Remember last month when a federal court awarded Gucci $4.7 million in damages stemming from a three trademark battle against GUESS and the brand's footwear licensee, Marc Fisher?

Christian Louboutin's been dealt another legal blow is his crusade against any and everyone producing red soled shoes!

Back in 2008 the French cobbler sued Zara France for counterfeiting and unfair competition over an open-toed shoe that looked identical to his YoYo heel.

After the court ruled in favor of Louboutin, Zara filed their own appeal, which resulted in the original decision being overturned in June of 2011 because "the terms of Louboutin’s trademark registration were too vague, noting for instance that it did not contain a Pantone color reference for the red soles".

Oops. That's why they pay lawyers the big bucks, right?

Last week the 4 year legal battle came to an end in France's final court of appeal, which upheld the 2011 ruling in favor of Zara. The court determined there was no legal or procedural error in the case and ordered Louboutin to pay Zara $3,600 as compensation.

We can only imagine the massive grins the folks at Yves Saint Laurent have across their faces right now!

Adidas' signature three stripes are JUST as identifiable as Nike's swoosh, so OF COURSE they'd be pissed if another shoe rips off their symbol!

Adidas AG and Adidas America Inc. have filed a lawsuit against Big 5 Sporting Goods and World Industries for creating/distributing sneaks that bear “confusingly similar imitations of Adidas’ three-stripe mark.”

The athletic clothing MEGA brand is asking for both companies to be permanently enjoined from using their trademark stripes, that all footwear bearing the mark be destroyed, and they want monetary and punitive damages and legal fees.

DAMN. They are super for serious!

We're sure those small, California based companies are feeling Adidas' burn!

It’s been over two years in the making, but it seems that Olivia Palermo is finally taking the steps to launch a line…of what? Not exactly sure!

According to reports, the former reality star and socialite has registered a trademark in her name in a variety of categories including pet clothing, collars, leashes, carriers, toiletry cases, purses, wallets, handbags, luggage and jewelry organizers.

That’s a LOT of stuff!

Although the trademark was filed, Olivia's reps issued a statement saying:

“Olivia does not have a line of accessories at the moment.”

Thanks captain obvi, but it sounds like Palermo is taking a cue from Rachel Zoe, and planning on a head-to-tail toe lifestyle brand.

Lawyers for Gucci and GUESS kicked off their copyright infringement battle in a New York federal court on Wednesday.

Here's the deets: in 2009 the Italian fashion house sued the jeans company for knocking off $200 million in Gucci product by "using a variety of design elements, including a block letter 'G', a combination of green and red stripes and diamond-logoed motifs".

Gucci's lead attorney Louis Ederer said in his opening statement:

"This case is not about following fashion trends. It’s about a massive, complicated scheme to knock off Gucci’s best-known and iconic designs."

He also added they had a "clear intent" to make shoppers "think it’s Gucci", but GUESS' attorney Daniel Petrocelli begged to differ. He fired back:

"Guess is not Gucci. It has no reason to be like Gucci and it did not scheme to be like Gucci…At the end of the day, it’s got to show up in the product, the proof is in the product. Gucci fabric, Gucci this, Gucci swatches. This is how they talk. That’s how they identify looks and feels and fabrics.…This case is built on a house of cards. That you can create intent from whole clothing and run it back and collect $220 million."

And that was only the first day!?

This is going to be good!

Trigger lawsuit happy fashion house Louis Vuitton do not do parody. In fact, they do not want anyone - ever - to even allude to anything they own, or they’ll slap a big, fat suit on ya!

Recently, The University of Pennsylvania Law School created some clever promotional posters for a symposium that focuses on all things having to do with Fashion Law.

The posters are a tongue-in-cheek reference to LV’s almost abusive intellectual property policy, replacing LV’s signature flowers and monograms with copyright logos.
