EXCLUSIVE! Kardashians' Khroma Vs. Chroma Battle Heats Up

Looks like this beauty dramz is not going to settle down anytime soon.

And we kinda love it!

Chroma Beauty, the high-end makeup line that has accused the Kardashians of stealing their name and confuzzling their customers, has hit back at Khloe Kardashian's claims that her and her sisters' name for their Khroma Beauty line came about organically.

Michael Rey, co-owner of Chroma, commented on the name issue exclusively to CoCoPerez.com, saying:

It's a shame that Boldface Licensing and Branding, the company that teamed with the Kardashians in creating their new makeup line, didn't do their homework. The Kardashians might have considered themselves clever when picking the name 'Khroma' for their new makeup line and spelling it with a K, but they ought to have known that we, Chroma have been doing business from our studio right here in Beverly Hills using 'Chroma' as a trademark for the past 12 years on our quality products and services. It seems hard to believe that the Kardashians and Boldface Licensing and Branding had not heard of, or seen our studio. Their actions have caused great concern and confusion with our clientele. Therefore, we have taken the action of filing both a lawsuit for trademark infringement and a motion for preliminary injunction to prevent further damage to our brand. We did not seek this battle but we will continue to do whatever necessary to defend the Chroma brand.

Uh oh, looks like the gloves are off!

And lest we forget, there is still the issue of that other Kroma makeup line suing the sisters for trademark infringement.

We're exhausted just trying to keep all the names straight!

Can't they all just kiss and make up?

Since the websites are run illegally, Coach likely won’t see much of this money, but it’s the principles that made it a victory.

The judge ruled that the websites must be shut down, and

A judgement was finally made yesterday in the three year bitter trademark battle between Gucci and GUESS.

As you may recall Gucci sought $221 million in damages, but a federal judge only awarded them $4.7 million, making GUESS the real winner in this case.

In the 104 page opinion, U.S. District Court Judge Shira Scheindlin wrote

Burberry Awarded $100 Million From Counterfeit Websites!

burberry-wins-100-million-judgement-against-chinese-internet-counterfeit-network.jpg

It may not be as big as UGG Australia's payday, but it's still a lot of moola!

Burberry is $100 million richer, thanks to a default judgement made by a Manhattan Federal court on Thursday.

Judge Thomas Griesa awarded the British brand the hefty sum of money after the defendants, a network of Chinese Internet counterfeiters, failed to show up in court.

It also didn't help that the online fraudsters, who were accused of selling at least 22 types of fake goods bearing Burberry trademarks, never responded to the initial complaint filed back in January.

In addition to the 9 figure judgement, Burberry now has the power to shut down other infringing sites and hold third-party hosts like Google and Facebook accountable for associating with them.

Congrats!

Gucci Gets Their Day In Court With GUESS

gucci-guess-trademark-lawsuit-federal-court.jpg

Lawyers for Gucci and GUESS kicked off their copyright infringement battle in a New York federal court on Wednesday.

Here's the deets: in 2009 the Italian fashion house sued the jeans company for knocking off $200 million in Gucci product by "using a variety of design elements, including a block letter 'G', a combination of green and red stripes and diamond-logoed motifs".

Gucci's lead attorney Louis Ederer said in his opening statement:

"This case is not about following fashion trends. It’s about a massive, complicated scheme to knock off Gucci’s best-known and iconic designs."

He also added they had a "clear intent" to make shoppers "think it’s Gucci", but GUESS' attorney Daniel Petrocelli begged to differ. He fired back:

"Guess is not Gucci. It has no reason to be like Gucci and it did not scheme to be like Gucci…At the end of the day, it’s got to show up in the product, the proof is in the product. Gucci fabric, Gucci this, Gucci swatches. This is how they talk. That’s how they identify looks and feels and fabrics.…This case is built on a house of cards. That you can create intent from whole clothing and run it back and collect $220 million."

And that was only the first day!?

This is going to be good!

Thoughts???
