Proposition 8 Ruling: Why The Supreme Court Effectively Killed The Anti-Equality Marriage Law

proposition 8 ruling explained doma struck down supreme court unconstitutional same sex marriage tolerance yay

By now, you've hopefully heard the AH-Mazing news!

Today the U.S. Supreme Court declared the Defense of Marriage Act unconstitutional and effective ended the rule of California's Proposition 8 which prohibited the state from recognizing any marriage that wasn't between a man and woman.

The reason for the death of DOMA was simple, the Justices decided (5-4) that it directly violated rights guaranteed by the Fifth Amendment's "due process" clause which prevents the government from unjustly depriving any citizen of "life, liberty, or property."

The Supreme Court's ruling on Prop 8, however, was a tad more complicated.

SCOTUS never confirmed whether or not Prop 8 was unconstitutional, but they nevertheless

facebook twitter gay marriage debate pink red equal signs human rights campaign supreme court

Don't adjust your browsers, dear readers — neither Facebook nor Twitter are broken!

You probably woke up to pink and red equal signs taking your social media outlets by storm this morning, but fear not because it's all for a totally awesome cause!!

The US Supreme Court spent Tuesday dragging its feet while listening to arguments for and against gay marriage, but there are millions of people who refused to let their voices go unheard!!

In an effort to bring awareness to the critically important battle to allow all couples who love each other the right to marry, the miracle workers over at the Human Rights Campaign are encouraging EVERYONE — us, you, your crazy uncle who doesn't like kids walking on their lawn — to replace their profile pics with these pink and red equal signs for these next few critical days.

This is pretty much the greatest idea since

Same Old Story! Wesley Snipes Will Stay In Jail After Court Denies His Appeal!

wesley snipes appeal denied again

This is truly becoming a tale as old as time!

To recap, Wesley Snipes was convicted in 2008 on tax evasion charges, and he was sentenced to three years in federal minimum security prison, beginning in December 2010.

Then, he tried to file an appeal requesting a new trial with the U.S. Supreme Court back in December…but he was denied.

Now, the Blade/Major League actor has once again tried to appeal his prison sentence, but the 11th Circuit Court of Appeals in Atlanta rejected his request.

This kind of reminds us of the whole Phil Spector thing…but on a much less extreme scale!

Do U think Wesley Snipes has served enough time? Or should he stay in jail???

Appeal Denied! Wesley Snipes Will Stay In Jail

wesley snipes appeal gets denied

Tough times continue for Wesley!

Back in December, actor-turned-tax-evader Wesley Snipes filed an appeal requesting that he get a new trial with the U.S. Supreme Court.

Unfortunately for Wes, the Supreme Court isn't interested, and his latest attempt to get his sentence overturned has been denied.

As a reminder, Wesley was convicted in 2008 on tax evasion charges, and was sentenced to three years in federal minimum security prison starting last December.

Sorry to hear it, Wes, but as we've said before, actions have consequences.

Hopefully you continue trying to make the best of your time away, and who knows? Maybe you'll get some new acting opportunities when you get out!

What do U think about Wesley's appeal getting denied? Does he deserve another trial?

Wesley Snipes Files Appeal To The Supreme Court

Even in prison, Wesley Snipes is making sure his voice gets heard!

Attorneys for the actor have filed a new appeal, asking the court to let him out of prison so that he can take his case all the way to the U.S. Supreme Court.

Snipes is asking the Court of Appeals to overturn their decision that ordered him to jail last week. He believes he deserves a new trial because there was an alleged juror bias during his tax evasion case.

Seems pretty ballsy! But, you can't blame him for wanting to fight!

Thoughts??

Equality For All! Federal Judge To Make Decision Regarding Proposition 8!

Filed under: Gay Gay GayLegal MattersPolitik

Let's all keep our fingers crossed!

Chief U.S. District Judge Vaughn Walker has heard both arguments from the opposing views, and now will be determining whether or not Proposition 8, the ban placed on gay marriage in California, is actually constitutional!

Attorneys Andy Pugno and Charles Cooper are defending the legality of Proposition 8, and Pugno writes:

"Historic marriage has its roots in pairing a man to a woman and has served as the foundation of the family and society as a whole. To change the definition of marriage… would result in such a profound change to the structure and public meaning of marriage as to severely damage society, possibly beyond repair."

AKA bullshiz!

Meanwhile, former Republican Solicitor General Ted Olsen and David Boies have represented the plaintiffs, and argue that Proposition 8 is "the result of disapproval or animus against a politically unpopular group" and represents "a backlash that stripped gays and lesbians of the rights previously conferred upon them by the California Supreme Court…and violates the equal protection clause of the Fourteenth Amendment."

Exactly!

Judge Walker isn't expected to make his decision for another few weeks, but regardless of the outcome, the ruling is expected to be appealed all the way through the system until it reaches the U.S. Supreme Court!

It's time for a change, people! Equal rights FOR ALL!
