.

And wouldn't you know it, their sales climbed 2.5% in November!

So of course they'd like to try it again, to make even more money this holiday season.

Instead, Gabriel and Olivier will attend an office hearing where a city-appointed rep acts as mediator between the two conflicting parties so that all issues can be sorted out without a court case.
